Abstract

Abstract Job recruitment is a process carried out by employers to find prospective workers who are in accordance with the positions and positions required by the company. Job recruitment is usually announced by the employer with several conditions as criteria for job candidates that the company needs. Requirements for unmarried status set in job recruitment can have an impact on the loss of job opportunities for prospective workers who are already married. Based on this, it is necessary to carry out an analysis with normative legal research methods regarding legal considerations to determine the requirements for unmarried status for job applicants in job recruitment and whether or not norm construction is required related to norm vacancies.regarding the stipulation of conditions in job recruitment, especially regarding the unmarried status of prospective workers. In the discussion, the legal consideration for stipulating the requirements for unmarried status in job recruitment is the absence of norms related to this matter so that it is permissible to determine the requirements for marital status in job recruitment which has become the habit as a legal basis for determining certain conditions in job recruitment. The impact of this is the loss of job opportunities by prospective workers who are already married, so it is necessary to provide legal protection, especially with the construction of norms in the hope that everyone can get fair and decent work opportunities.

Abstract

The bipartite negotiation is the first attempt taken to resolve industrial relations problems that occur. Therefore it is interesting to conduct an in-depth analysis of the importance of conducting bipartite negotiations in the resolution of industrial relations disputes and the existence of collective agreements as a legal basis for implementing bipartite negotiation agreements. Bipartite negotiations as an initial effort to settle industrial relations disputes require good faith in the negotiation process, the formation of collective agreements, and the implementation of collective agreements. Carefulness and caution are also needed in the formulation of collective agreements so that agreement clauses not cause in losses or problems in implementation.

Abstract

Salah satu asas dalam Undang-Undang Perkawinan adalah asas mempersukar terjadinya perceraian. Keberadaan asas mempersulit terjadinya perceraian adalah adanya kewajiban alasan untuk melakukan perceraian hingga proses perceraian wajib melalui pengadilan. Dalam pembahasannya, terdapat beberapa alasan hukum untuk melakukan perceraian sebagaimana diatur dalam Undang-Undang Republik Indonesia Nomor 1 Tahun 1974 dan Peraturan Pemerintah Republik Indonesia Nomor 9 Tahun 1975. Wajib adanya alasan untuk melakukan perceraian diharapkan agar tidak mudah melakukan perceraian. Proses melakukan perceraian diwajibkan melalui prosedur penyelesaian melalui Pengadilan Negeri setempat yang tentunya mewajibkan adanya proses penyelesaian alternatif sebagaimana diatur dalam Peraturan Mahkamah Agung Republik Indonesia Nomor 1 Tahun 2016. Proses melakukan perceraian dengan tahapan yang panjang mulai dari wajib melakukan penyelesaian secara mediasi hingga proses penyelesaian di Pengadilan memiliki harapan supaya para pihak berpikir kembali dan tidak jadi melakukan perceraian.
