Abstract

Information delivered by the medical professionals to the patients in their initial communication is crucial in establishing the therapeutic contract (transaction). Based on that information, the patient will decide whether to accept or to refuse the proposed medical treatment. This paper discusses the philosophical basis of the Informed Consent, Informed Refusal and the documentation of medical information into Medical Record. This normative legal research is carried out by library-based study on primary and secondary legal materials. Besides descriptive-analytical approach, the study also employs comparative approach. The comparison is made between continental legal system, common law system, and the Islamic legal system. It is found that philosophical basis of informed consent, informed refusal and documentation of medical information into medical record is basically to protect the patients’ dignity and to maintain their trust and cooperation. Furthermore, from the Islamic perspective the establishment of informed consent is to respect the privacy to blood, property, and family. In addition, the documentation of medical information into the medical record is to give legal protection in the form of strong evidence both for the health providers and health receivers in the event of a medical dispute.

Abstract

Cryptocurrency sebagai mata uang digital memiliki fungsi yang hampir sama dengan mata uang lainnya. Cryptocurrency dapat dipandang sebagai teknologi inovatif di bidang ekonomi yang sangat baik. Namun dalam penggunaannya sebagai alat investasi masih menjadi perdebatan karena minimnya aturan terhadap crytocurrency, bisa dijadikan alat pencuian uang serta penipuan dan riba. hanya beberapa Negara yang melegalkan transaksi menggunakan cryptocurrency. Pembahasan ini sangat penting karena berhubungan dengan halal dan haramnya terkait transaksi keuangan. Manfaat dari penelitian ini yaitu untuk mengimbau kepada pembaca agar berhati hati jika ingin menggunakan cryptocurrency sebagai alat transaki karena cryptocurrency sendiri bentuknya hanya berupa digital serta nilainya dapat berubah sewaktu-waktu. Tujuan dalam penelitian ini yaitu untuk mengetahui apakah cryptocurency dapat dijadikan alat transaksi keuangan di Indonesia menurut hukum Islam. Jenis penelitian ini merupakan penelitian hukum normatif yang meneliti bahan pustaka berupa bahan hukum primer, sekunder, dan tersier dengan pendekatan konseptual dan menggunakan teknik analisis preskriptif. Kesimpulannya adalah cryptocurrency tidak dapat dijadikan transaksi keuangan di Indonesia karena tidak memenuhi prinsip-prinsip keuangan syariah dan dilarang dalam Islam karena mengandung unsur gharar, riba, masyir dan tadlis.

Abstract

Adoption is one way of obtaining offspring for married couples who are not blessed with biological children. However, the adoption of this child raises questions in the field of inheritance according to Islamic law, whether the adopted child inherits property or not from his adoptive parents. This research is normative legal research using primary, secondary and tertiary legal materials. The research materials were analyzed descriptively qualitatively. The conclusion is that adopted children can be given inheritance rights by means of an obligatory will from their adoptive parents, a maximum of 1/3 of the available inheritance before being distributed to other heirs. This is in accordance with the provisions of Article 209 KHI
