Abstract

Crime is a very anti-social act that consciously gets a reaction from the state in the form of giving suffering (punishment or action). Crime as a behavior is an act of deviance, is against the law or violates statutory regulations and is detrimental to the community in terms of decency, decency and order of community members. Crime can be defined juridically and sociologically. Crime is part of people's lives and is an everyday event. A philosopher named Cicero said Ubi Societas, Ibi Ius, Ibi Crime which means there is a society, there is law and there is crime. The benefit of studying criminology is that criminology contributes to the formulation of new legislation (the Criminalization Process), explaining the causes of crime (Criminal Ethylogy) which in turn creates efforts to prevent crime. Another issue regulated in the child protection law is how to punish adults who commit crimes against children and also the responsibility of parents, society and the state in protecting children. This research was conducted in North Maluku, precisely in the city of Ternate. This research will use a descriptive type of analysis with a qualitative approach. Abstract

Divorce happens due to continuous disputes and fights due to economic reasons. This research aims to analyze the factors causing the increasing rate of divorce as well as its main causes amid the pandemic in Ternate City. This paper employed the normative juridical method which is a literary study that studies documents. Results showed that divorce is the last resort. Economic status is the factor that wives often use to file for a divorce, as husbands are no longer able to provide for the wife, causing family conflicts that lead to divorce. The second factor is the rampant cases of work termination. This has become one of the main causes of divorce amid the Covid-19 pandemic.

Abstract

Undang-Undang No.1 Tahun 1974 tentang perkawinan yang mengatur batas minimal seseorang dapat melangsungkan perkawinan adalah laki-laki berusia minimal 19 tahun dan perempuan 16 tahun, sedangkan Pasal 1 angka (1) Undang-Undang Perlindungan Anak menyebutkan bahwa anak adalah seseorang yang belum berusia 18 tahun, termasuk anak yang masih dalam kandungan . Badan Koordinasi Keluarga Berencana (BKKBN) menyarankan usia menikah bagi perempuan adalah 21 tahun. Masalah usia perkawinan yang akan dilangsungkan senantiasa menjadi perhatian bagi Pegawai Pencatat Nikah yang akan membantu melangsungkan perkawinan. Sehingga jika ditemukan hal-hal yang bertentangan dengan syarat formil maka Pegawai Pencatat Nikah dapat menolak untuk dilangsungkannya perkawinan tersebut. Hal ini merupakan salah satu bentuk pencegahan perkawinan pada anak usia dini. Menikah di usia kurang dari 18 tahun merupakan realita yang harus dihadapi sebagian anak di seluruh dunia, terutama negara berkembang, perkawinan anak usia dini bukan mengatasipersoalan ekonomi dalam keluarga atau masalah sosial, namun sebaliknya perkawinan anak usia dini merupakan hal yang menjerumuskan anak ke dalam persoalan yang lebih kompleks terkait dengan keberlansungan hidup dan dampak bagi generasi muda selanjutnya. Indonesia sampai saat ini masih dihadapkan dengan persoalan perkawinan anak, yang hingga saat ini masih banyak anak yang berusia dibawah 18 tahun melangsungkan perkawinan dengan berbagai alasan, salah satunya adalah persoalan ekonomi keluarga. Penyuluhan Hukum yang akan kami laksanakan dengan tim Pengabdian di SMA Negeri 2 Ternate.

Abstract

Article 38 of Law Number 1 of 1974 concerning Marriage and Article 113 of the Compilation of Islamic Law states that divorce is one form of dissolution of marriage other than death and court decisions. Divorce is the severance of the marital bond between a man and a woman as husband and wife, which is carried out before a court hearing, namely the District Court for non-Muslims and the Religious Court for Muslims. This paper aims to analyze: (1) The legal protection for child support obligations after divorce in Ternate City and (2) The efforts that the government can make to reduce the obligation of unpaid alimony after divorce in Ternate City. This research is normative legal research, where the concept of normative legal research. The approaches used in this research are the statute approach and the conceptual approach. The statute approach examines laws and regulations related to the legal issue at hand. This conceptual approach is also used when relevant laws and regulations do not yet or do not address the issue at hand. Children's rights after divorce, both under the Marriage Law and the Compilation of Islamic Law (KHI), include the right to continue receiving care, education, and support from both parents. The father is responsible for the cost of childcare and education after divorce, a term known as "maintenance" in the KHI. This represents a parent's responsibility to fulfill their obligations to uphold children's rights, as stipulated in Law Number 23 of 2002 concerning Child Protection.
