Abstract

Pesanggrahan Village is a village located on the banks of the Bengawan Solo River, Laren District, Lamongan Regency. In Pesanggrahan Village, there are youth groups, but they have not carried out entrepreneurial activities. Even though one of the goals of the youth organization is to develop an entrepreneurial spirit. This is because members of the youth organization are passive, the management and members are less skilled in starting a business, and lack of funds. Therefore, community service is carried out in the form of providing entrepreneurship knowledge through counseling, discussions to choose the type of business, and starting a simple business. The counseling contains material on entrepreneurial motivation, the benefits of entrepreneurship, home-based entrepreneurship, preparation for opening a business, determining profit, and healthy business space. The business that is being developed by the youth organization is a coffee shop business. The realization of a coffee shop business is carried out by preparing a business place and procuring coffee shop facilities. The result of mentoring youth organizations in pioneering coffee shops is to increase the motivation of young people to become entrepreneurs, open jobs, increase cash for youth organizations, and add supporting facilities in the village sports room.

Abstract

The legislation process is not only influenced by the juridical factor. Non-juridical factors also influence the legislative process. Even non-juridical factors influence sometimes is greater than juridical factors. Whereas any legislation must meet the criteria of good legislation based on legisprudence theory. The quality of legislation in DPRD Kota Surabayais also influenced by other factors beyond the text of the legislation. Therefore, it is the legislative process in DPRD Kota Surabaya interesting to analyze because of course non-juridical factors remain influential in the legislative process. These factors, however, can be accommodated in such a way to suit the demands of judicial aspect. The analysis in this study isconducted by a socio- legal approach. Based on the research by socio-legal approach, the legislation process in DPRD Kota Surabaya (2009-2014) is influenced by non-juridical factors. Non-juridical factors are influenced by the interests of the struggle for influence in the community base. On the side of the legislator, there is an interest to build a base of constituents on an on going basis. On the executive side, there is the need to build a public trust in the government. The interests of each other in the dynamics of the discussion of draft legislations relating to the budget.

Abstract

Mencuatnya kasus yang mengharuskan tenaga kerja melakukan staycation dengan atasan sebagai syarat perpanjangan kontrak kerja membuat heboh dunia kerja. Masalah perjanjian kerja tidak akan pernah selesai karena banyak faktor yang mempengaruhi, salah satunya adalah ekonomi. Tujuan dari penelitian ini adalah mengetahui efek dari penerapan klausul baku yang bersifat subjektif sehingga menguntungkan perusahaan dan menimbulkan penyimpangan serta mengetahui upaya perlindungan yang bisa di ambil untuk mencegah terjadinya tindak kejahatan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan yang digunakan adalah hukum yang datanya diperoleh melalui perkara, peraturan, jurnal, dan artikel. Perjanjian kerja disalahgunakan oleh perusahaan yang tidak bermoral untuk mencari keuntungan dan memanfaatkannya. Kondisi ini membuat pekerja merasa dirugikan, ditambah dengan adanya klausula subjektif. Pembuatan klausul yang disengaja untuk menguntungkan perusahaan membuat tenaga kerja dirugikan dan dilemahkan, sehingga menciptakan banyak eksploitasi dan kejahatan bagi pekerja. Pemerintah diharapkan bertindak cepat dengan mengeluarkan kebijakan standardisasi perjanjian kerja sehingga memberikan perlindungan hukum kepada pekerja dan kepastian hukum.
