Abstract

Illegal Fishing merupakan masalah yang tidak dapat terselesaikan secara substansial, dilihat intensitas kejadian maupun kerugian yang ditimbulkan. Problem Illegal Fishing terjadi karena penegakan hukum yang lemah, koordinasi antar lembaga penegak hukum, luasnya wilayah laut dan rendahnya hukuman. Kebijakan menenggelamkan kapal illegal fishing, menjadi suatu harapan baru yang mesti dilakukan secara konsisten. Penelitian ini bertujuan untuk mengetahui kebijakan hukum penanggulangan illegal fishing di wilayah perairan Indonesia khususnya di wilayah perairan laut Provinsi Maluku. Metode penelitian yang digunakan adalah metode yuridis normatif, dengan pendekatan perundang-undangan dan pendekatan konseptual.. Hasil penelitian menunjukan bahwa dengan diratifikasinya United Nations Convention on the Law of the Sea 1982, Negara Kesatuan Republik Indonesia memiliki hak untuk melakukan pemanfaatan, konservasi, dan pengelolaan sumber daya ikan di perairan Indonesia, Zona Ekonomi Eksklusif Indonesia dan laut lepas yang dilaksanakan berdasarkan persyaratan atau standar intemasional. Akan tetapi, kondisi ini menimbulkan persoalan baru, terutama banyaknya kapal asing maupun kapal dalam negeri yang secara ilegal beroperasi melakukan penangkapan ikan di wilayah perairan Nusantara, terutama di wilayah laut Provinsi Maluku. Meskipun pemanfaatan wilayah laut di Indonesia telah di atur dalam berbagai ketentuan peraturan perundang-undangan akan tetapi pelaksanaan di lapangan masih terkendala akibat kegiatan illegal fising oleh kapal-kapal asing untuk itu instrumen kebijakan yang dapat di gunakan pemerintah yaitu mengakomodir dalam suatu sistem yang utuh dan komprehensif dengan mengintegrasikan dimensi penegakan hukum yang terkoordinir antar institusi, melibatkan masyarakat hukum adat, dan dilaksanakan dengan orientasi pembangunan kelautan serta mengutamakan pengembangan kawasan perbatasan Negara terkhususnya peningkatan pengawasan pada wilayah-wilayah yang sering menjadi target illegal fishing di Provinsi Maluku.

Abstract

Ownership rights to land as a type of property right are very important for the state, nation, and people of Indonesia as an agrarian society which is developing towards industrial development and so on, but land is the basic life for humans. Various existing governance concepts, its validity as a basis for agrarian management must be tested again. With these actions, it is hoped that there will be synergy between agrarian issues and an environmentally based management orientation. The aim of the service is to provide legal understanding related to agrarian law based on local wisdom and environmental law in small island border areas. The Service Method is carried out in a lecture by each presenter, the presenter is given time to present the material, after that the participants are invited to ask problems or questions which are then answered in turn by the presenters according to the problem being asked. The results of this community service activity are one form of tridharma activity for educators to play a role in resolving problems that occur in the community, especially regarding Agrarian Law Based on Local Wisdom and Environmental Law on Small Border Islands through legal counseling that discusses the customary rights of customary law communities. encounters development, resulting in changes in the community's living environment.

Abstract

Introduction: Environmental law enforcement is one of the processes carried out to provide legal certainty. In principle, indigenous peoples always carry out exploitation in coastal areas, so law enforcement is needed so that it can run optimally, where this experiences obstacles in the process and causes environmental law enforcement to not run effectively.Purposes of the Research: To find out the enforcement of environmental law against indigenous communities who exploit coastal areas and the obstacles in enforcing environmental law for indigenous communities in coastal areas.Methods of the Research: The method used in this study is normative- juridical, which focuses on the main law by examining theories, concepts, legal principles, and laws and regulations related to this research.Results of the Research: Environmental law enforcement can run well through criminal, administrative and civil aspects. Enforcing environmental laws for indigenous communities against exploitation in coastal areas has become very difficult. This is influenced by legal factors, law enforcement, facilities and infrastructure, society and culture itself. These five factors are one of the things that causes environmental law enforcement to not run optimally. For this reason, there must be cooperation between regional governments and law enforcement in order to prevent prolonged exploitation and cause marine areas to become damaged and not well controlled, so that regional governments must coordinate with stakeholders in the regions, in this case the environmental services and village governments. locally to follow up on problems in coastal areas resulting from sand and coral mining by indigenous communities.

Abstract

Combating narcotics smuggling via maritime routes poses a considerable challenge for Indonesia due to its expansive territorial waters and the prevalence of small, unregulated ports that are often exploited by transnational criminal organizations. This research aims to evaluate the effectiveness of law enforcement in addressing maritime drug trafficking and to examine the roles of major enforcement bodies, including the Indonesian National Police, the Directorate General of Customs and Excise, and the National Narcotics Agency. Utilizing a normative juridical research approach, the study is grounded in legal theory and statutory analysis. The findings reveal that the majority of narcotics enter Indonesia through sea routes using increasingly advanced smuggling techniques. However, enforcement efforts are hampered by limitations in human resources, surveillance infrastructure, and inter-agency coordination. Existing legal and operational measures have proven inadequate in deterring or prosecuting maritime drug crimes. The study concludes that strengthening maritime surveillance systems, enhancing institutional cooperation, and fostering community involvement are essential to effectively combat narcotics trafficking in Indonesian waters. Furthermore, legal reforms are necessary to adapt law enforcement strategies to the complex and transnational dynamics of organized drug crime
