Abstract

Abstract The purpose of this research is to knowing of regulation and implementation of president Prerogatif before and after the amendment to the 1945 constitution as well as the implementation of the Prerogatif of the president in the judiciary in administering judicial power in Indonesia. Amendments to the 1945 constitution including the first amendment on October 19, 1999, the second amendment on August 18, 2000, the third amendment on November 9, 2001, and the fourth amendmenton August 10, 2002. President’s Prerogatif is a right that is owned by a head of state or head of government without any intervention from any party in exercising that right. The judicial field is a part of the judiciary, namely the state institution in charge of overseeing the passage of laws and regulations. The problem is how regulation and implementation of president prerogatif before and after the amendment to the 1945 constitution and how the implementation of the president’s prerogatif in the judiciary in exercising judicial power in Indonesia. The method used in writing this scientific paper is a normatif juridical method that is reviewing the laws and regulations and library books as well as accessing the legal journals relating to the problem. The result and discussion obtained show that there are differences in the implementation of the president’s prerogatif before and after the amendment to the 1945 constitution. The implementation of the president’s prerogatif in the judiciary is not a form of interference, but the implementation of the check and balance system in Indonesia.

Abstract

The Sexual Violence Crime Law (UU TPKS) was passed in 2022. However, the TPKS Law cannot be separated from various incidents, this is also the background for the TPKS Law taking a long time to be ratified. One of the controversial ones is related to the sexual consent paradigm which is often the reason for rejection of the TPKS Bill. This research uses the library study method, namely the author collects data by searching for data and information through books, journals, documents, articles, news and other library sources. The author will collect library data, record and analyze discourse related to sexual consent in the TPKS Bill, both within the DPR and external parties, namely community organizations. The Prosperous Justice Party (PKS), Islamic Defenders Front (FPI) and several other organizations use religious ideology in rejecting the TPKS Bill, while KUPI, Komnas Perempuan, Gusdurian, and other women's activist groups try to remember the mindset of the initial purpose of the TPKS Bill which was formed in basically departs from feminist ideology.

Abstract

Penelitian ini bertujuan untuk mendeskripsikan peran kepala sekolah dalam melaksanakan Kurikulum Merdeka di Sekolah Indonesia Kota Kinabalu (SIKK), Sabah, Malaysia. Pendekatan penelitian yang digunakan adalah kualitatif deskriptif dengan teknik pengumpulan data melalui wawancara, observasi, dan dokumentasi. Informan penelitian terdiri dari kepala sekolah, wakil kepala sekolah bidang kurikulum, dan guru penggerak. Hasil penelitian menunjukkan bahwa kepala sekolah SIKK menjalankan perannya secara optimal pada tujuh indikator utama, yaitu: (1) Educator, membimbing guru dalam pembelajaran berdiferensiasi dan mendukung pengembangan profesional; (2) Manajer, menyusun program kerja, mengelola sumber daya, dan membagi tugas secara jelas; (3) Administrator, mengelola administrasi kurikulum dan dokumentasi pembelajaran; (4) Supervisor, melakukan supervisi kelas serta memberikan umpan balik; (5) Leader, menjadi teladan, membangun visi bersama, dan menumbuhkan kerja kolektif; (6) Innovator, mendorong pembelajaran berbasis proyek dan menciptakan lingkungan belajar inovatif; serta (7) Motivator, memberikan dukungan moral dan penghargaan untuk meningkatkan kinerja guru. Temuan ini menegaskan bahwa peran adaptif dan kolaboratif kepala sekolah memiliki pengaruh signifikan terhadap keberhasilan implementasi Kurikulum Merdeka di SIKK. Kata Kunci : Peran kepala sekolah, Kurikulum Merdeka, Sekolah Indonesia Kota Kinabalu
