Abstract

Kebocoran data saat ini menjadi sangat umum di kalangan pengguna. Dalam beberapa kasus, hal ini bermula dari kelalaian, kealpaan, atau bahkan kesalahan dalam mengelola atau mengendalikan data, terutama sistem aplikasi yang digunakan dalam memproses data. Sayangnya, kasus kebocoran data juga menjadi masalah umum yang besar di Indonesia, yang mana terakhir kali ditandai dengan 282 data Pusat Data Nasional (PDN) hilang dan hanya 44 yang memiliki cadangan. Hal ini menyebabkan target utama penulis tertuju pada dampak kebocoran data yang terjadi di pemerintah dan masyarakat Indonesia bagi keamanan nasional negara. Teori Keamanan Nasional digunakan dalam penulisan ini guna membantu penulis untuk menganalisis dampak-dampak kebocoran data di Indonesia. Alhasil, pemerintah Indonesia mencoba untuk mengatasi kasus kebocoran data yang tercantum dalam Undang-Undang Nomor 27 Tahun 2022 terkait Perlindungan Data pribadi (PDP). Meskipun begitu, pengimplementasian dari regulasi ini menghadapi kendala-kendala yang signifikan, misal yang dialami oleh PT PLN dan Indihome yang menggambarkan konsekuensi dari tindakan keamanan data yang tidak memadai. Adapun strategi kerjasama Indonesia baik bilateral, multilateral, maupun regional, yang mana menunjukkan keseriusan Indonesia dalam mengatasi kasus ini. Berdasarkan hasil-hasil yang telah didapatkan, penulis menyadari bahwa kebocoran data memiliki dampak yang sangat berbahaya bagi keamanan nasional, yang mana dapat mengganggu lanskap sosio-ekonomi dan politik negara. Melalui penulisan ini, penulis juga menyarankan bahwa pemerintah perlu meningkatkan pertahanan keamanan siber, seperti autentikasi multi-faktor, serta pendekatan yang lebih kaku dan tegas dalam menegakkan hukum untuk melindungi data pribadi yang diberikan oleh warga negara kepada pemerintah.

Abstract

The shifting global geopolitics have led to a new security dilemma in Europe, especially in trans–Atlantic relations. NATO as the vanguard of the trans–Atlantic defense pact is faced with transitional conditions of non-conventional threats that return to conventional threats. Due to the shift in the new global order, these threats require a repositioning for NATO to counter the new security dilemma amidst shifting global geopolitics. By referring to the three asserted pillars–the return of conventional warfare on the European continent; a more assertive Russia in the European continent under Vladimir Putin; and the geopolitical of China's rise impacted trans–-Atlantic relations, as factors of the new securities dilemma in the context of trans-Atlantic relations, this research aims to analyze the impact of the new security dilemma amidst shifting global geopolitics toward the repositioning of NATO and its consequences on the trans–Atlantic relations using the integration of Mackinder’s Heartland Theory with Jervis’ Security Dilemma.

Abstract

Today, many experts of maritime powers take it for granted that a foreign submarine has the right of submerged passage in an archipelagic sea lane. By using the 1969 Vienna Convention on the Law of Treaties (VCLT) as a tool of interpretation, this paper tries to decipher whether a submerged passage is permissible or not in archipelagic sea lane passage. This paper found that the submerging in an archipelagic sea lane passage is not a generally accepted interpretation of “normal mode” in Article 53 of the 1982 United Nations Convention on the Law of the Sea (UNCLOS). The writers discovered on one hand, the result of the travaux preparatoir means of interpretation appears to be in favor of the submerged passage being included within the meaning of “normal mode”. The textual interpretation, on the other hand, emphasizes the exclusion of submerged passage from both transit passage and archipelagic sea lane passage. In the case of an archipelagic sea lane passage, the exclusion of submerged passage weighs more than the transit passage. Therefore, based on VCLT 1969, which says that the textual interpretation takes precedence over the interpretation of travaux préparatoires, the submerged passage is not a widely accepted interpretation.
