Abstract

Hukum Islam diterapkan di semua tempat di mana umat Islam berada untuk menerapkan ajaran-ajaran Islam dari Al-Qur’an dan sunnah, juga qaul-qaul ulama dalam ijma dan qiyas. Penerapannya di masing-masing tempat selalu berhubungan dengan politik hukum kekuasaan dan keadaan di mana wilayah itu berada, serta adanya musyawarah dan politik hukum kekuasaan di antara para ulama dan penguasa. Khususnya di masyarakat Jawa, hal ini terlihat dengan jelas, bagaimana elit bangsawan dan ulama berperan, sehingga corak politik hukum kekuasaan di kalangan muslim Jawa memiliki dimensinya karena ada dialektika lokal daerah, prakrassa ulama dan elit bangsawan. Tulisan ini ingin melihat politik hukum kekuasaan yang dijalankan ulama dan elit bangsawan di tanah Jawa di masa-masa awal, untuk dijadikan bahan refleksi bagi pengembangan gerakan Islam kultural di Jawa, dengan tetap mengacu pada hukum Islam yang, dalam batas-batas tertentu harus diterapkan secara fleksibel, selain pada soal hukum-hukum elementer, seperti sholat, puasa, dan haji. Oleh karena itu, tulisan ini ingin melacak: politik penyebaran Islam dalam menerapkan hukum Islam di dalam masyarakat Jawa, hubungan elit bangsawan dan ulama penyebar Islam di masa awal, da hukum Islam secara kultural yanmg diterapkan di masyarakat Jawa; dan relevansinya untuk saat ini.

Abstract

Islamic law is applied in all places where Muslims are to apply the teachings of Islam from the Qur’an and sunnah, as well as the qaul-qaul of scholars in ijma and qiyas. Its application in each place is always related to the political law of power and the situation in which the region is located, as well as the existence of deliberations and political law of power between the scholars and rulers. Especially in Javanese society, this is clearly seen, how the aristocratic elite and scholars play a role, so that the political pattern of power law among Javanese Muslims has its dimensions because there is a local dialectic, prakrassa ulama and aristocratic elite. This article would like to see the political law of power carried out by scholars and aristocratic elites in Java in the early days, as a reflection for the development of the cultural Islamic movement in Java, while still referring to Islamic law which, within certain limits must be applied flexible, in addition to the question of elementary laws, such as prayer, fasting, and pilgrimage. Therefore, this article would like to trace: the politics of the spread of Islam in the application of Islamic law in Javanese society, the relationship of elite nobles and scholars who spread Islam in the early days, and the Islamic law culturally applied in Javanese society; and its relevance for the present.

Abstract

The rising of the religious sects that are claimed as deviated and infidel has been a controversial issue today. This paper reviews the phenomenon, both from the basic of Muslim’s faith and from the historical context. Based on these perspectives, this article analyzes the phenomenon of the religious sects vis a vis major groups of Islam. This phenomenon can be categorized into two perspectives; first, the sects which are claimed as deviated can be categorized as madzhab in Islam. Second, those sects can also be indicated as new religion. From the mainstream Muslim group side, the sects was not admiited both as madzhab of Islam and also new religion, because they believe that there is no true religion but Islam. Therefore, all these sects will be refused and should be destroyed. Here, Muslims are not able to make the norms of living together and harmony.In fact, Islam teaches freedom of speech, thought, and faith. Every one can choose  anything without any pressure. To overcome their daily problems, they have to have sense of humanity and non-violence attitudes.Keywords: deviating, streams in Islam, problems, and civilised society
