Abstract

Abstract:Provisions regarding the resolution of trademark disputes in CHAPTER XV of Law Number 20 Year 2016 concerning Trademarks and Geographical Indications state that the procedure for resolving trademark disputes can be carried out in civil cases through the Commercial Court within the scope of General Courts/District Courts, Crimes through District Courts, Arbitration through Arbitration Institutions, and Other alternative dispute resolution in accordance with the agreement of the parties to the dispute. The existence of provisions regarding civil and criminal settlement in trademark problems sometimes causes polemic, because in the legal world the boundary between criminal law and civil law is very thin. Therefore, it is not uncommon in trademark disputes that should be resolved by civil law instead ends with criminal sanctions. The purpose of this study is to find out the procedure for resolving trademark disputes if resolved in a Civil and criminal manner, as well as the causes of Dissenting Opinion of the Supreme Court judges in examining the Review of the New Gudang brand in decision No. 104 PK/ Pid.Sus / 2015.Keywords: Brand Dispute Resolution, Dissenting Opinion

Abstract

This research is to know how the provisions regarding the legal standing dissolution of political parties in the country of democracy, namely Indonesia and Germany, and know the legal position of the applicant in the case of dissolution of political parties in Indonesia in accordance with the principles of democracy, this is based on studies with the German state. This research uses the type of normative research, in this research method of data collection is done by Library Research technique, by studying the literature, rules of invite-invitations, books, official documents, and writings of scholars related to this thesis. The Data has been compiled and analyzed using a juridical normative method or qualitative method, which is a study that specialized in the study based on the legal theories that are then associated with legislation.The approach used in this research is a statutory approach as well as an analytical approach. The results of this research showed a comparison of legal standing applicants for the dissolution of political parties in Indonesia with Germany, where Indonesia has similarities with the German state that both have a multi-party system as well as the authority to dissolution its political party owned by the Constitutional Court, but in the application of a legal standing applicant dissolution of a different political party, which German , the implementation is already based on the principle of democracy, unlike Indonesia which legal standing applicants only government only, of course this is not based on the principle of democracy state when mirrored to the German state. That there should be other parties who become applicants in the case of the dissolution of political parties in Indonesia, namely the DPR and DPD, it reflects the life of a democratic country and the oversight of the political parties and governments who become parties in the application of the dissolution of the political party, for that it is necessary to study the authority of the applicant in the dissolution of political parties in

Abstract

Alquran contains the order for deliberation, but it does not clearly explain the deliberation system. This article investigates several hadiths concerning al-Shura, the Prophet's deliberation practices, the issues discussed, and who to consult. The normative approach is used in this study, with a focus on the concept of Al-Shura and comparative democracy. The purpose of this article is to compare Islamic discourse and the concept of deliberation with Western-style democracy. Deliberation is one of the values of constitutional political ethics in the life of an Islamic state, according to this article. Similarly, there is a significant distinction between Western-style democracy and delusional democracy.Keywords: Law; Democracy; Al-Shura Abstrak:Perintah musyawarah terdapat dalam Alquran, namun tidak menjelaskan sistem bermusyawarah secara jelas. Artikel ini mengupas  beberapa hadits yang berhubungan dengan al-Syura, praktek-praktek musyawarah Rasulullah Saw, persoalan-persoalan yang dimusyawarahkan serta dengan siapa bermusyawarah. Penelitian ini menggunakan pendekatan normatif dengan fokus pembahasan pada analisa konsep Al-Syura dan demokrasi secara komparatif. Artikel ini bertujuan untuk membandingkan wacana dan konsep musyawarah dalam Islam dan demokrasi ala barat. Artikel ini menemukan bahwa musyawarah merupakan salah satu nilai etika politik yang konstitusional dalam kehidupan negara Islam. Demikian pula terdapat perbedaan yang cukup signifikan antara demokrasi ala Barat dengan musyawarah dalam Islam.Kata kunci: Hukum; Demokrasi; Al-Syura

Abstract

Many people who have not registered ownership rights so that they have no protection andlegal certainty due to several factors: First, factor of land ownership history. Second,community psychology. Third, weakness of land registration rules. Fourth, executorimplementation, intervention BPHTB legislation and other fees. Fifth, the mechanism ofregistration of land is too expensive for the community both procedure and registration fee.The Solution and effort to minimize the occurrence of land disputes society are: first, bypreventing the land dispute case is not repeated. Second, the government immediatelysocialize what and how the issuance of land certificates and the purpose of certificates. Third,If there is dispute in the court that the object is not certified land, the court notifies the urbanvillage and local BPN to block the transaction or the transition of the land immediately. Fourth,each transaction or transition of land with proof of ownership in the form of girik, the witness inthe transaction should be the Village Head and the BPN officer, and fifth, it is better if there island dispute in the court, at least one judge from land law expert, such as non-academicjudges (academics). DOI: 10.15408/jch.v5i2.7089

Abstract

This study aims at examining the law and impact of corrupt politician behavior on public trust in political parties and the efforts of reforms by the parties. Using the survey method, this study has come to the following conclusions. (1) the corruption committed by politicians mostly occurs due to the work pattern and the Indonesian political system which develops towards political apathy, in which regeneration does not optimally take place, while the drive to maintain power and dominate the political parties in the state system is increasing; (2) the corruption does not only influence the public trust in political parties, but also the perspective and paradigm of society towards the political system and government in Indonesia. (3) The impact of this political apathy, which we might be able to see from how the radicalism and extremism easily exist and develop in Indonesia. An encouragement to even create a new system is present from this political apathy. If this is not immediately corrected, a change in the system in Indonesia can probably occur.Keywords: Law; Corruption; Politicians; Political Parties; Community Trust  Hukum dan Dampak Korupsi Politik Terhadap Kepercayaan Masyarakat Pada Partai Politik di Indonesia AbstrakPenelitian ini bertujuan untuk mengkaji hukum dan dampak perilaku politikus korup terhadap kepercayaan publik terhadap partai politik dan upaya reformasi yang dilakukan oleh partai tersebut. Dengan menggunakan metode survei, penelitian ini menghasilkan kesimpulan sebagai berikut. (1) Korupsi yang dilakukan oleh politikus sebagian besar terjadi karena pola kerja dan sistem politik Indonesia yang berkembang ke arah apatisme politik, dimana regenerasi tidak berlangsung secara optimal, sedangkan dorongan untuk mempertahankan kekuasaan dan mendominasi partai politik dalam sistem ketatanegaraan. meningkat; (2) Korupsi tidak hanya mempengaruhi kepercayaan publik terhadap partai politik, tetapi juga cara pandang dan paradigma masyarakat terhadap sistem politik dan pemerintahan di Indonesia. (3) Dampak dari sikap apatis politik ini, yang mungkin dapat kita lihat dari betapa mudahnya radikalisme dan ekstrimisme tumbuh dan berkembang di Indonesia. Dorongan untuk bahkan menciptakan sistem baru hadir dari sikap apatis politik ini. Jika tidak segera diperbaiki, perubahan sistem di Indonesia kemungkinan besar bisa terjadi.Kata Kunci: Hukum; Korupsi; Politisi; Partai Politik; Kepercayaan Masyarakat Закон и влияние политической коррупции на доверие общества политическим партиям в Индонезии АннотацияЭто исследование направлено на изучение закона и влияния коррумпированного поведения политиков на общественное доверие политическим партиям и усилия партий по проведению реформ. Используя метод опроса, это исследование пришло к следующим выводам: (1) коррупция, совершаемая политиками, в основном происходит из-за модели работы и политической системы Индонезии, которая развивается в сторону политической апатии, при которой возрождение не происходит оптимально, в то время как стремление сохранить власть и доминировать над политическими партиями в государственной системе повышается; (2) коррупция влияет не только на доверие общества политическим партиям, но также на взгляды и парадигму общества в отношении политической системы и правительства в Индонезии; (3) влияние этой политической апатии, которое мы могли бы увидеть по тому, как радикализм и экстремизм легко существуют и развиваются в Индонезии. Эта политическая апатия дает стимул даже к созданию новой системы. Если это немедленно не исправить, вероятно, произойдут изменения в системе в Индонезии.Ключевые слова: Закон; коррупция; политики; политические партии; общественное доверие

Abstract

Hukum Perbankan dalam Sistem Operasional Bank Konvensional dan Bank Syariah. Dengan terbentuknya Bank Syariah, merupakan fenomena besar dalam dunia perbankan di Indonesia, sehingga masyarakat memiliki alternatif untuk memiliki jasa Bank Konvensional atau bank syariah. Dengan pertimbangan bahwa bank konvesional menggunakan sistem operasional interest foregone (bunga efektif) dan bank syariah menggunakan sistem operasional bagi hasil berdasarkan prinsip masyarakat al mutanaqisah (kombinasi musyarakah dan ijarah) dalam ketentuan syariat Islam.
