Abstract

Thought of ‘Fikih Sosial’ Kiai Sahal Mahfudh is a method to explore and respond to the dynamics of law in society. ‘Fikih Sosial’ is a model of fiqh development based maṣlaḥah oriented with a clear manhaj. As an embryo of ‘fikih peradaban’ (civilizing fiqh), ‘Fikih Sosial’ was based on the method of the underlying ideas of Moslem scholars (‘ulamā’), not a product of their thoughts. Therefore, to follow the method, may result the same product and the different one as well. The method is to contextualize ‘traditional authoritative book’ (al-kutub al-mu’tabarah) through the undestanding of the applications of rules of uṣūl al-fiqh or qawā’id al-fiqhiyyah. The development of masālik al-'illah theory is also urgent in accordance with producing fikih based maṣlaḥah al-'āmmah. In this position, fikih Kiai Sahal completely answers the problem of the integration of authenticity and modernity which are often contradictory and antagonistic

Abstract

KH. Ali Yafie is a great scholar of the archipelago who performs ijtihad in the field of classical fiqh with the paradigm and action of fiqh reform so as to give birth to concepts that are applicable to the modern world. This research aims to explain the study of legal istinbath conducted by KH. Ali Yafie in the renewal of fiqh. This research is a library research with a descriptive qualitative approach. Data collection is done through documentation and interviews. The data analysis technique uses Miles and Huberman data analysis through three stages, namely data reduction, data presentation, and conclusion drawing. The results of the study explain that KH Ali Yafie's style of istinbath law is istislahi-maqashidi which prioritizes the general propositions of sharia and prioritizes benefit. KH Ali Yafie's paradigm of thought reform revolves around the concepts of tajdid, ijtihad, fiqh development, and istishlah. These four concepts encourage the dynamization and contextualization of fiqh so that it can answer social problems contextually and solutively. Meanwhile, the product of KH Ali Yafie's fiqh thinking revolves around four aspects, namely worship, mu'amalah, munakahah, and jinayat.

Abstract

The Pati Regent Regulation Number 8 of 2025 provides legality for a 100% tax increase. However, the Regent increased the land and building tax (PBB-P2) to 250%. This increase aims to boost Regional Original Income, supporting infrastructure development programs and public services. This increase is intended to adjust the PBB-P2 rate after 14 years of no change. This increase in the PBB-P2 tax has caused pros and cons in society. In general, the community is burdened by this tax increase. This paper examines in depth whether this increase in PPB P2 tax is relevant. The research method employed is a robust descriptive-analytical approach, ensuring a comprehensive analysis. The theoretical framework used is justice, maslahah, and fiqh sosial, providing a solid foundation for the study. The analysis method employs critical discourse to examine the power that underpins the ideology of the dominant group, legitimizing its dominance. The results of this study indicate that the increase in PBB-P2 tax up to 250% is contrary to the values of justice, maslahah, and fiqh sosial, which lead to maqashidus shariah, namely protecting religion, soul, mind, property, and descendants. Justice demands that a leader prioritize honesty, solidarity, and compassion. The maslahah demands a leader who sides with the most vulnerable members of society. Meanwhile, fiqh sosial encourages the achievement of maqashidus sharia. The increase in the PBB-P2 tax suggests that a leader lacks honesty, compassion, and solidarity in acknowledging the suffering of their people.
