Abstract

This article analyses the concept and practice of international relations according to fiqh al-siyasah, which is related to war and peace, international law, diplomacy, and international cooperation. This study emphasises the normative concept of international relations (al-‘alâqât al-dauliyyah) using international relations studies and international law. Thus, the sources of data or information in this study are the Quran, Hadis, the opinions of Muslim scholars (ulama) and theories of international relations and international law. Since the beginning, Islam has provided guidelines on relations between groups and kingdoms, which in today's context refer to international relations. In addition to the principles of international relations, the Quran and Hadith also provide normative references, which the Muslim scholars formulated as international law. Philosophically, there is a difference between secular international law and Islamic law derived from revelation understood by contextual ijtihad. However, at present, the majority of Muslim scholars believe that, in general, there is compatibility between the principles of modern international law and the principles of Islamic law, especially in the form of agreements ('uhûd and mawâtsiq), customs ('âdât), and ratio ('aql), which also recognised by Islamic law.

Abstract

Almost all ulama and Muslim intellectuals in Indonesia accept the term “democracy” and support it as a system that must be implemented in Indonesia. The emergence of the “reform era” following the fall of authoritarian Soeharto’s government in 1998 was marked as the starting point of the transition to substantive democracy. The political reform took the form of conducting free elections, developing a multiparty system, and guaranteeing more freedom for the press and citizens to express their opinions and criticism, and the amendments to the 1945 Constitution. This ran well, so the democratic transition was considered successful. The political parties and civil society organizations, including those with an Islamic background, played an important role in this transition. To develop a civilized democracy in Indonesia, the government, political parties, and civil societies, especially religious organizations, made efforts to strengthen ethics and moral education as well as civic education, conveying values in a democratic system, such as tolerance, trust, responsibility, law consciousness, and others. This research was done through qualitative approach, based on library documents.

Abstract

. This article discusses public finance from the perspective of Islamic jurisprudence focusing on fiscal policy. Using the rules of ushul fiqh which emphasizes maqâshid al-syarî'ah as the main method in siyâsah syar'iyyah. This policy includes the function of managing sources of public income and their distribution or managing public spending as well as the function of financial stabilization. The study found that management of public revenues, such as zakat, waqf, infaq, sadaqah, in addition to jizyah, kharâj, ghanîmah, and fai' is currently not yet practiced, so ulama provides support for the development of a fair tax system and state efforts to manage natural resources sustainably as well as the development of accountable public services. The main priority in preparing the state budget is realizing people's welfare, poverty alleviation, and economic development.Abstrak:Artikel ini membahas keuangan negara atau keuangan publik (al-mâliyyah al-‘âmah) dalam perspektif fikih siyasah, dengan penekanan pada bahasan kebijakan fiskal (al-siyâsah al-mâliyyah). Sumber data atau informasi dalam pembahasan ini adalah Al-Quran, Hadits, dan pendapat ulama, yang dianalisis dengan menggunakan metode ushul fiqh yang menekankan pada maqâshid al-syarî’ah sebagai metode utama dalam siyâsah syar’iyyah. Sejak awal Islam telah memberikan    pedoman umum tentang keuangan publik, baik dalam bentuk kebijakan fiskal maupun kebijakan moneter. Kebijakan fiskal ini meliputi fungsi alokasi atau pengelolaan sumber-sumber pendapatan publik (al-mawârid al-mâliyyah) dan fungsi distribusi atau pengelolaan belanja publik (al-infâq al-‘âm) serta fungsi stabilisasi keuangan (al-istiqrâr al-mâlî). Al-Quran dan Hadits telah menyebutkan beberapa bentuk pendapatan publik, yakni: zakat, wakaf, infak, sadaqah, di samping jizyah, kharâj, ghanîmah, dan fai’. Namun pada saat ini sebagian dari sumber-sumber pendapatan ini tidak lagi dipraktikkan. Sebagai gantinya, para ulama mendukung pengembangan sistem pajak secara adil dan usaha-usaha negara untuk mengolah sumber daya alam serta pengembangan pelayanan publik. Dalam penyusunan anggaran belanja negara (publik), prioritas utama adalah untuk mewujudkan kesejahteraan rakyat dan penanggulangan kemiskinan serta pertumbuhan dan pengembangan ekonomi.

Abstract

Almost all governments in the world, including authoritarian, claiming that their political system is democratic. However, not all governments in the Muslim world accept this system. Among the 'ulama and Muslim intellectuals themselves there are differences of opinion about the system and the concept of democracy. In general, the modernist Muslim groups accept this system, because he was judged to be compatible with Islam, while Muslim groups "fundamentalist" and mostly conservative Muslims reject this system, because it supposedly excludes the sovereignty of God.The problem that often arises is how to implement human rights in Islamic societies. Then in 1990 the Muslim countries which are members of the Organization of the Islamic Conference (OIC) issued a "Cairo Declaration of Human Rights in Islam" , after over 13 years of discussing this issue among its members. Abstract

Minority jurisprudence is an innovation in jurisprudence regarding various problems faced by Muslims living in the midst of a non-Muslim majority. This research focuses on the methodology used by the conceptors of fiqh al-aqalliyyat, namely Abdallah bin Bayyah, Taha Jabir Al-Alwani & Jamāl al-Dīn 'Atiyyah in building the structure of the ijtihad framework of fiqh al-aqalliyyat in countries with Muslim minorities. This research is a qualitative literature study with several legal research approaches. More specifically, in the study of Islamic law this research belongs to the category of philosophical-normative-empirical research, by examining three main ideas initiated by the conceptors of fiqh al-aqalliyyat namely Abdallah bin Bayyah, Taha Jabir Al-Alwani & Jamāl al-Dīn 'Atiyyah. This research concludes that the thought of fiqh al-aqalliyyat Abdallah bin Bayyah, Taha Jabir Al-Alwani & Jamāl al-Dīn 'Atiyyah is considered to be able to accommodate the problems of Muslim minorities, by covering all the principles, methodologies, concepts of ijtihad from each mujtahid who focuses on fiqh al-aqalliyyat, so that these methods that have become legal products can be used for Muslim minorities to be able to carry out the principles of Islamic teachings substantially and coexist with non-Muslim majorities. Fikih minoritas merupakan inovasi dalam berijtihad tentang berbagai problematika yang dihadapi muslim yang hidup di tengah mayoritas non-Muslim. Dalam penelitian ini berfokus pada metodologis yang dipakai oleh konseptor fiqh al-aqalliyyat yakni Abdallah bin Bayyah, Taha Jabir Al-Alwani & Jamāl al-Dīn ‘Atiyyah dalam membangun struktur kerangka ijtihad fiqh al-aqalliyyat pada negara dengan minoritas muslim. Penelitian ini merupakan studi kepustakaan yang bersifat kualitatif dengan beberapa pendekatan penelitian hukum. Lebih spesifik lagi, dalam kajian hukum Islam penelitian ini termasuk kategori penelitian filosofis-normatif-empiris, dengan mengkaji tiga pokok pikiran yang digagas oleh konseptor fiqh al-aqalliyyat yakni Abdallah bin Bayyah, Taha Jabir Al-Alwani & Jamāl al-Dīn ‘Atiyyah. Penelitian ini menyimpulkan bahwa pemikiran fiqh al-aqalliyyat Abdallah bin Bayyah, Taha Jabir Al-Alwani & Jamāl al-Dīn ‘Atiyyah dinilai dapat mengakomodir permasalahan muslim minoritas, dengan mencakup seluruh prinsip-prinsip, metodologi, konsep ijtihad dari masing-masing mujtahid yang berfokus pada fiqh al-aqalliyyat, sehingga metode-metode tersebut yang sudah menjadi produk hukum dapat digunakan bagi muslim minoritas untuk dapat menjalankan prinsip-prinsip ajaran Islam secara substansial dan hidup berdampingan dengan mayoriats non muslim.
