Abstract

Democracy and authoritarianism represent two contrasting systems of governance. Since the Reform Era and the fall of President Soeharto’s New Order regime, public discourse in Indonesia has consistently focused on strengthening democratic values and preventing the resurgence of authoritarian practices. Despite the progress made, Indonesia is still regarded as a democracy in development, with several persistent issues undermining its democratic framework. These challenges include widespread corruption, the repression and criminalization of political opposition, limited judicial independence, socioeconomic disparities, and the exploitation of identity politics, issues that have continued into President Joko Widodo’s second term. In light of these concerns, this educational outreach program has been designed. It targets eleventh-grade students, who represent a group of first-time voters in the upcoming election. The goal is to provide these students with the critical skills needed to assess the policy platforms of electoral candidates. The program will be delivered through a combination of lectures, interactive discussions, and post-session assessments. The intended outcome is to enhance students’ awareness of the significance of democratic values, encourage resistance to authoritarian tendencies, and promote informed, principle-based voting behavior.

Abstract

Chinese-Indonesians who live in Yogyakarta can no longer possess land ownership legally since the Instructions of the Head of the Special Region of Yogyakarta Number K.898 Year 1975 came into effect. Surprisingly, the discrimination finds its root even before the creation of the nation state of Indonesia. Dutch colonial government is the first authority to initiate such discriminative policy to attenuate Chinese, Arabs, and Indians economic influence in the region and monopolize economic assets above the land. This ethnocentric legal norm permeates and continues its influence in Yogyakarta until now. This paper demonstrates that the instruction as the legal basis in prohibiting Chinese-Indonesians to enjoy land ownership is discriminative. Thus, it is against the legal norms that are applicable in Indonesia. Indonesian legal system treats its citizen equally and does not endorse an ethno-nationalist view that discriminate particular ethnicities. In addition, this paper demonstrates that the instruction cannot be classified as a law, according to legal procedure in Indonesia, therefore renders it unlawful. Lastly, this paper also demonstrates that the instruction is ineffective to serve its purpose because there are many legal loopholes and practices that can avoid its provision.

Abstract

The Kejawen community, recognized as a belief system rather than a formal religion, faces systemic discrimination in Indonesia. This distinction underpins the country's recognition of its political and legal status, thereby impeding the rights of Indigenous practitioners, including Kejawen followers. Several factors contribute to this systemic discrimination: the Western conception of religion, the dichotomy between religion and belief enshrined in Article 29 of the 1945 Indonesian Constitution, the narrow definition of religion by the Indonesian Department of Religion, the association of indigenous beliefs with communism post-1965, and the application of blasphemy laws aimed at "purifying" religion while sidelining belief systems. This study aims to explore the discriminative dynamics against Kejawen within the binary framework of religion versus belief through qualitative research and critical discourse analysis. It seeks to uncover the ambiguity surrounding the concept of religion in Indonesia, drawing on a wide range of sources, including historical narratives, academic studies, relevant legislation, and judicial rulings. This research indicates a significant bias rooted in the differentiation between "religion" and "belief," primarily originating from Western perspectives on religion. This bias has led to the marginalization of Kejawen and other similar spiritual practices, which are often viewed as lesser compared to world religions.
