Abstract

There are many things that should be asked by husband and wife when deciding to divorce. In addition the property of gono-gini, another thing that must be considered is the division of child custody in a divorce. by both parents may not injure the fulfillment of children's rights which are also regulated by the state through the child custody law through Law Number 23 of 2002 concerning Child Protection. In General Provisions Article 1 point 11 it is explained that foster care is the power of parents to nurture, educate, nurture, nurture, protect, and develop children according to their religion and abilities, talents and interests. According to Article 41 of Law Number 1 of 1974 concerning Marriage, a married husband and wife are still obliged to maintain and educate their children for the benefit of the child himself. Divorce also does not cancel the father's obligation to be responsible for all the care and education that the child needs. However, the court may decide that the mother also demands it under certain conditions. The court also has the right to determine which custody of the child should be given to the mother or father, especially if there is a right to household rights.

Abstract

Fiqh as Islamic law that regulates the pattern of human relations with God and with each other, takes part in discussing the relationship between humans and their environment. This research examines environmental fiqh issues. With the aim of formulating environmental jurisprudence that is comprehensive, systematic and accountable and able to deal with the problem of global warming. Where in the data analysis with descriptive qualitative research. And the data collection technique is a library or library research. In this study it was concluded that fiqh contributes to the problem of efforts to maintain environmental harmony by providing rules or codes of ethics for human relations with their environment. Such as the prohibition of destroying the environment and the obligation to preserve the environment. This arrangement of environmental law is based on tafsiliy arguments, namely the Qur'an-al-Hadith, and the general principles of legal legislation. When jurisprudence takes part in environmental preservation, it is hoped that there will be a new awareness for all Muslim leaders, especially awareness related to environmental issues. They have high concern for the environment

Abstract

Kebutuhan masyarakat sangat komplit dan berubah-ubah tidak mungkin membuat kodifikasi hukum secara sempurna, salah satu penyebanya adalah berbeda-bedanya adat istiadat setempat yang tidak sama dengan adat pada jaman dulu (adat orang Arab). Perubahan di sini tidak hanya menyangkut terhadap nilai-nilai saja akan tetapi dapat mempengaruhi perubahan terhadap hukum agama (Islam)Untuk itu, sudah seharusnya dengan adanya polemik semacam ini perlu kiranya ada penanganan khusus terhadap persoalan yang berkaitan dengan masalah yang berkembang di masyarakat dari segi kajian hukum Islam. Tujuannya, agar permasalahan ini dapat dipecahkan dengan putusan yang terbaik dan bisa memberikan solusi yang dapat diajalankan oleh masyarakat.
