Abstract

Adanya pinjaman online atau peer to peer lending sebagai salah satu bentuk financial technology (fintech) adalah imbas dari kemajuan teknologi yang banyak menawarkan pinjaman dengan syarat serta ketentuan yang lebih mudah dan fleksibel kalau dibandingkan dengan lembaga keuangan konvensional seperti bank.Di Indonesia pasar Fintech dalam bentuk pinjaman online dianggap cocok, bahkan penetrasi kepemilikan dan penggunaan telepon selularpun sangat tinggi meskipun masyarakat belum memiliki akses keuangan. Apalagi disaat kondisi ekonomi yang sulit akibat pandemi Covid-19 seperti ini ditambah lagi perilaku masyarakat digital yang konsumtif membuat pinjaman online menjadi solusi terbaik bagi mereka tanpa memikirkan dampak yang timbul dikemudian hari. Dampak permasalahan yang muncul bagi konsumen layanan pinjaman online salah satunya adalah saat penagihan pembayaran, mereka dibuat tidak nyaman, merasa diperas, diteror dan diintimidasi. Tindakan dari penyelenggara Pinjaman online ini diindikasikan bukan hanya melanggar hukum namun juga melanggar hak asasi manusia terutama pada Undang- Undang Nomor 39 tahun 1999 Tentang Hak Asasi Manusia Pasal 29 Ayat (1) dan Pasal 30. Dengan adanya Peraturan Otoritas Jasa Keuangan Nomor 77/POJK.01/2016 Tentang Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi, Undang-Undang Nomor 19 Tahun 2016 tentang perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik dan Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen (UU Perlindungan konsumen) masyarakat pengguna jasa / konsumen pinjaman online berharap ada perlindungan hukum dari pemerintah. yang rendah. oleh karena itu penulis berharap untuk pendidikan dan perbaikan dalam hal pemerintah.

Abstract

This paper explores the complex landscape of religious freedom in Russia and Indonesia, despite constitutional guarantees in both nations. In Russia, historical legacies and state control have led to restrictions on religious pluralism, particularly affecting minority faiths and dissenting voices. The Orthodox Church's influence and government policies often contradict formal protections, creating a paradoxical environment. Similarly, in Indonesia, despite its religious diversity, state regulations, societal norms, and religious identity intersect to challenge genuine religious freedom. Discrimination and persecution against religious minorities persist amidst political interests and cultural tensions. This discourse analyzes the underlying factors contributing to this paradoxical situation, emphasizing historical contexts, political dynamics, and socio-cultural complexities. It underscores the need for nuanced approaches beyond legal frameworks to address deeper societal attitudes and power structures. By reflecting on these cases, this discourse prompts broader discussions on global religious freedom, advocating for genuine respect for religious diversity as a fundamental aspect of democracy and human rights. Understanding the complexities in Russia and Indonesia illuminates the challenges and opportunities for advancing religious freedom globally.

Abstract

Rental flat was built to facilitate low income communities to obtain temporary housing. However, the implementation of the flats was not on target because people who were unfit to live in the Pekunden flats were not disciplined by the UPTD. The legal umbrella for condominiums is contained in Law no. 20 of 2011. Likewise, flats in Semarang City have rules for implementing flats which are regulated in Mayor Regulation No. 7 of 2009. The aim of this research is to identify and analyze the implementation of the rental extension of the Pekunden Rental flat Mayor Regulation of Semarang City No. 7 of 2009 and find out and analyze what repressive efforts there are regarding the problem of unavailability of housing for low income communities in the Pekunden flats.The results of the research carried out were that the Semarang City Government in carrying out the provision of flats did not implement Law no. 20 2011, in practice there are still well-off flat residents living in flats. The conclusion and suggestion from this research is that in implementing the flats, the Semarang City Government does not confirm the termination time for residents to settle. This problem causes the low income communities queue list for Pekunden flats to increase and they never get their rights, so it is necessary to implement implementing regulations regarding termination times and special qualifications for lease extensions by Disperkim or discretion by UPTD. Regarding this problem, repressive efforts must also be found to overcome it.

Abstract

The background of this research begins with the fact that modern society follows an exponential pattern of life, where society develops rapidly, leading to a gap between the new lifestyle and the laws that govern it. This is due to the static nature of law and its relatively slow process of reform and adaptation in comparison to the rapid development of society. Based on this problem background, the aim of this study is to analyze the theoretical review of sociological jurisprudence theory in the context of law and society in the era of digital globalization and to analyze and examine the role of legal theory in social life in the digital globalization era, from the perspective of law theory as a tool of social engineering. The research method used in this study is qualitative, with a conceptual, analytical, and philosophical approach. The findings of the research indicate that, given the VUCA (Volatile, Uncertain, Complex, and Ambiguous) characteristics of society, there is a need for the embodiment of law as social engineering in the process of change, and law as social control is also required as a means of controlling social engineering. The conclusion drawn from this study is that the theory of social engineering is ineffective if a country has characteristics with a positivist approach to law. Therefore, a country’s legal system must adopt a pluralistic approach to integrate aspects that go beyond just positive law.
