Abstract

AbstrakPerbankan syariah di Indonesia sudah mengalami perkembangan yang cukup pesat dan semakin menyebar. Industri Perbankan di Indonesia mencatat sejarah baru dengan hadirnya Bank Syariah Indonesia (BSI) yang didirikan 1 februari 2021, atau 19 jumadil Akhir 1442 H. Pembiayaan merupakan salah satu tugas  didalam lembaga keuangan Perbankan. Produk pembiayaan yang banyak dipilih nasabah adalah Pembiayaan Kredit Usaha Rakyat (KUR) dengan menggunakan akad Murabahah. Penelitian ini bertujuan untuk mengetahui bagaimana penerapan akad murabahah produk pembiayaan Kredit Usaha Rakyat (KUR) di BSI KC Medan Adam Malik. Penelitian ini merupakan hasil pengamatan penulis selama melakukan magang di BSI KC Medan Adam Malik. Metode yang digunakan dalam penelitian ini yaitu metode penelitian kualitatif.  Sumber data didapat dari hasil penelitian lapangan (magang) dan juga wawancara dengan Finacing Operation Staff. Hasil penelitian ini adalah penerapan akad Murabahah pada produk pembiayan KUR (Kredit Usaha Rakyat) di Bank Syariah Indonesia KC Medan Adam Malik sesuai dengan fatwa dan prosedur transkasi murabahah, karena akad Murabahah akan dilakukan dan diberikan pembiayaan setelah adanya pembelian barang yang diminta oleh nasabah.Kata Kunci : Penerapan, Pembiayaan, Murabahah

Abstract

The Financing to Value (FTV) policy is a macroprudential policy issued by Bank Indonesia to determine the total ratio between the value of credit that can be provided by a bank to the value of collateral in the form of property at the time of initial lending to customers. This research aims to be able to know how the procedures for implementing risk management in Sharia Home Ownership Loans (KPR) financing and knowing FTV policies can minimize problem financing on Sharia KPR products at Bank Muamalat Branch Office (KC) Medan City Hall. In this study, the authors used qualitative research with a case study approach. Data collection techniques used interviews and documentation. From the results of the research conducted, it was found that Bank Muamalat KC Medan City Hall has fully implemented Bank Indonesia’s policy regarding Finance to Value (FTV) in KPR financing products. However, this implementation is not fully in accordance with existing policies and the application of these policies has not fully minimized the NPF of Sharia KPR. In addition, the implementation of Sharia Home Ownership Loans (KPRS) distribution carried out by Bank Muamalat KC Medan City Hall did not go well due to several things that caused problematic financing, including non-performing loans. Problematic credit financing at Bank Muamalat KC Medan City Hall is caused by two things, namely debtors and creditors. To prevent and overcome problem financing loans that have been carried out by Bank Muamalat KC Medan City Hall, namely by providing understanding to debtors and providing concessions to ongoing credit problems.

Abstract

GCG (Good Corporate Governance) is the most well-known principle in the world to maintain the integrity of the world's organizations. Almost all international location swithin all countries adhere for the basis to build responsibility and openness. Regrettably, in the application, GCG lacks explanation of stakeholder values. That study aims to reconstruct GCG (OECD version) and seek an extra agreeable idea of Sharia Concept. Surely this will provide a solution to the problem it self. After analyzing the value and character of SET, webuild a modern GCG positioned on Islamic concept. These concept ​​are; one; deeper sympathetic of the stakeholder steam, second; principles regarding the rights of stakeholders; third; equality regarding the behavior of stakeholders; fourth; openness principle; last; about corporate accountability. Weak GCG practices in Indonesia are caused by the low level of protection for investors, the class of lawmaintanance, the class of transparency and the ineffective audit committee of public companies. This condition strongly encourages the need for effective and efficient global corporate governance. Islamic Corporate Governance The Islamic perspective lies under the Islamic Corporate Theory which has greater concern for wider stakeholder swhich include God, humans and nature. Differences in goals between conventional Corporate Governance and Sharia GCG which tend to adopt Sharia Enterprise Theory (SET). SET equates material and spiritual values. This shows that GCG Syariah is not only toachieve material benefits, but also spiritual values. SET also equates egoistic values ​​with altruistic values, which in Islamic law are manifested in the form of worship.
