Abstract

Penelitian ini menjelaskan tentang kajian kritis terhadap keluarga berencana (KB) dalam perspektif Imam Al-Ghazali. Metode yang digunakan dalam kajian ini menggunakan metode atau pendekatan kepustakaan (library research), bahwa studi pustaka atau kepustakaan dapat diartikan sebagai serangkaian kegiatan yang berkenaan dengan metode pengumpulan data pustaka, membaca dan mencatat serta mengolah bahan penelitian. Hasil penelitian ini menunjukkan bahwa Imam al-Gazali berpendapat bahwa Keluarga Berencana (KB) itu diperbolehkan. Hal ini dapat dilihat dari pendapatnya perihal hukum melakukan ‘azl, dalam menentukan hukum melakukan ‘azl, Imam al-Gazali cenderung kepada membolehkan ‘azl. Perihal hukum melakukan ‘azl. Dalam menentukan hukum melakukan ‘azl Imam al-Gazali cenderung kepada membolehkan ‘azl. Andaikata ‘azl tidak diperbolehkan pun tidak sampai pada taraf hukum haram, artinya ‘azl tidak dilarang namun makruh. Adapun hukum makruh ini adalah bermakna meninggalkan sesuatu yang lebih utama. Menurut imam al-Ghazali suatu hal tidak dapat dihukumi makruh dengan arti haram kecuali terdapat nash yang jelas-jelas mengatakan keharamannya sedangkan pada kasus ‘azl ini tidak terdapat nash yang secara tegas melarangnya.

Abstract

One of the functions of citizenship education is as legal education for students. It is felt that the function of citizenship education as legal education is not optimal. The aim of this research is to determine the role of learning civil law concepts to increase the meaningfulness of citizenship education. This research approach is a qualitative approach. Based on the research results, it shows that the function and aim of Citizenship Education is to open up the widest possible opportunities for citizens, to express their commitment and carry out an active role, to learn to mature themselves, especially regarding legal, moral and functional relationships between citizens and state organizational units and other public institutions. The figure of a good citizen that Citizenship Education aims to produce is an independent citizen who is not a burden on anyone, who involves himself in learning activities, understands the outline of history, ideals, and goals of the state, and is productive by contributing to advancing order, security, the economy and general welfare.

Abstract

The concept of authority plays a pivotal role in the context of civil law, particularly in delineating the powers and responsibilities vested in legal subjects through statutory provisions. This research explores the nuanced distinctions between "authority" and "competence," asserting that authority in civil law is a formal power granted by legislation, whereas competence refers to the scope and nature of the duties assigned. The study adopts a qualitative approach, utilizing descriptive analysis to investigate the legal foundations and implications of authority, particularly its attribution, delegation, and mandate in the legal system. The findings emphasize the complex interplay between state sovereignty and civil law, illustrating how authority functions within legal relationships and its relevance in ensuring accountability. This paper further examines how civil law governs the delegation of authority, its implications for legal subjects, and the underlying principles that guide such delegation. Ultimately, this research contributes to the broader discourse on authority in civil law, highlighting the essential role of legal frameworks in governing power delegation while maintaining legal order and justice.
