Abstract

Gunjingan tentang merosotnya kualitas sumber daya manusia di kalangan aparat penegak hukum sudah cukup lama. Harus dikatakan bahwa pendekatan profesional harus disertai dengan komitmen moral. Tulisan inji  melihat banyaknya missi yang dibawa oleh aparat adalah salah satu sebab yang membuat kalangan penegak hukum mengalami distorsi profesionalisme. Tulisan ini ingin menjelaskan bagaimana cara untuk memangkas dilema-dilema tersebut. Meski semuanya tetap bergantung kembali pada aparatnya.

Abstract

The right according to Islamic jurisprudence permit the limitation exclusive owner Isike copyright, but Islamic forbid it ifthat reason then group ofpeople 'let' the others in ignorance because oftheir poverty, so they are not be able to pay with high price for knowledge and discovery, whereas it iscrucial for him in abandoning their poverty and ignorance. In this case, the justice and social principles in implementing intellectual copyright have to be extended more.

Abstract

Besidesbeing  generally  bound  by  prudential  principles  in  banking  regulations,  Islamic  banking  in Indonesia is also bound by sharia principles. In reality, there are several contradictions between these two  jurisdictions  (conventional  banking  and  Islamic  banking).  This  article  aims  to  discuss  why  the contradictions between these two jurisdictions can occur. Furthermore, how the possibilities are to make harmony or adjustment among the various different elements, so that these two different jurisdictions can synergistically play a role in driving the development of Islamic banking in Indonesia. The research method in this article is normative legal research with a qualitative analysis model. The conclusion of this article showed that the set of regulations related to the prudential principle of banking in two banking models  (conventional  and  sharia)  in  fact  were  the  same.  It  was  because  this  regulation  related  to banking  prudential  was  originally  designed  for  conventional  banking,  and,  when  applied  to  Islamic banking, various adjustments were needed, for example in the collateral case. This article recommends that sharia-based prudential principles should be immediately integrated into the regulation of banking prudential principles in general to prevent any problems arose from the application of Islamic banking.

Abstract

The halal tourism industry is an emerging sector that has recently become a global trend in economic development in many countries. However, in various regions in Indonesia, halal tourism triggers anomalies and raises pros and cons. This article aims to explore the construction of halal tourism development in five regions in Indonesia. It seeks to formulate a sustainable halal tourism regulatory model that is based on plurality and local wisdoms of the local community. This study uses a legal research method, with a critical-constructive approach. The findings from this study conclude that the development of halal tourism regulations in various regions shows a positive and dynamic direction in line with the configuration of regional tourism policies, which needs to be continuously encouraged and accelerated. As such, amid these positive trends and dynamics, regional halal tourism development needs to adopt a sustainable halal tourism regulatory model that is based on community plurality and is responsive to local wisdoms. This article supports the realization of a sustainable halal tourism policy following the Covid-19 pandemic in the midst of a plurality of regional communities.

Abstract

The freedom of expression, of embracing any religion and beliefs as well, which are guarantied by many documents in human rights and constitutions in a lot of countries, including the Republic of Indonesia, finally must be considered as something which is not absolute in nature. The interpretation on the favor of such absoluteness will certainly carry the effects of the freedom and liberty of particultas person or group of people. Abstract

The cancellation of several words in the draft of  The State Establishment which is known as Jakarta Charter, i.e. the statement says on the obligation of every muslim  to act according the law of Sharia, made great disappointment among Moslems. This fact shows that the eager of Indonesian Muslims to implement their sharia law  is extremely huge. Therefore, during the process of constitution amendment in the refor mation era, there was strong tension among representatives whether this words must be attached or not. Even though the effort also failed to remove back the words in to Pancasila, there are still some chances for hospitalization of the implementation of sharia through the local autonomywhich are getting popular today.

The following article investigates disaster of earthquake from Islamic ethics point of  view. Disasteror earthquake constitute an active leaming that given by God by natural phenomenon in order to human introspect, human life in accordant with the urgent need of keeping universe, islam as a religion to give high motivation in order to answer the ultimate question and optimistic of life. Last but not least, it should be reconstruct religious ethical norms in term of human invironmental development. Happening disaster either as the God's involvment or the rasionality of natural phenomenon.
