Abstract

The state of law idea formulated in the provisions of Article 1 paragraph (3) of the 1945 Constitution of the Republic of Indonesia is a formulation containing normative statements that is still dubious and seems convincing. The Pancasila philosophical justification as the source of legal norms needs to be questioned. The possibility if Pancasila is used as the source of law will expand coercive actions and choices of legal imperatives. The research method used is analytical techniques with a critical-philosophical approach, which brings factual concepts closer by resting on philosophical issues within the scope of concepts and values for understanding Pancasila which is still interpreted as the source of all sources of law. The research findings found that the construction of the state of law idea should not depend on legal rigidity. It must be able to be created as a discursive space that is truly interpretive and not limitative. The paradox’s problem can be raised through legal interpretations which are able to find a relationship between what should be normative and what is factual.

Abstract

This article explores the crisis narrative surrounding the erosion of democracy in Indonesia, with a particular emphasis on political and ethical responsibilities. It examines the prevailing consensus on the consequences, factors, and conceptualization of democracy, especially concerning political trust and ethical governance. The discussion underscores how democracy evolves by deconstructing and reshaping societal structures, drawing on Kantian philosophy and the core pillars of democratic society. The paper highlights the inherent flaws in democratic principles, demonstrating how these imperfections permit varying degrees of freedom within societal practices. It advocates for the value of cultivating a culture of open, public discourse aboutcollective societal objectives. However, it also points out that the actual practice of lawmaking, implementation, and enforcement often deviates from its doctrinal ideals, particularly when the law’s purported impartiality contrasts with its impact on marginalized communities. These inconsistencies are examined as outcomes of the exercise of political power, illustrating that the law is shaped by political morality and legitimacy rather than being wholly independent. Furthermore, the article delves into the decline of democracy by engaging in dialogue about the process of its deterioration, rather than simply questioning the reasons behind it. This study also explores democracy and philosophy both in theory and practice, framing law as a reflective inquiry into the democratic process. Ultimately, it advocates for the political concepts of democracy to be subjected to scientific analysis and validation.

Abstract

Abstract Gadamer’s philosophical hermeneutics is rooted in the idea that interpretation, understanding, or meaning cannot take place outside of historical and social contexts. This approach challenges the traditional view of law as an autonomous and rational discourse, emphasizing the importance of dialogue and ethical deliberation in legal interpretation. Gadamer’s insights provide a unique perspective on legal hermeneutics, offering necessary protocols for determining, giving meaning, and emphasizing the historical and social embeddedness of legal practice. While some describe legal interpretivism as a hybrid between legal positivism and natural law theory, Gadamer’s hermeneutics offers an alternative approach to legal meaning, focusing on the historical and social contexts that shape interpretive activities. This approach provides a nuanced understanding of legal interpretation, emphasizing the concretization of the law through dialogue and ethical deliberation. Abstrak Hermeneutika filosofis Gadamer didasarkan pada asumsi bahwa penafsiran, pemahaman, atau makna tidak dapat muncul di luar konteks sejarah dan sosial. Pendekatan ini menantang pandangan tradisional tentang hukum sebagai wacana yang otonom dan rasional serta menyoroti pentingnya dialog dan pertimbangan etis dalam penafsiran hukum. Gagasan Gadamer memberikan perspektif unik mengenai hermeneutika hukum dengan menyarankan protocol yang diperlukan untuk menentukan makna dan menyoroti interkoneksi historis dan sosial dari praktik hukum. Meskipun ada yang menggambarkan interpretasi hukum sebagai kombinasi positivisme hukum dan teori hukum kodrat, hermeneutika Gadamer menawarkan pendekatan alternatif terhadap makna hukum dengan berfokus pada konteks sejarah dan sosial yang membentuk aktivitas hukum. Pendekatan ini memungkinkan adanya pemahaman yang berbeda mengenai penafsiran hukum dengan penekanan pada penerapan hukum melalui dialog dan pertimbangan etis.

Abstract

Abstract This article explores constitutional legitimacy through the legal and philosophical lens of Joseph Raz, focusing on the dynamic relationship between political systems, normative reasoning, and public justification. Raz contends that legal authority cannot rely solely on institutional power or formal procedures; it must be supported by reasons that individuals can endorse as morally and rationally acceptable. This insight is especially relevant to constitutional interpretation, where judges must navigate between textual fidelity, evolving democratic norms, and political pressures. Divided into four key discussions, the article first tracesthe foundations of Raz’s legal philosophy and its political context. Then, it examines the political system, public reason, and judicial interpretation in Raz’s framework. The third section focuses on the normativity foundations in Raz’s legal and political philosophy landscape. Finally, the article applies these insights to the Indonesian context, where constitutional judging faces challenges from politicized reason justification. Using a philosophical-legal method, this article argues that a Razian approach can help preserve public trust and legal legitimacy by grounding judges to act not only with legal precision but also with ethical discernment, civic responsibility, and publicly justifiable norms rather than in institutional dominance. Abstrak Artikel ini menyajikan analisis tentang legitimasi konstitusi melalui pendekatan hukum dan filsafat Joseph Raz, dengan menyoroti hubungan antara sistem politik, alasan normatif, dan pembenaran publik. Raz berpendapat bahwa otoritas hukum tidak dapat semata-mata didasarkan pada kekuasaan institusional atau prosedur formal, melainkan harus dibangun atas dasar alasan yang dapat diterima secara moral dan rasional oleh masyarakat. Pandangan ini sangat relevan dalam praktik interpretasi konstitusi, khususnya di negara seperti Indonesia, di mana tekanan politik kerap memengaruhi proses pengambilan keputusan yudisial. Artikelini terbagi dalam empat bagian utama. Bagian pertama membahas dasar-dasar filsafat hukum Raz dan konteks politiknya. Bagian kedua mengkaji konsep sistem politik, nalar publik, and interpretasi yudisial dalam kerangka pemikiran filosofis Raz. Bagian ketiga mengulas fondasi normativitas dalam acuan pemikiran filsafathukum dan politik Raz. Bagian keempat menerapkan pemikiran Raz untuk menelaah situasi Indonesia, di mana penegakan konstitusi menghadapi ragam tantangan yaitu justifikasi alasan yang dipolitisasi. Dengan menggunakan metode penelitian filsafat dalam kerangka philosophical-legal, artikel ini menunjukkanbahwa pendekatan Raz dapat membantu menjaga kepercayaan publik dan legitimasi hukum dengan membumikan hakim harus bertindak tidak hanya berdasarkan presisi hukum tetapi dengan kearifan etis, tanggung jawab sipil, dan norma-norma yang dapat dibenarkan secara publik daripada dalam dominasi kelembagaan.

Abstract

This article examines the intrinsic relationship between law and values through the lens of legal epistemology, focusing on Joseph Raz’s legal philosophy. It investigates how judicial interpretation, shaped by epistemological foundations, influences legal reasoning and outcomes. Central to the discussion are normative challenges in adjudication such as ambiguity, uncertainty, and moral conflict. It also discusses how Raz’s thought of legal authority and the chain of validity among norms provide a framework for evaluating the legitimacy and justification of legal decisions. Raz argues that legal authority must offer independently justified reasons for action, reinforcing the law’s role in maintaining social order. The article further examines how legal structures shape and sustain societal values, positioning legal epistemology not only as a tool for understanding the basis of authority but also as a normative foundation for aligning legal principles with societal values. In conclusion, the research affirms that a robust epistemological approach to law, as proposed by Raz, is crucial for ensuring legitimacy and fairness in legal systems, making legal epistemology indispensable in affirming the normative force of law in contemporary society.

Abstract

The process of forming laws and regulations often ignores the rights of citizens, especially the citizen participation rights, the supervision of the House of Representatives and the involvement of citizens. Many problems still unable to accommodate the aspirations of the community, minimize the civil space and only limited to the elite, resulting in discrepancies and ambiguity of implementing the regulations are not simultaneous. Through this paper, using the juridical-normative method with a conceptual approach wants to review the kinds of the reconstruction of the House of Representatives supervision through the bargaining position process as a political aspiration line and citizen participation rights as a tool of legal communication during the formation of laws and regulations in constitutional democracy framework. The reconstruction form of the House of Representatives supervision through the bargaining position process can be divided into two are preventive supervision carried out when the legal product still processing in the draft legislation and repressive supervision carried out when legal product has been formed.
