Abstract

This article discusses legal protection against child exploitation in the digital era which includes the legal basis, the role of the authorities, the challenges faced, as well as prevention and law enforcement efforts that can be taken. Child protection laws and laws regarding gambling crimes, human trafficking crimes, and human organ trafficking crimes provide the legal basis for child protection in the digital era. This research is normative legal research, using a statutory approach. This normative legal research is based on primary and secondary legal materials, namely research that refers to the norms contained in statutory regulations. library data collection method, or research in which the research object is explored through a variety of library information, including books, encyclopedias, scientific journals, and documents.in conclusion, protecting children from exploitation in the digital era is a formidable challenge that requires a multifaceted and evolving approach. It is only through the lens of justice—balancing prevention, protection, and prosecution—that we can hope to safeguard the innocence and rights of children in this increasingly digital world.

Abstract

Penelitian ini mengkaji tantangan hukum yang terkait dengan regulasi kampanye di media sosial dalam konteks pemilu 2024. Dengan semakin masifnya penggunaan media sosial dalam politik, terdapat permasalahan hukum yang timbul terkait dengan kampanye politik di platform tersebut. Penelitian ini mempertimbangkan tantangan-tantangan seperti penyebaran informasi palsu (hoaks), upaya menjatuhkan lawan politik melalui konten yang merugikan, dan ketidakjelasan regulasi terkait kampanye di media sosial. Metode penelitian yang digunakan adalah analisis normatif fokus terhadap perundang-undangan yang ada serta pendekatan deskriptif untuk memahami perkembangan dan dampak praktik kampanye di media sosial. Hasil penelitian ini diharapkan dapat memberikan wawasan mengenai permasalahan hukum yang muncul dalam kampanye politik di media sosial, serta memberikan dasar untuk penyusunan regulasi yang lebih efektif dalam mengatasi tantangan tersebut pada pemilu 2024.Undang-undang yang dapat digunakan dalam menghadapi tantangan hukum terkait regulasi kampanye di media sosial dalam Pemilu 2024 antara lain, Undang-Undang Nomor 7 Tahun 2017 tentang Pemilu dan Undang-Undang Nomoe 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE). Ketentuan-ketentuan dalam undang-undang tersebut menjadi dasar hukum untuk mengatur pelaksanaan kampanye di media sosial dan menanggapi tantangan hukum yang mungkin timbul dalam konteks Pemilu 2024.

Abstract

Penelitian ini mengkaji implikasi Putusan Mahkamah Konstitusi (MK) Nomor 62/PUU-XXII/2024 yang menghapuskan Presidential Threshold (PT) 20% terhadap demokrasi dan supremasi hukum di Indonesia. Analisis diawali dengan menelusuri akar filosofis negara hukum dari zaman Yunani kuno, yang menekankan supremasi hukum sebagai fondasi masyarakat adil. Di Indonesia, cita-cita negara hukum tersebut termaktub dalam Pasal 1 Ayat (3) UUD NRI 1945, yang mewajibkan segala kebijakan negara berlandaskan konstitusi. Namun, ketentuan PT 20% dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum, meskipun awalnya dirancang untuk stabilitas, telah memicu perdebatan sengit karena dianggap menghambat demokrasi, membatasi pilihan publik, dan menciptakan oligarki partai. Keputusan MK pada 2 Januari 2025 yang menyatakan PT tidak memiliki kekuatan hukum mengikat menandai babak baru, berpotensi membuka ruang kompetisi yang lebih luas dan mengembalikan semangat kedaulatan rakyat serta supremasi hukum yang sesungguhnya. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan deskriptif analitis, berfokus pada studi pustaka dan analisis bahan hukum sekunder. Penelitian ini secara khusus menganalisis Pasal 222 Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum dan putusan Mahkamah Konstitusi Nomor 62/PUU-XXII/2024 yang menghapuskan Presidential Threshold. Sumber data primer meliputi Undang-Undang Dasar Negara Republik Indonesia 1945, UU No. 7 Tahun 2017, dan Putusan MK No. 62/PUU-XXII/2024. Data tersebut didukung oleh bahan hukum sekunder seperti rancangan undang-undang, karya ilmiah hukum, dan buku relevan, serta bahan tersier seperti kamus dan ensiklopedia, yang dikumpulkan melalui studi kepustakaan. Seluruh data dianalisis secara kualitatif untuk menghasilkan kesimpulan yang bersifat deskriptif.Hasil penelitian menyimpulkan bahwa Putusan MK Nomor 62/PUU-XXII/2024 selaras dengan prinsip supremasi hukum dan tujuan demokrasi, memperkuat keadilan prosedural, dan meningkatkan kedaulatan rakyat dengan membuka ruang kompetisi yang lebih inklusif. Putusan ini juga menegaskan peran MK sebagai penjaga konstitusi yang berani mengambil keputusan counter-majoritarian. Namun, implementasinya menghadapi tantangan signifikan, termasuk potensi ketidakpastian hukum dan fragmentasi politik jika revisi UU Pemilu tidak segera dilakukan atau tidak komprehensif. Perubahan drastis dalam dinamika politik memerlukan adaptasi dari semua partai, dan potensi ledakan jumlah calon bisa menyulitkan pemilih. Keberhasilan putusan ini dalam mewujudkan demokrasi yang lebih adil dan transparan sangat bergantung pada kemampuan DPR dan Pemerintah dalam menciptakan kerangka hukum yang stabil, adil, dan transparan, serta komitmen semua pihak untuk menghormati dan beradaptasi dengan prinsip supremasi hukum.Kata Kunci: Presidential Threshold, Supremasi Hukum, Demokrasi.

Abstract

Abstract. A case study in Military Region IV/Diponegoro shows the importance of Military Police professionalism in resolving legal violations firmly, fairly, and transparently. The aim of this research is to examine and analyze the role and responsibility of the military police in dealing with fraud crimes by members (Case Study in Military Region IV/Diponegoro and Military Police Detachment IV/5) and to identify obstacles in carrying out the role and responsibility of the military police in addressing fraud crimes by members (Case Study in Military Region IV/Diponegoro and Military Police Detachment IV/5) and how to overcome them. This study uses a sociological juridical method with descriptive-analytical specifications. Primary data were obtained directly through interviews and analyzed using legal theory. The results of this study concern the role and responsibility of the military police in handling fraud committed by members (Case Study in Military Region IV/Diponegoro and Military Police Detachment IV/5). The Military Police have a strategic role in handling fraud committed by TNI members, as regulated in Law Number 3 of 2025 concerning the Amendment to Law Number 34 of 2004 on the Indonesian National Armed Forces and Law Number 31 of 1997. In the case of Sertu NSW which occurred in the Kodam IV/Diponegoro area, Military Police Detachment IV/5 concerned an investigation based on Article 378 of the Criminal Code. The investigation process followed Article 75, including the summoning of witnesses, seizure of evidence, and detention. In handling fraud committed by TNI members, the Military Police face several obstacles, such as difficulty obtaining testimony from witnesses due to fear, and pressure from families to settle the case amicably. In the case of Sertu NSW, witnesses were reluctant to come to the Denpom, even though the loss amounted to IDR 114,700,000. Solutions to these problems include providing legal protection to witnesses according to the principle of witness and victim protection, educating all parties about criminal sanctions, and guaranteeing the confidentiality of witness identities so they are willing to provide honest testimony.

Abstract

Abstract. The type of research in this thesis is empirical research. Empirical law research is also called sociological law research, which is a legal research that studies law conceptualized as actual behavior, as an unwritten social phenomenon, experienced by everyone in social life. Based on the research results, it can be seen thatThe regulation of the death penalty for narcotics traffickers in Indonesia is currently regulated in Article 114 and Article 119 of the Republic of Indonesia Law Number 35 of 2009 concerning Narcotics, however, the existence of PK and pardons are often the reasons for postponing or even canceling the execution of the death penalty for narcotics dealers. The obstacles that result in the failure to realize the deterrent effect through the death penalty in eradicating narcotics crimes today are the formal legal weaknesses, namely the existence of PK and gerasi which can cancel and postpone the execution of the death penalty for narcotics dealers. The material legal weaknesses are in the form ofLaw Number 11 of 2008 in conjunction with Law Number 19 of 2016 concerning Electronic Information and Transactions andRepublic of Indonesia Law Number 35 of 2009 Concerning Narcoticsdoes not specifically contain regulations related to the distribution of narcotics electronically or through social media and the internet. This can be a source of increasing digital-based narcotics circulation that is difficult to prosecute. These various circumstances will clearly result in the absence of a deterrent effect for perpetrators of narcotics distribution.Empirical constraints in the form of economic needs that can be due to dealers being drug addicts so they need narcotics through efforts to become dealers, or purely dealers are only looking for profit for their economic needs, have resulted in dealers having no choice not to commit the crime of drug trafficking. The solution that can be done is to regulate the exception of granting pardons to drug dealers in the Republic of Indonesia Law Number 5 of 2010 concerning Amendments to Law Number 22 of 2002 concerning Pardons considering that drug trafficking is a serious problem that can damage the future of the nation and state. Specifically regulate the digital distribution of narcotics, so that drug dealers in the digital world can be subject to the death penalty as the maximum penalty with aggravation. The government needs to supervise the community, especially teenagers seriously, especially for people with weak economies regarding the existence of drug trafficking.
