Abstract

Industry 4.0 has shifted conventional buying and selling transactions into online buying and selling transactions with online shopping platforms such as Shopee. Online buying and selling transactions that occur at Shopee are regulated in the Electronic Information Technology Law (UU ITE) which guarantees that all parties are in good faith. Violation of the ITE Law will be subject to a maximum criminal sentence of six years and / or a maximum fine of one billion rupiah. Meanwhile, online buying and selling transactions at Shopee can also be viewed from the application of the five principles of Islamic business ethics in Islamic law, namely the principle of unity, balance, free will, responsibility, and ihsan / truth. Even so, the seller still often violates the principles of unity, balance, responsibility and ihsan / truth. The buyer also has a tendency to violate the principle of free will by blaming the seller for delays in the delivery of the goods. The courier party also violated the principle of free will because it did not fulfill the contract to estimate the delivery of goods as specified. Shopee has proven to be able to maintain the continuity of its business by applying Islamic business ethics based on maqashid sharia Abstrak Industri 4.0 telah menggeser transaksi jual-beli konvensional ke dalam transaksi jual-beli online dengan platform online shopping seperti Shopee. Transaksi jual-beli online yang terjadi pada Shopee telah diatur dalam Undang-Undang Informasi Teknologi Elektroni (UU ITE) yang menjamin seluruh pihak berada dalam itikad baik. Pelanggaran terhadap UU ITE akan dikenakan hukuman pidana paling lama enam tahun dan/atau paling banyak denda uang sebesar satu miliyar rupiah. Sementara itu, transaksi jual-beli online pada Shopee juga dapat ditinjau dari penerapan lima prinsip etika bisnis Islam dalam Hukum Islam, yakni prinsip kesatuan, keseimbangan, kehendak bebas, pertanggung jawaban, dan ihsan/kebenaran. Meskipun demikian, pihak penjual masih kerap melakukan pelanggaran pada prinsip kesatuan, keseimbangan, pertanggung jawaban, dan ihsan/kebenaran. Pihak pembeli juga memiliki tendensi untuk melakukan pelanggaran terhadap prinsip kehendak bebas dengan menyalahkan penjual atas keterlambatan pengiriman barang. Pihak kurir juga melakukan pelanggaran terhadap prinsip kehendak bebas karena tidak memenuhi kontrak estimasi pengiriman barang sesuai dengan yang ditentukan. Pihak Shopee terbukti mampu menjaga keberlangsungan bisnisnya dengan menerapkan etika bisnis Islam dengan berdasarkan pada maqashid syariah.

Abstract

The health insurance policy for retired ministers as stipulated in Presidential Regulation No. 121/2024 has sparked controversy regarding fairness and its implications for state financial accountability. This study aims to analyze the suitability of this policy with the principles of social justice and state financial accountability in public budget management. The method used is normative juridical through statutory, conceptual and case-based approaches based on the general principles of good governance, especially the principles of justice, propriety, and public budget efficiency. The results show that this policy has the potential to create social injustice because it provides special facilities to political elites without objectively considering their economic conditions. In addition, this policy risks burdening the state budget disproportionately and disrupting essential public sector budget allocations. It is concluded that the policy has the potential to be tested through judicial review because it contradicts the principles of good state financial governance.
