Abstract

Tujuan penelitian ini untuk mengkaji mengenai Status dan Perlindungan Hak Anak Luar Kawin ditinjau dalam Hukum Positif di Indonesia. Penelitian dari bidang hukum normatif digunakan dalam penelitian ini. Doktrin atau asas-asas ilmu hukum menjadi bahan penelitian yuridis normatif. Hasil Penelitian menunjukan bahwa Hak Anak Luar Kawin di dalam Pasal 1 (2) Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak menunjukkan bahwa anak-anak di luar nikah dilindungi undang-undang demi menjamin hak-hak mereka. Hak-hak anak, khususnya anak di luar nikah, dijamin oleh negara yang juga mempunyai perlindungan hukum. Negara menjunjung tinggi dan membela hak-hak anak di luar nikah berdasarkan Undang-Undang Perlindungan Anak. R. Subekti mengatakan bahwa ikatan keluarga dan segala dampaknya, termasuk anak dan orang tua yang mengakuinya sebagai sebuah keluarga, hanya dapat berkembang jika sudah ada pengakuan. Pengesahan anak hanya dapat dilakukan dengan surat pengesahan dari kepala negara apabila orang tua pasangan suami istri belum mengakui anak pranikahnya. Pengakuan anak tidak sah berupa akta notaris, akta kelahiran anak, dan akta nikah orang tuanya.

Abstract

Ideally, a curator in bankruptcy proceedings should act transparently, accountably, and professionally so that all company assets, including share deposit funds, are managed in accordance with legal provisions without causing harm to any party. However, the reality shows deviations, as in the bankruptcy case of PT Alam Galaxy, where share deposit funds were converted into debt with inflated values, even involving alleged document forgery and creditor claim mark-ups. This study aims to analyze the curator’s liability for share deposit funds recognized as debt in the bankruptcy case of PT Alam Galaxy based on Decision Number 54/Pdt.Sus-PKPU/2021/PN Niaga Surabaya. In addition, it examines the legal implications of recognizing capital deposits as debt for the legal position of the company, creditors, and shareholders. The research employs a normative juridical method with statutory, case, and conceptual approaches, supported by analysis of official court documents, literature, and bankruptcy law principles. The findings indicate that curators are obliged to bear responsibility for negligence or actions that cause losses to the bankrupt estate as regulated under Article 72 of the Bankruptcy Law and may even be held personally liable under Article 1365 of the Civil Code. Furthermore, the recognition of share deposit funds as debt leads the company into insolvency, disrupts the corporate capital structure, and undermines legal protection for creditors and shareholders.

Abstract

In an agreement, it is crucial for both parties to comprehend the rights and responsibilities that will arise. The agreement also stresses the voluntary responsibility to fulfill obligations, with situations where parties fail to meet their obligations being termed Force Majeure or Masyaqqah events. In the context of Sharia Economic Law, Force Majeure/Masyaqqah refers to circumstances where a party is unable to fulfill their agreed-upon duties due to fatigue, difficulties, and hardships. This concept serves to protect parties experiencing such events. However, in the discussion of Decision Number 863/Pdt.G/2020/PA.Mks, it is explained that parties were unable to meet their obligations due to Force Majeure. This research will also explore the legal protections available to both parties under Sharia Economic Law and applicable Indonesian laws.

Abstract

This research paper provides a comparative analysis of the legal frameworks governing the delisting of issuer shares in Indonesia, the United States, and Singapore. Using a normative legal research approach, supplemented by interviews with members of the Financial Services Authority (OJK) and a Member of the House of Representatives Commission XI, the study explores how each jurisdiction addresses the delisting process, particularly focusing on the protection of minority shareholders . The analysis reveals that Indonesia's legal system, influenced by its Civil Law heritage, contrasts with the Common Law approaches of the US and Singapore, especially in terms of shareholder involvement in voluntary delisting and the specificity of conditions for forced delisting. The study suggests enhancements to the Indonesian framework, such as clearer guidelines for shareholder approval in delisting decisions and more transparent criteria for forced delisting. These recommendations aim to improve the protection of minority shareholders within Indonesia's Capital Market.

Abstract

In filing a bankruptcy petition, the petitioner must fulfill the requirements for the petition to be granted by the panel of judges. These requirements are stipulated in Article 2 paragraph (1) in conjunction with Article 8 paragraph (2) of Law No. 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations. According to these requirements, the bankruptcy petitioner must provide evidence that there are other creditors, either by presenting these other creditors as witnesses or by the debtor's acknowledgment in the form of promissory notes or other documents. However, in its implementation, it turns out that the method of proving this is subject to multiple interpretations, leading to legal uncertainty, namely whether other creditors need to be present in the hearing or if the debtor's acknowledgment is sufficient. This research will be conducted using a normative research method, which involves studying legislation with an approach to bankruptcy cases in Indonesia

Abstract

This research discusses the use of evidence, including circumstantial evidence, in the process of examining the Cooking Oil case No. 15/KPPU-I/2022 by the Business Competition Supervisory Commission (KPPU). This case involves alleged cartel practices in the cooking oil industry in Indonesia. This research aims to analyze the extent to which indirect evidence contributes to proving cartel practices in this case and how this evidence is used in law enforcement. The research method used is an in-depth case study, by collecting and analyzing data from various relevant sources. The research results show that indirect evidence plays an important role in building cases of cartel practices and contributes significantly to the enforcement of business competition law. The KPPU's decision in this case was supported by strong evidence, and the use of circumstantial evidence has helped uncover violations of business competition law. This decision has a direct impact on business competition practices in the cooking oil industry and encourages compliance with business competition laws in the future

Abstract

The demand for housing creates business opportunities for private individuals to venture into the residential property sector. Housing development companies, also referred to as developers, can face bankruptcy. When declared bankrupt, the developer often maintains a legal relationship with the homebuyer, based on the Sale and Purchase Agreement. This research aims to determine the legal status of a house in situations where the developer goes bankrupt, in accordance with Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations. This study employs a qualitative research method with a normative approach, focusing on statutory aspects. The research findings indicate that, as per the Bankruptcy Law, the Sale and Purchase Agreement between the developer and the homebuyer is voided. This occurs because ownership rights to both the land and house remain with the developer, making them assets subject to bankruptcy proceedings. Consequently, the homebuyer may apply as a creditor simultaneously, seeking compensation.

Abstract

Penelitian ini mengaji serta komprehensif dan mendalam terkait Undang-Undang Perlindungan Data Pribadi Nasabah dalam Layanan Pinjaman Online. Fokus pembahasan penelitian ini adalah Perlindungan Nasabah dan Tanggung Jawab Penyelenggara Pinjaman Online berdasarkan Undang-Undang Perlindungan Data Pribadi Nomor 27 Tahun 2022. Studi ini bertujuan untuk mengevaluasi efektivitas Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi (UU PDP), dalam konteks menjamin hak-hak privasi nasabah. Penelitian ini menggunakan pendekatan yuridis-normatif untuk menganalisis berbagai peraturan perundang-undangan terkait perlindungan data pribadi di sektor fintech. Kebaruan penelitian ini terletak pada kajian terperinci mengenai implementasi putusan tersebut dalam memperkuat pengawasan dan sanksi terhadap penyelenggara layanan fintech, yang sering kali lalai dalam menjaga data pribadi nasabah. Hasil penelitian menunjukkan bahwa meskipun regulasi telah ada, implementasinya masih belum optimal, terutama terkait pengawasan dan penegakan hukum yang konsisten. Putusan Mahkamah Agung ini memberikan ‘resep ampuh’ berupa pedoman dalam pelindungan data pribadi nasabah peminjam serta mempertegas tanggung jawab pemerintah dan penyelenggara layanan untuk melindungi data pribadi nasabah secara lebih efektif.
