Abstract

Keadilan sangat sulit diperoleh bagi perempuan, terbukti dengan maraknya korban Kekerasan Dalam Rumah Tangga (KDRT). Keadilan disimbolkan dengan Dewi Themis, yang notabene adalah perempuan. Dewi Themis digambarkan mengenakan tutup mata, memegang timbangan, dan membawa pedang bermata dua untuk menjamin kekuatan pertimbangan dan keadilan. Tutup mata yang dikenakan Dewi Themis manandakan agar keadilan dapat diberikan secara objektif tanpa pandang bulu. Namun sepertinya tutup mata ini menjadi hambatan bagi Sang Dewi Themis akhirnya tidak dapat melihat bahwa timbangan yang di bawahnya tidak seimbang. Tutup mata itu membuat Dewi Themis tidak mampu melihat bahwa pedang bermata dua yang dibawanya malah membuat korban kembali, menjadi korban karena tertusuk oleh sisi mata pedang yang terarah kepadanya. Akhirnya dengan tutup mata itu, Dewi Themis tidak mampu lagi melihat kebenaran untuk dapat memberikan keadilan pada pihak yang berhak menerimanya. Apakah fiqh termasuk seperti Dewi Themis tersebut yang sudah tertutup matanya sehingga sudah tidak bisa lagi melihat realitas kebenaran dan keadilan di depannya, sehingga dengan dawuhnya mensubordinatkan nilai keadilan bagi perempuan. Padahal pencarian keadilan merupakan salah satu fitrah kemanusiaan, yang harus tetap ditegakkan sebagaimana firman Allah Q.S. al-Maidah (5) : 8 “I’dilû, huwa aqrabu littaqwâ” yang artinya “berbuat adillah, hal itu lebih mendekatkan ke takwa”, begitupun menurut ahli filsafat zaman Romawi kuno, M.Tullius Cicero (106-43 SM) yang terkenal “Fiat Justitia Fereat Mundus” yang artinya “laksanakan keadilan walaupun langit akan runtuh”

Abstract

Masjid di samping peranannya sebagai tempat peribadatan umat Islam, beralih peran menjadi medan kontestasi, berupa adanya peralihan dan perubahan keberagamaan masayarakat muslim di Indonesia dalam berbagai aspek seperti ekonomi, sosial dan budaya. Istilah “sepi” dalam Masjid, bermakna “sepi” di sini adalah terjadi degradasi spirit, degradasi moral dan degradasi ritual keagamaan. Degradasi adalah sebuah kemunduran, kemerosotan, penurunan aktivitas keagamaan baik secara mutu, moral, ritual bahkan derajat atau maqam (tingkat) keagamaan. Namun di balik degradasi tersebut ironisnya adalah meningkatnya keramaian dengan beragam aktivitas pengunjung yang berhasrat datang kemasjid tersebut dengan silih-berganti, pada kondisi inilah adanya proses “medan kontestasi”. Masjid menjadi pusat “profit oriented” sekaligus “human oriented” untuk kepentingan tertentu dengan berdalih atas nama agama. Bukti lokus adanya medan kontestasi pada Masjid Dian al-Mahri (masjid Kuba Emas), beragam kontestasi telah dihadirkan oleh Masjid ini, dengan dalih agama. Diantara wujud kontestasi Masjid tersebut adalah Masjid yang ber-Kuba Emas. Panorama yang indah nan asri di sekeliling Masjid dengan adanya Vila, dan Gedung Serba Guna dengan segala fasilitasnya yang disewakan untuk acara penyelenggaraan Akad Nikah, serta memberikan fasilitas kepada umat tentang penyelenggaraan Manasik Haji & Umroh. Peneliti masih mendalami lebih lanjut lagi untuk menunjukkan lebih banyak lagi bentuk kontestasi-kontestasi yang disajikan oleh Masjid Kuba Emas, juga akan mendalami secara holistik tentang kepentingan apa dibalik pendirian masjid Kuba Emas ini ? Pada dasarnya kontestasi Masjid sebenarnya tidak hanya terjadi pada Masjid Kuba Emas saja, namun sangat terbuka dengan Masjid-Masjid lainnya. Namun Masjid Kuba Emas sebagai salah satu contoh, karena satu-satunya Masjid dengan nuansa wisata religinya, memiliki lahan Masjid yang sangat luas, bebas diakses untuk umum, memiliki halaman parkir lebar, memiliki gedung serba guna, serta adanya faktor pendukung berupa tempat-tempat indah yang menjadikan Masjid ini layak dikatakan sebagai tempat wisata religi.

Abstract

This research is motivated by Article 171 KHI and Article 832 of the Civil Code concerning inheritance groups, it is explained in these articles that people or families who are entitled to receive inheritance include 15 groups of men and 10 groups of women, which groups are the closest people to the heir. According to Islamic law, a child out of wedlock, whether a child of adultery or li'an, is not entitled to inherit from his father's lineage and vice versa if the child out of wedlock dies, then the father cannot inherit from the child. However, when viewed from a humanitarian point of view, he can still receive inheritance from his father, but not by dividing the inheritance of children in general, but by grants, and the share may not be more than 1/3 of the inheritance. Meanwhile, according to civil law, a child out of wedlock gets a share of his father's inheritance as much as 1/3, ½, and ¾ of the share of a legitimate child depending on what class of heirs the child lives together after the heir dies. As for the source of Islamic inheritance law which is used as a guideline in the distribution of inheritance, it is listed in the Qur'an in the letter An Nisaa verses 7, 11, 12 and 176, and in the letter An Naml verse 16. Meanwhile, civil inheritance law is regulated in book II concerning objects (Van Zaken) which contains object law (Zaken Recht) and inheritance law (Erfrecht).

Abstract

This research aims to find out how contemporary issues related to religion as well as a challenge for Islamic da'wah, such as secularism, religious pluralism, liberal Islam (religious liberalism), radicalism-terrorism, and so on. The type of research used in this study uses a descriptive-qualitative library research approach, with the primary source being several references related to contemporary da'wah, while additional (secondary) sources and several references in the form of journals, books, and online media as supporting data that correlate with the focus of research. The results of this study indicate that Islam and its people, who are in the vortex of global currents and related to some contemporary issues, should come to the surface with contemporary Islamic ideas or thoughts to answer the challenges of da'wah while positioning Islam as a universal religion. Contemporary Islamic thought is thought to bridge two poles between tradition and modernity (al-turāts wa al-Hadassah) to raise new awareness and give birth to ideas that can respond to contemporary problems. Recommendations for further research with this research are expected to add insight related to contemporary issues.

Abstract

The marginality of Islamic world in the scientific scene due to the lack of methodology. The only methodology that is found in Islam is ushul fiqh. However, ushul fiqhis no longer able to grow because it was regarded as something raw and can not be increased. In that context, the position of ushul fiqhis no longer as a methodology, but it would be a patent for each madzhableaders and its followers. Qur’anic methodology is expected to be used to bring Muslims to continue with varying views of contemporary ijtihad. Yet, it still based on the basic inspiration of the Qur’an as a major source and a guidance of the world and the hereafter. Qur’anic-based methodology here, referring to two prominent scholars of Islamic thought, Fazlur Rahman and Muhammad Shahrur. Fazlur Rahman offers a method of interpretation of the Qur’an which he called the theory of double movement. While, Muhammad Shahrur offers a method of interpretation of the Qur’an namely the theory of limits (hudud). Through interpretation of double movement and hudud theory, it is expected to create science revolutionary on the science of usul fiqh as a characteristic of methodology product of Muslims.
