Abstract

Perkara khamar dan zina di dalam al-qur’an telah dilarang secara jelas namun diungkap secara unik, bahkan keduanya dikategorikan sebagai dosa besar. namun terjadi distorsi persepsi pada masyarakat seakan-akan meminum khamar sesuatu yang biasa, berbeda dengan perbuatan zina yang sangat memalukan, kemudian seakan-akan hanya dosa kecil bagi peminum khamar sedangkan melakukan zina adalah dosa besar dan dimurkai Allah, padahal keduanya merupakan dosa besar. Penelitian ini adalah literatur review yang diungkap dengan kualitatif deskriptif, maka data primernya yaitu tulisan yang khusus membahas tentang kedua pelarangan tersebut. Hasilnya pelarangan khamar di dalam al-Qur’an secara unik dapat di jumpai pada empat ayat secara berangsur Kemudian pelarangan zina pada QS. Al-Isra/17:32. Keduanya telah dilarang namun seakan-akan perkara khamar disepelekan dibandingkan perkara zina, alasan distorsi persepsi tersebut ada empat hal yaitu pemahaman yang rendah, iman yang lemah, Budaya dan kebiasaan di tengah masyarakat dan dampak yang timbulkan terlihat perkara khamar mudaratnya kecil dan sesaat saja.

Abstract

Speaking of rights, of course we are talking about rights which are fundamentally inherent in human beings. Be it the right of life, the right of welfare, the right to justice, and the right of social security as embodied in the 1945 constitution. LGBT communities want the same thing, get the same rights, with principles of freedom and principles of equality. Not only does the LGBT community want legal protection against its freedom but also the legality of its existence in Indonesia. This article aims to learn the essence of human rights protection against LGBT (lesbian, gay, bisexual, and transgender) and its conversion to the existence of pancasila values and Islamic law, which is intended to find common points in both, is qualitative in the use of literature study methods (library research). As for the results of this study, LGBT basically has a right to cure abuses, not the claims of freedom to campaign, and to preserve existence in Indonesia. Certainly, one of its restriction reviews or ladsments is a consideration of religious morality that has always held a high regard for human dignity and dignity. There is also a value to maintain, there is a value embodied in the pancasila that gives the message, that every citizen must maintain a value and be irreparable.

Abstract

Mangrove forest protection requires not only effective state regulation but also the incorporation of religious values that strengthen environmental responsibility. From the perspective of Siyasah Syarʻiyyah, government policies aimed at promoting public welfare (maslahah), including environmental conservation, constitute an essential component of Sharia governance. This study analyzes the efforts of the Sinjai Regency Government to protect mangrove forests and examines the integration of Fiqh Biʻah into the existing legal protection framework from the perspective of Siyasah Syarʻiyyah. This study employed a qualitative case study approach. Primary data were collected through field observations, in-depth interviews, and documentation, while secondary data were obtained from statutory regulations, scholarly literature, and other relevant documents. The data were analyzed descriptively by integrating the perspectives of state law and Siyasah Syarʻiyyah. The findings reveal that the Sinjai Regency Government has implemented mangrove protection through legal regulations, the enforcement of administrative and criminal sanctions against environmental offenders, and the establishment of community-based environmental groups actively engaged in mangrove conservation. From the perspective of Fiqh Biʻah, these measures are consistent with Islamic principles that prohibit environmental destruction (fasad) and assign the state responsibility for safeguarding the public interest through environmental protection. The integration of state law and Islamic legal values has strengthened environmental governance while encouraging greater community participation in preserving mangrove ecosystems. Mangrove forest protection in Sinjai Regency demonstrates that integrating Fiqh Bīʻah into government environmental policies through the framework of Siyasah Syarʻiyyah contributes to a more effective and sustainable governance model by harmonizing state law with Islamic environmental ethics to achieve ecological sustainability and public welfare.
