Abstract

Islamic law is substantively derived from the teachings of Islam. As a religious teaching, Islamic law comes from Allah and is extracted directly from the Qur'an and al-Sunnah. This Islamic law is then considered as something sacred and cannot be changed. This thought then makes Islamic law rigid and even static and ultimately not ready to answer various problems, even though Islamic law in the reality of human life requires continuous dynamization and development. The dynamization of Islamic law will be achieved when there is a dialectic between text and reality, thus always finding new innovations in the context of legal discovery, the goal is to achieve benefit. Using an analytical study through library research based on primary and secondary data w­­­­ith a juridical normative approach. This research shows that there are still Muslims who consider the sacredness of classical Islamic law as an absolute truth that cannot be changed, the attitude of some of these circles makes Islam feel foreign to the environment that surrounds it. The situation is exacerbated when they do not fully accept the renewal of Islamic law such as the presence of contemporary maqashid concepts or values.

Abstract

Expressing opinions is a human right that every citizen has. The freedom to express opinions through thoughts orally, in writing, and so on, has been mentioned in the 1945 Constitution and the Universal Declaration of Human Rights. From historical perspective, the birth of freedom of opinion has at least played a very large role in initiating the idea of a democratic system that is currently being implemented by the Indonesia people. However, the existence of the right to freedom of opinion with the aim of being checks and balances in the system of government in Indonesia today often creates tension when its delivery in public, often leads to chaos and the like, which of course is out of the concept of procedures for expressing opinions as mandated by law. Keywords: Human Rights; Freedom; Opinion; UUD 1945. Mengemukakan pendapat merupakan hak asasi manusia yang dimiliki setiap warga negara. Kebebasan meyampaikan pendapat melalui pikiran dengan lisan, tulisan, dan lain sebagainya, telah disebutkan dalam Undang-Undang Dasar 1945 dan Deklarasi Universal Hak-Hak Asasi Manusia. Dalam pengamatan kacamata sejarah, lahirnya kebebasan berpendapat itu setidaknya telah berperan sangat besar mengawali gagasan sistem demokrasi yang kini diterapkan bangsa Indonesia. Namun keberadaan hak kebebasan berpendapat dengan tujuan sebagai checks and balances sistem pemerintahan di Indonesia dewasa ini seringkali menimbulkan ketegangan ketika penyampaiannya dimuka umum, tidak jarang berujung kericuhan dan sejenisnya, yang tentu saja hal tersebut sudah keluar dari konsep tata cara penyampaian pendapat sebagaimana amanat undang-undang.Kata Kunci: Hak Asasi Manusia; Kebebasan; Pendapat; UUD 1945.

Abstract

Maintaining local wisdom values or traditional values of a culture in the midst of modernization of people's lives today is very important, in addition to providing messages and educational values to the next generation it also has meaning as evidence of history or civilization of human life.  This research on cultural values in the tradition of the Lombok community's wedding procession highlights at least three things including; the influence of modernization on the sustainability of culture or tradition, the influence of modernization on the meaning of conveying moral messages and cultural values, and analyzing the shift in cultural values from the perspective of moderate Islam. This research uses a qualitative method. Collecting data by observation, interview, and documentation. The results of this study indicate that the tradition of the Lombok community's wedding procession still exists today, but some of the processions or rituals in it have shifted and lost their traditional values, as well as the meaning of conveying the message of the tradition has been scratched because of the bad influence due to the change of some rituals with their sacred characteristics towards modern

Abstract

Zakat is a basic principle brought by Islamic teachings, which are oriented towards the benefit of the ummah. Regarding the procedures for managing zakat, it is expected that it is an effort to encourage prosperity, economic development, and a strategy to achieve the goals aspired by a nation and a country. So that the poverty and unemployment rates, as well as the gap in the social class of society, will be resolved and the creation of a prosperous, just and prosperous society by the goals of the nation and country. However, in the field, it shows that the current implementation and management of zakat is less effective and still uses classic methods, innovation, and professional work are expected to be far from the desired expectations. So naturally, there are still very poor people in various places and all over the region. This research uses qualitative methods to explain the intent and purpose of writing. And this writing also offers zakat as an economic instrument for regional development, which is based on humanity and strong tolerance between religious communities. Thus there is nothing but effective zakat management and management so that welfare and economic prosperity are expected to be created. As is well known, good zakat management is a requirement and condition for the creation of a clear, accountable, and transparent economy, to avoid corrupt behavior. The management of zakat management uses the principles and rules of sharia law based on tolerance so that the goal is by the principles of the Pancasila Ideology

Abstract

Abstract: This article examines the challenges that arise from implementing customary law in Indonesian society amidst the predominance of state law. The data was collected from primary and secondary legal materials as well as facts on the ground. Applying a juridical-empirical approach, this study identifies various factors that contribute to difficulties in the application of customary law, including the tendency for law enforcers to prioritize state law over customary law, and the textual understanding of law that permeates legal discourse. Furthermore, efforts to unify the law have also created additional problems for customary law. In addition, this article also finds evidence that a number of concepts offered by experts in overcoming this problem are in fact not able to guarantee the application of customary law in the life of Indonesian society. Thus, it is necessary to support these proposals with legal-political changes that can ensure the existence and enforceability of customary law in Indonesian society. Abstrak: Artikel ini mengkaji problematika penerapan hukum adat dalam kehidupan masyarakat Indonesia di tengah dominannya hukum negara. Data-data dikumpulkan dari bahan-bahan hukum primer dan sekunder serta fakta-fakta di lapangan. Menggunakan pendekatan yuridis-empiris, artikel ini menyimpulkan bahwa terdapat sejumlah faktor yang menyebabkan munculnya problematika dalam penerapan hukum adat, yakni adanya para penegak hukum yang sering kali mengesampingkan keberadaan hukum adat dan lebih mengedepankan berlakunya hukum negara; adanya pemahaman hukum yang cenderung terkstual dari para penegak hukum, dan juga adanya upaya univikasi hukum yang ternyata justru telah menimbulkan masalah baru bagi penerapan hukum adat. Selain itu, artikel ini juga menemukan bukti bahwa sejumlah konsep yang ditawarankan oleh para sarjana dalam mengatasi persoalan tersebut dalam faktanya juga belum mampu menjamin bisa diterapkannya hukum adat dalam kehidupan masyarakat Indonesia. Oleh karena itu, tawaran-tawaran tersebut perlu didukung dengan upaya melakukan perubahan hukum melalui politik hukum yang bisa menjamin eksistensi dan keberlakuan hukum adat dalam masyarakat Indonesia.

Abstract

This article examines the relationship between state and religion from the perspective of Islamic-based state policy in Indonesia by focusing on how the state can manage the relationship with religion, as well as its impact on political, legal, and social structures. The data in this research is collected from primary and secondary legal materials. Using a juridical-normative approach and content analysis of various policies as well as conducting a literature review, this article concludes that in the context of state and religion relations, the state is not only considered as a political entity but also as a forum for implementing various Islamic-based values and principles in public policy. This article also sees that the state continues to make a positive legal system that is enforced nationally, in addition to efforts to introduce and apply moral and ethical values in the social and political structure of the state. In addition, this article also finds the fact that the relationship between the state and religion is still harmonious by providing legality to various Islamic-based legal products, one of which can be seen in sharia-based economic arrangements, especially Islamic banking. The relationship between state and religion in the Indonesian context shows that both have a reciprocal relationship that needs each other, state policies in ensuring religious life are very important to foster faith. Conversely, religion is very important for the state to get guidance in terms of morality. Keywords: State, Religion, Sharia Economics, Islamic Law.

Abstract

This article examines the failure of the Arab Spring and the extent to which post-Arab Spring changes in authority have an impact on political and economic stability in the Middle East region such as Tunisia, Libya, Syria, Egypt and Yemen. The data in this research was collected from primary and secondary materials as well as field facts. Using a sociological-political and juridical-empirical approach, this article concludes that there are a number of factors in the failure of the Arab Spring, namely the unpreparedness of the Arab people in implementing a democratic system considering that they have used a monarchical system for centuries, there is domestic and regional polarization between countries in the Arab region. due to the pros and cons of the concept of democratization, and also the existence of foreign intervention. This article also finds evidence that changes in authority after the Arab Spring have actually had an impact on political and economic instability due to strengthening tribalism and competition between political elites in fighting for power after the fall of the previous regime. Apart from that, this research found another fact that the differences in economic conditions between countries in the Middle East region are not completely influenced by the chosen state system, although the democratization transition has also influenced political stability and then had an impact on the country's economic stability.
