Abstract

Dalam Putusan Pengadilan Negeri Palembang Nomor 117/Pdt.G/2020/PN.PLG, Hakim kurang memberikan keadilan yang berimbang bagi bank mengingat sebagai kreditur telah mengalami kerugian akibat adanya tindakan wanprestasi dari debitur. Pembatalan akta perjanjian kredit juga memberi dampak bagi kinerja bank. Adapun bentuk perlindungan hukum bagi bank yang akta perjanjian kreditnya dibatalkan oleh Pengadilan adalah dengan menggunakan perlindungan hukum preventif dan perlindungan hukum represif, sebagaimana yang diatur dalam Pasal 1451 dan Pasal 1452 KUHPer.

Abstract

This article discusses how SOEs prepare themselves in an effort to deal with economic globalization over the demonopolization policy. Demonopolization is a policy undertaken by the government as a commitment to implementing free trade required WTO. Economic globalization is a condition that will not be able to be avoided, a sure step that must be taken by the government is to prepare for the resilience of the nation's economy through institutional strengthening strategies. One of them is by improving the performance of SOEs through policies that can create a synergy of effort and will be able to improve the quality to face competition globally. Create competitors to SOEs will be able to encourage SOEs to improve their institutions internally and externally, this condition is one of the strategies to create professional and independent SOEs, in order to face global challenges. Restructuring of SOEs by applying corporate culture and implement of concept good corporate governance is a strategy for internal institutional reform, internal institutional strengthening will have an impact on external institutional which will provide the best service for consumers and public. The Concept of SOEs performance must be based on the principles of economic democracy that promote fair efficiency for all economic actors, the main aim of providing protection for the people of Indonesia.

Abstract

Water is essential for all forms of life, and its importance is also emphasized in Islamic teachings. The quality of water that is not guaranteed can affect health or even the validity of worship. Base on the problem, the existence of water becomes important, especially in efforts to ensure the hygiene of water quality standards in order to provide security for its users. The existence of water requires guaranteed protection from supply to distribution. In fact, it is not governed by strict regulations that ensure legal certainty. This study aims to describe the level of urgency of legalizing water and sanitation quality standards in the form of higher and legally binding regulations. Empirical legal methods by taking primary and secondary data sources in conducting problem analysis. Observations and interviews were conducted to obtain primary data, while secondary data was obtained from legislative and conceptual approach are used to strengthen arguments in ensuring that the concepts offered remain in the correct legal corridor. The findings show the inconsistency of the government in recognizing the existence of water that is important for life but the implementation of systematic quality standard supervision, even the application of sanctions for violators cannot be carried out because the legal instrument is only limited to the regulations of the Minister of Health. The need to establish regulations in the form of Government Regulations on water quality standards and sanitation is a crucial consideration for safeguarding public health and well-being.

Abstract

Dalam praktek peradilan perdata di Indonesia, penerapan asas hakim pasif telah mengalami pergeseran berdasarkan beberapa putusan Mahkamah Agung. Tujuan penelitian ini adalah untuk mengetahui ruang lingkup asas hakim pasif dalam hukum acara perdata di Indonesia serta praktik penerapan asas hakim pasif di pengadilan Negeri Klas I A Palembang. Penelitian ini berlokasi di Pengadilan Negeri Klas I A Palembang dengan menggunakan jenis penelitian hukum secara sosiologis yaitu praktek yang mengkaji data sekunder dan data primer yang dibantu dengan penelitian wawancara. Analisis data yang digunakan adalah dengan cara analisis semua data yang bersifat tertulis dan hasil wawancara. Berdasarkan hasil penelitian dapat dikatakan bahwa ruang lingkup asas hakim pasif yang diatur dalam doktrin ilmu hukum dan Pasal 178 ayat (3) HIR dan Pasal 189 ayat (3) Rbg. Hakim dalam memeriksa perkara perdata bersikap pasif dimana luas pokok sengketa yang diajukan kepada hakim pada asasnya ditentukan oleh para pihak yang berperkara. Hakim tidak berhak menambah ataupun mengurangi kejadian materiil yang diajukan oleh penggugat dalam surat gugatannya sehingga hakim dalam menyusun pertimbangan suatu putusan perdata tidak boleh menyimpang dari posita gugatan, dasar gugatan dan dalil-dalil yang telah diajukan oleh para pihak kepadanya dalam pemeriksaan di persidangan dan untuk penerapan asas hakim pasif di Pengadilan Negeri Klas I A Palembang memang dikatakan tetap ada, namun untuk proses penerapannya masih terbilang belum sepenuhnya.
