Abstract

Penyusunan penelitian ini memiliki tujuan untuk mengetahui eksistensi penerapan sebuah perundang-undangan perkawinan dalam Undang-Undang Nomor 16 Tahun 2019 tentang perkawinan pada perkara batas usia dan syarat perkawinan. Yang mana eksistensinya Undang-Undang tersebut merujuk pada perspektif hukum Islam yang notabene tidak menjelaskan secara spesifik aturan batas usia minimum dalam melaksanakan perkawinan. Dalam penelitian ini menggunakan pendekatan metode penelitian hukum normatif. Yang mana penelitian hukum normatif merupakan penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder sehingga dapat melihat sejauh mana penerapan Undang-Undang perkawinan diterapkan di Indonesia yang notabene mayoritas beragama Islam. Dengan persepektif agama Islam bedasarkan pendapat para ulama yang telah memberi rambu-rambu terhadap batas usia perkawinan, maka dengan terbitnya Undang-Undang perkawinan di Indonesia maka menjadi jelas bahwa penetapan usia minimum dalam melaksankan perkawinan adalah kebijakan pemerintah guna menekan angka kemiskinan, kematian, tingkat perceraian dan dampak negatif lainnya akibat pernikahan diusia kurang atau tidak matang.

Abstract

The interpretation of professional ethics in this study discusses how law enforcers make efforts to restore public trust in the law and the legal profession. The background of this study is social issues about law enforcers, the role of law enforcers is considered not to side with the truth but with profit, so that some people consider the legal profession not to be law enforcers but rather a legal business. The behavior of violating legal ethics makes the legal principles of certainty, justice and legal benefits cannot be felt by some legal subjects (society). The purpose of this study is to demand that legal professions better understand and dare to practice ethics and professional codes of ethics in everyday life and be able to restore public trust in the legal profession. This study uses normative juridical legal methods through library data, regulations related to issues and problems that occur in the field. The results of this study are 1). With the interpretation of professional ethics, legal professions can implement legal services in accordance with the code of ethics and principles of law enforcers to create certainty, justice and benefits for the community, 2). Public trust will increase in the legal profession as law enforcers who can protect the community. The negative impact of the legal profession's inability to implement ethics and codes of ethics for the legal profession will result in a loss of public trust in law enforcement itself.

Abstract

Islamic economy is in the middle of a developed society model which becomes a separate measure or barometer for practicing all transactions based on uluhiyah and insaniyha. As a representative of Islamic teachings that are able to provide benefits to all living things, Islamic economy is able to provide movement and influence on society in its economic practices. Islamic economics as part of the social sector tries to offer an economic action that is beneficial to all economic and social actors, which makes the existence of Islamic economics as a means of self-revolution from a capitalist concept that prioritizes personal gain towards Islamic behavior, namely prioritizing interests vertically (after all: God ) and horizontal interests (humanity). The implementation of Islamic economics emerges from a set of basic Islamic laws, namely: Al-Quran and Hadith as the primary law and the ulama's ijtihad as the primary legal basis. Prophet Muhammad SAW, his companions and tabi'i, tabi'in and scholars in the past and present are a reflection of the level of building a good relationship with the progress of Islam as a civilized religion and as a barometer for shaping an Islamic character, namely upholding the values human value. In conditions like this, when mankind begins to neglect their own brothers because of their own enrichment (capitalism) so that they become uncivilized human beings, then here God's lovers give an example which then influences humans to become Islamic humans through the means of preaching, namely the concept. application or implementation of Islamic economics.
