Abstract

Sebagai makhluk yang digolongkan lemah, wanita cukup sering menjadi korban dari adanya kejahatan seksual seperti hal nya pemerkosaan yang berujung pada kehamilan. Hal tersebut menimbulkan niat wanita untuk memilih aborsi sebagai suatu jalan pintas untuk mengatasi kehamilan yang tidak ia inginkan tersebut. Dalam KUHP aborsi termasuk dalam suatu jenis tindak kejahatan yang tentu saja dilarang, tetapi UU memungkinkan melakukan aborsi namun dengan memberikan syarat seperti yang termuat pada Pasal 76 UU Kesehatan. Tujuan studi ini ialah mengkaji bentuk perlindungan hukum bagi korban pemerkosaan yang melakukan aborsi. Metode penulisan jurnal ini menggunakan penelitian normatif yang berpatokan pada bahan hukum primer yang meliputi peraturan perundang-undangan yang berlaku, serta bahan hukum sekunder yang meliputi buku-buku maupun jurnal dan juga dengan menggunakan pendekatan undang-undang. Penulisan hukum ini dimotivasi oleh tingginya tingkat aborsi di indonesia baik yang dilakukan oleh remaja atau ibu rumah tangga. Namun pada studi ini terfokus pada suatu Tindakan aborsi yang mana dilakukan oleh perempuan yang merupakan korban pemerkosaan. Kata Kunci: Wanita, Korban, Pemerkosaan, Aborsi ABSTRACT Women, as weak creatures, are often victims of sexual crimes such as rape and pregnancy. It is not uncommon for abortion to be chosen as a shortcut in overcoming unwanted pregnancy (KTD). In the Criminal Code, abortion is included in prohibited actions, but Law No. 36 of 2009 concerning Health allows having an abortion but by providing the conditions as contained in Article 76 of Law No. 36 of 2009 concerning Health. The purpose of this study is to examine the form of legal protection for victims of rape who have had abortions. This journal writing method uses normative research which is based on primary legal materials which include applicable laws and regulations, as well as secondary legal materials which include books and journals and also by using a statutory approach. The writing of this law was motivated by the high rate of abortion in Indonesia, both by teenagers or by housewives. However, this study focuses on abortions performed by women who are victims of rape. Keyword: Woman, Victim, Rape, Abortion

Abstract

The purpose of this writing is to examine criminal acts that can be classified under forced defense and to analyze the form of criminal liability for victims of robbery who defend themselves in emergency situations. This research applies a normative legal approach, utilizing the study and analysis of literature sources in accordance with primary, secondary, and tertiary legal materials, and employing conceptual and legal approach methods. The results of this writing explain that criminal acts can be excluded from punishment if they meet the elements of forced defense as stipulated in Article 49 of the Criminal Code. The victim of the crime of robbery (begal) who defends themselves in an emergency cannot be convicted if the action is carried out proportionally, as a reaction to a real threat to self, honor, or property. The recognition of forced defense as a reason for criminal expungement provides legal protection for victims of crime who are forced to defend themselves. This encourages law enforcement officials to consider aspects of justice, proportionality, and the context of the event in the criminal justice process.
