Abstract

Muslim scholars disagree as how old lady Aisyah was when she married Prophet Muhammad. One of the popular records reported by Hisyam bin Urwah says that she was about 6 and 9 years old. However, more recent careful study of hadits shows that the Hisyam bin Urwah's version of report is contradictory with other available reports, and therefore the validity of the hadits is in doubt. Nonetheless it is both interesting and strange to see how the hadits has been used as a valid argument by opponents of Islam to destroy the image of the Prophet and Islamic teaching in general, and even by Muslims themselves to justify their interests to take advantages of marrying young girls. This paper aims at reexamining the aunthenticity and validity of the hadits reported by Hisyam bin Urwah regarding the marriage lady Aisyah with Prophet Muhammad.

Abstract

Reconstructing women to obtain a role equal to that of men requires cognizance on how to deconstruct the dominant ideology of the patriarch. As representation plays as a mean of legitimating or preserving ideology and social phenomenon, women should be put forward taking roles traditionally accomplished my men. This is not an easy task however, because at the end actual representation ultimately reflects social culture.

Abstract

Trafficking was initially associated with prostitution but, infact, it includes some other exploitations and slavery. Human trafficking keeps growing and its farm and complexity are changing from time to time_the only persistent thing is its characteristic of human exploitation. It is illegal activity and is against human rights: it is against the rights of its victims, which include women, children and worker. Trafficking is vulnerable to the emergence of violence against human beings, unwanted pregnancy, and sexually transmitted (STD) and infectious diseases. The networks of trafficking are currently well organized and, therefore, it demands a more serious and global attention to deal with the issue. Each country, including Indonesia, has to rethink about its system of law to be able to prosecute the traffickers and help the victims, both materially and immaterially. Some countries have ratified and implemented the anti-trafficking law. In Indonesia, however, the law is presently neither ratified nor implemented yet. The government of Indonesia, nonetheless, proclaimed the national action plan for the elimination of trafficking in women and children and made RUU (draft of laws) on anti, trafficking. So many women and children in Indonesia are waiting for the law that liberates them from any violence or exploitation and enables them to enjoy freedom of life. This draft, therefore, has to be immediately ratified.

Abstract

Special attention to the study of the hadith or sunnah of the Prophet as the second source of Islamic law, led Al-Sinkili to a greater appreciation of the meaning of sharia and Sufism. This can be found in references to works in the form of tafsir, fiqh, and Sufism in the form of hadith histories. This research uses qualitative methods and is descriptive analysis, namely by systematically describing and describing discussion materials obtained from various sources, both primary and secondary sources which are then analyzed to obtain research results. The results of this research, especially regarding the development of hadith studies in Indonesia in the XVII-XVIII centuries, provide an illustration that hadith at that time had not yet developed into a separate discipline, because the study of hadith was new on a practical plane, not yet theoretically structured. Although there has been Al-Sinkili's work on hadith, namely; Syarah Latif 'ala Arba'in Hadisan li Imam an-Nawawi and al-Mawa'iz al-Badi'ah, but access to these works is still very difficult.

Abstract

Context analysis plays an important role in understanding revelatory events, because the concept of "revelation" cannot be understood unless you look at the previous context. This indicates that there is a relationship between reality (as context) and the text. One cannot possibly understand by taking the text outside of reality. Therefore, asbab al-nuzul (events that occurred and accompanied the revelation of a verse of the Qur'an) is very necessary to understand a condition. But the context here is broader than asbab al-nuzul, because asbab al-nuzul becomes necessary only to see special events. This assumption about asbab al-nuzul was developed by A'isyah Bint al-Syathi'. According to him, asbab al-nuzul is nothing more than postulates surrounding the text, or external conditions of revelation. Therefore, he emphasizes the universality of meaning rather than the specificity of the condition (al-'ibratu bi'umum al-lafzi la bi specifically al-sabab). He tried to develop a "narrative text theory" that stated that verses were revealed based on specific reasons but were expressed in the form of general pronunciations, so the general pronunciation was used as a guide.
