Abstract

This article explains about Jahangir and Abdullatif’s view on same-sex marriage. T They argued that the Qur’an itself keeps silent on the status of same-sex union. The prohibition of same-sex union commonly adopted by Muslims is a product of the limitation of ijma (Muslim consensus) and Qiyas (deductive reasoning) as the main method of the formulation of Islamic law, and the bias of Muslim orthodoxy. Therefore, they proposed an idea that same-sex unions in Islam can be carried out by considering the broad principle of dignity and based on human affection.Artikel ini membahas tentang pendapat Jahangir dan Abdullatif tentang pernikahan sesama jenis. Kedua pemikir ini berpendapat bahwa al-Qur’an sejatinya tidak memberikan pendapat tentang status pernikahan sesama jenis. Menurut keduanya, larangan menikah sesama jenis yang menjadi pendapat umum umat Islam merupakan hasil dari keterbatasan ijma’ dan qiyas, sebagai metode utama dalam formulasi hukum Islam, ditambah dengan adanya bias ortodoksi. Oleh karena itu, keduanya mengusulkan pemikiran tentang perlunya mempertimbangkan prinsip umum tentang martabat manusia dan kasih sayang. Dengan cara seperti itu, pernikahan sesama jenis dapat diakomodir.

Abstract

This paper tries to understand how Angkola Batak women negotiate a patriarchal cultural system, by trying to find a middle way that still goes hand in hand with Batak customs and Islam, and on the other hand, slowly brings them out of the shadow of patriarchy itself. Through the results of interviews and field observations, this paper argues that the relationship between women and the patriarchal cultural system is dynamic in different structures and times. Women constantly use different ways to deal with the difficulties they face in different situations. This paper concludes that only by describing the dynamic negotiation context and the process can we avoid the assumption that Batak women are passive, oppressed, and powerless subjects. This paper describes the negotiations carried out by Angkola Batak women to achieve changes in gender relations with a more accommodating attitude towards inequality itself. Thus, the defense that emerges from women's actions is a framework that can change the patriarchal cultural order, no matter how slowly the change occurs. [Makalah ini mencoba memahami bagaimana perempuan Batak Angkola menegosiasikan sistem budaya patriarki, dengan upaya menemukan jalan tengah yang tetap beriringan dengan adat Batak dan agama Islam, dan di sisi lain secara perlahan mengeluarkan mereka dari bayang-bayang patriarki itu sendiri. Melalui hasil wawancara dan observasi lapangan, makalah ini berpendapat bahwa hubungan perempuan dengan sistem budaya patriarki berdinamika dalam struktur dan waktu yang berbeda. Perempuan secara terus-menerus menggunakan cara yang berbeda untuk mengatasi kesulitan yang mereka hadapi dalam situasi tertentu.Temuan dalam makalah ini adalah bahwa hanya dengan  menggambarkan konteks dan proses negosiasi yang dinamis tersebut maka dapat menghindari asumsi yang menyatakan bahwa perempuan Batak adalah subjek pasif, tertindas, dan tidak berdaya. Makalah ini menggambarkan perundingan yang perempuan Batak Angkola lakukan untuk mencapai perubahan relasi gender dengan sikap lebih akomodatif terhadap ketidaksetaraan itu sendiri. Maka bentuk pertahanan yang terlihat dari tindakan perempuan merupakan kerangka yang dapat merubah tatanan budaya patriarki tanpa peduli seberapa lambat perubahan itu akan terjadi.]

Abstract

This article explores the interplay between customary and Islamic law in the Batak Angkola community, with a focus on child adoption and inheritance distribution. Using Alan Watson’s legal transplantation theory, this study examines how accessibility, habit, and mode (the latest trend) influence the adaptation of these legal practices. Findings reveal that the traditional adoption ceremony, which recognizes adopted children as biological heirs and involves significant costs and time, is becoming obsolete and is gradually abandoned. Consequently, adopted children are no longer regarded as biological heirs, leading to the logical application of compulsory bequest (wasiat wajibah) as a mechanism to grant inheritance rights limited to one-third of the estate. The frequent application of this practice suggests its potential evolution into a living customary law. The adaptation of wasiat wajibah reflects the alignment of customary law with Islamic legal principles, which emphasize justice and procedural ease. This shift underscores society’s preference for efficiency and practicality while preserving adherence to tradition. Thus, the continuous interaction between customary and Islamic legal frameworks fosters legal pluralism, enhances responsiveness to social changes, upholds maṣlaḥah (public welfare), and facilitates the evolution of legal traditions in response to contemporary societal needs.

Abstract

Modernity brings about gender equality, but in Padang Lawas, this gender equality is not universally accepted by Batak Angkola men. Resistance under the guise of masculine identity exists based on cultural reasons. This study aims to explore the reasoning behind Batak Angkola men's defense of their masculine identity in the public and domestic spheres amid the prevailing gender equality of the modern world. This study relies on a socio-anthropological approach. Data were obtained through observation and interviews. This study concludes that Batak Angkola men maintain their self-esteem (ego) and uphold their identity as part of the Batak patriarchy by using preventive cultural masculinity reasoning. This use of reasoning keeps them from being deprived of religious and cultural understanding. In essence, the modernity echoing gender equality auto-encourages Batak men to empower and safeguard their masculinity in their own ways and according to their own standards. This affirms that latently, Batak Angkola men's resistance to modernity is rooted in their traditional paradigm. Consequently, this is by no means enough to alleviate Batak women’s longstanding unfavorable circumstances, a double-burdened trap.[Modernitas melahirkan kesetaraan gender, namun di Padang Lawas kesetaraan gender ini tidak diterima secara universal oleh laki-laki Batak Angkola. Perlawanan dengan kedok identitas maskulin ada berdasarkan alasan budaya. Penelitian ini bertujuan untuk mengeksplorasi alasan di balik pembelaan identitas maskulin laki-laki Batak Angkola di ruang publik dan domestik di tengah kesetaraan gender yang berlaku di dunia modern. Kajian ini bersandar pada pendekatan sosio-antropologis. Data diperoleh melalui observasi dan wawancara. Penelitian ini menyimpulkan bahwa laki-laki Batak Angkola mempertahankan harga diri (ego) dan menjunjung tinggi identitasnya sebagai bagian dari patriarki Batak dengan menggunakan penalaran maskulinitas budaya preventif. Penggunaan penalaran ini membuat mereka tidak kehilangan pemahaman agama dan budaya. Intinya, modernitas yang menggemakan kesetaraan gender secara otomatis mendorong laki-laki Batak untuk memberdayakan dan menjaga kejantanannya dengan cara mereka sendiri dan menurut standar mereka sendiri. Hal ini menegaskan bahwa secara laten, resistensi laki-laki Batak Angkola terhadap modernitas berakar dari paradigma tradisional mereka. Konsekuensinya, ini sama sekali tidak cukup untuk meringankan keadaan tidak menguntungkan perempuan Batak yang sudah berlangsung lama, sebuah perangkap berbeban ganda.]
