Abstract

The livelihood of children resulting from Siri (unregistered) Marriages is a problem in the Kawahmanuk Village, Darma District, Kuningan Regency because they don't fully receive rights from their parents. The target of this research is to analyze the practice of providing livelihood for children resulting from Siri Marriages in Kawahmamnuk Village, Darma District, Kuningan Regency, Beside that, this research also object to analyze how children resulting from unregistered marriages are provided for according to Islamic law and positive law in Kawahmanuk Village, Darma District, Kuningan Regency as well as comparing Islamic law and positive law regarding the maintenance of children resulting from unregistered marriages in Kawahmanuk Village, Darma District, Kuningan Regency. The investigation method uses qualitative methods, the type of research is field research and the data collection technique used in this research is a structured interview technique. The results of this study are First, the practice of providing for children resulting from siri marriages in Kawahmanuk Village, Darma District, Kuningan Regency is the same as marriages in general, where the responsibility for providing for children resulting from siri marriages on the husband, although sometimes fully provided or insufficient. Second, according to Islamic law, the obligation to provide support for children resulting from an siri marriage in Kawahmanuk Village, Darma District, Kuningan Regency is the same as for marriages in general, where the responsibility for providing for children resulting from an siri marriage lies with the husband. Third, according to positive law, the obligation to provide support for children resulting from siri marriages in Kawahmanuk Village, Darma District, Kuningan Regency is different from marriages in general, where the marriage has no legal force, the husband does not have to be responsible for the child's support, and the child has no right to claim support. Fourth, a comparison of Islamic law and positive law regarding the maintenance of children resulting from siri marriages in Kawahmanuk Village, Darma District, Kuningan Regency, that according to Islamic law the obligation to provide support for children resulting from siri marriages is like in marriages in general, where the husband must be fully responsible for the child's maintenance, whereas according to positive law, this marriage does not abide by the law, and fathers do not have to be responsible for the maintenance of children resulting from siri marriages, and children cannot claim their rights.

Abstract

In determining the nominal post-divorce living, there was disagreement between the applicant and the respondent. So, the judge decides using his considerations in deciding the case. This research aims to determine the considerations of the Kuningan Religious Court judges in deciding case no. 0119/Pdt.G/2020/PA.Kng concerning the nominal amount of living as a result of divorce due to a disagreement between the applicant and the respondent and to analyze the conformity of the Kuningan Religious Court judge in deciding case No. 0119/Pdt.G/2020/PA.Kng regarding the nominal amount of living as a result of divorce due to a disagreement between the applicant and the respondent. The research method used by researchers is qualitative research using this type of data, namely data obtained from field research (field research). Then the data collection technique is by conducting interviews and documentation. Based on the research that has been carried out, it can be concluded that the considerations that the judge used in deciding case No.0119/Pdt.G/2020/PA.Kng were by looking at the ability, feasibility and claim. Moreover, the view of Islamic law and the law of positive considerations that judges use in deciding case No. 0119/Pdt.G/PA.Kng is in accordance with Islamic law and applicable positive law, as explained in the Al-Qur'an and the Compilation of Islamic Law (KHI). There are similarities between the basis of Islamic law and the basis of positive law used by judges, which have been explained in terms of both legal bases.

Abstract

Pernikahan atau perkawinan merupakan suatu perbuatan hukum yang pastinya menimbulkan akibat hukum, yaitu adanya hak dan kewajiban dari semua anggota keluarga. Salah satu kewajiban tersebut adalah kewajiban seorang anak untuk memberikan nafkah kepada orang tua baik anak sah maupun anak luar nikah. Kewajiban nafkah ini telah diatur baik dalam mazhab Syafi’i. Selain itu dalam hukum positif melalui Undang-Undang No. 1 Tahun 1974 pasal 46 ayat 2. Juga Undang-Undang Nomor 23 Tahun 2004 pasal 49. Fokus penelitian ini adalah komparasi mazhab Syafi’i dan hukum positif yang dituangkan dalam persamaan dan perbedaan mengenai kewajiban anak luar nikah menafkahi orang tua. Penelitian ini merupakan jenis penelitian kualitatif, yaitu penelitian terhadap literatur-literatur yang berkaitan dengan kewajiban anak luar nikah menafkahi kedua orang tuanya di masa tuanya. Sumber data terdiri dari data primer dan sekunder, yaitu data yang digunakan adalah kitab-kitab mazhab Syafi’i. Selain itu sebagai data primer untuk hukum positif yaituUndang-Undang No. 1 Tahun 1974 tentang Perkawinan dan Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga. Sedangkan data sekunder antara lain adalah kitab-kitab fiqih dan buku-buku hukum dan literatur lainnya. Data hasil penelitian dari sumber-sumber tersebut kemudian menggunakan metode content analysys dan komparatif. Penelitian ini menunjukkan bahwa baik dari tinjauan hukum mazhab Syafi’i maupun hukum positif mewajibkan seorang anak luar nikah untuk memberikan nafkah kepada orang tua. Terdapat komparasi (perbandingan) yang dituangkan dalam persamaan dan perbedaannya. Persamaan, pertama, kewajiban nafkah kepada orang tua baik dalam mazhab Syafi’i maupun hukum positif sama-sama dibebankan kepada anak, baik laki-laki dan perempuan. Kedua, dalam hal jenis nafkah sama-sama merupakan kebutuhan pokok bagi orang tua. Ketiga, baik mazhab Syafi’imaupun hukum positif menganggap bahwa kewajiban anak menafkahi orang tua merupakan kewajiban moral sebagai bentuk dari timbal balik pemeliharaan orang tua serta salah satu bukti berbuat baik kepada orang tua.

Abstract

Divorce is the dissolution of a marital bond, which results in the termination of the relationship between husband and wife. A divorce petition may be filed by both parties, whether the husband or the wife. When the wife initiates the divorce, it is referred to as cerai gugat, and when initiated by the husband, it is called cerai talak. Divorce can occur for various reasons, one of which is the husband‟s imprisonment. This study aims to examine the judgment in case Number 3539/Pdt.G/2019/PA.Sbr regarding a divorce caused by the husband's imprisonment, and to analyze this from the perspective of maqashid sharia.This research is a normative study using a qualitative method. Primary data were collected through interviews, while secondary data were gathered from documentation and various relevant literature sources. The collected data were then reduced, presented, and concluded using data analysis techniques.The results of the study show that in case Number 3539/Pdt.G/2019/PA.Sbr, concerning divorce due to the husband‟s imprisonment, the plaintiff (wife) filed for divorce at the Sumber Religious Court, Class 1A, due to frequent disputes and continuous arguments. These conflicts stemmed from the fact that the husband was a narcotics user, leading to his arrest by the Cirebon police and subsequent imprisonment.The panel of judge‟s in granting the divorce included the defendant‟s absence from the court sessions, fulfillment of the requirement to advise the plaintiff to maintain the marriage, the failure of the mediation process, corroboration of the witness statements with the evidence submitted by the plaintiff, and the ongoing disputes caused by the husband‟s drug use and imprisonment. The judge did not base the decision solely on the husband's imprisonment because his sentence was less than five years. According to Government Regulation Nomor 9 of 1974, divorce can be granted on the grounds of a spouse‟s imprisonment only if the sentence is five years or more. From the perspective of maqashid sharia, the decision of the Sumber Religious Court, Class 1A, in case Number 3539/Pdt.G/2019/PA.Sbr, is aligned with the principles of Maqashid Syariah, as it ensures the benefit of the plaintiff, particularly in terms of preserving religion (hifdz ad-din), life (hifdz an-nafs), intellect (hifdz al-„aql), and property (hifdz al-maal).

Kedua, dalam hal jenis nafkah sama-sama merupakan kebutuhan pokok bagi orang tua.
