Abstract

The Covid-19 Pandemic has made the situation of society must change in order to maintain public health. The rules that have been in effect so far, the perpetrators of the criminal act will undergo an investigation by the police and the prosecutor's office before entering the trial process. During the trial process, the police searched for evidence of the suspect's actions until they got all the evidence. The police investigator submission the case to the prosecutor and carry out after the evidence is complete. With the covid-19 pandemic, covid 19 can be transmitted more easily by having close encounters with other suspects in detention centers. For health reasons, there is no transmission. It is necessary to reduce the number of people who enter detention centers. Moreover, for the time being, the Detention Center occupants have a number that exceeds the capacity, so that it is very prone to transmission. While the suspect must act as a deterrent to their actions. It is necessary to protect the human rights of the perpetrator. In the Indonesian legal system that has the principle of presumption of innocence provides legal certainty with the decision of the judge. So that the termination of the prosecution submitted by the prosecutor will make the public feel the legal certainty to be ruled out. This is a matter that wants to be examined to provide understanding for the public about the attorney general's regulation number 15 of 2020 on the termination of prosecution as restorative justice. The research method uses a normative approach by using research on the criminal procedure law, other implementing regulations, and reference books that support the protection of the criminal's human rights during the Covid-19 pandemic.

Abstract

The issuance of Law Number 5 of 1960 concerning Basic Agrarian Regulations or what can be called UUPA is aimed at the welfare and prosperity of the Indonesian people. This policy is a form of protecting the rights of the Indonesian people which regulates ownership of flats. In its development, land in Indonesia has also followed developments with the existence of flats, namely residential places with vertical floors on a horizontal plot of land and consisting of units that can be owned and used by each owner individually as regulated in Law Number 20 of the Year 2011 concerning Flats. The regulations regarding flat ownership have been regulated in Law Number 6 of 2023 concerning Stipulation of Government Regulations instead of Law Number 2 of 2022 concerning Job Creation. However, there is legal uncertainty regarding these two laws and regulations so appropriate efforts are needed to realize legal certainty regarding ownership of flats by foreign citizens (WNA). The type of research that will be carried out is normative juridical research that uses a library study model. This research uses a statutory regulation approach. The literature study carried out by the author is on related literature which shows that there is legal uncertainty regarding the regulation of flat ownership by foreigners. Due to legal uncertainty, an ideal policy is needed to protect the rights of Indonesian citizens (WNI).

Abstract

Indeed, corporations serve as the primary consumers of resources and the primary contributors to environmental damage. Indonesia incurs substantial economic losses as a consequence of environmental damage. Corruption frequently contributes to the deterioration of these conditions, resulting in fiscal ramifications for the government that are attributable to environmental damage. This study aims to examine the state financial losses incurred by states as a result of environmental damage. This is normative-jurisprudential research. This research shows that environmental damage ultimately results in a financial loss for the state and must be recouped by the violating corporation. The deterioration of this circumstance is frequently correlated with corruption, leading to financial losses for the government due to environmental damage. Therefore, a comprehensive legal framework is required to maximize the recovery of this damage. Enhancing regulatory transparency concerning the distribution of state funds and calculating losses will ensure the legal validity of efforts to enforce environmental legislation in response to corporate violations. Furthermore, environmental damage affects the populace's well-being, resulting in economic and health repercussions and reduced state revenue. To promote sustainability, the government must regulate financial impacts through education and a greater focus on MSME business lines.

Abstract

This research aimed to critically analyze regulations regarding the ownership status of flats in realizing legal certainty. The research method used is normative juridical research using a library study model. This research uses a legislative regulation strategy. The research results show that the concept of apartment ownership, which has been regulated in statutory regulations, has different rules. The UUPA firmly states that only Indonesian citizens (WNI) have rights to land with the status of Ownership Rights, Business Use Rights, and Building Use Rights. In contrast, the Job Creation Law states that foreigners are allowed to have ownership of Building Use Rights (HGB) without changing the right becomes the Right to Use. However, Building Use Rights (HGB) can only be owned by Indonesian citizens, and ownership can be given to foreigners who have a residence permit with the requirement of completing the house shape criteria that the government itself has regulated.

Abstract

The practice of coercively demanding a success fee by lawyers who promise victory to clients before a case is resolved raises serious legal and ethical concerns. This study aims to examine the legal implications of such actions and their relation to violations of the Code of Ethics for Advocates. The research employs a normative legal method with a qualitative juridical approach, using library research on primary and secondary legal materials. The findings indicate a shift in values within the legal profession from a socially driven service to a profit-oriented practice which reflects a degradation of lawyers' social responsibility in providing non-commercial legal assistance. A success fee is, in principle, a legitimate additional compensation if agreed upon professionally and paid after the case has concluded. However, promising a favorable outcome before resolution and using it as a means to demand payment constitutes a breach of ethical standards. The study concludes that lawyers who guarantee case outcomes and coercively demand success fees are in serious violation of professional ethics and may be subject to both ethical and legal sanctions. It is recommended that the advocate professional bodies reinforce ethical supervision mechanisms and provide continuous legal ethics training to prevent such practices.

Abstract

Penelitian ini membahas isu tentang penggunaan klausula eksonerasi dalam Perjanjian Pengikatan Jual Beli (PPJB) Rumah Susun dalam kaitannya dengan prinsip-prinsip perlindungan konsumen. Penelitian yang digunakan adalah penelitian yuridis normatif. Hasil penelitian dapat disimpulkan bahwa penggunaan klausula baku dalam PPJB dimungkinkan sejauh tidak bertentangan dengan Pasal 18 ayat (1) UU Perlindungan Konsumen dan tidak mencederai kehendak para pihak, sebab yang halal dan itikad baik. Konsumen yang merasa dirugikan memiliki hak untuk mengajukan pembatalan klausula baku yang telah dilarang oleh UU Perlindungan Konsumen. Dalam proses penyusunan perjanjian, konsumen juga perlu melakukan upaya-ypaya preventif dengan membaca isi perjanjian dan memproyeksikan resiko atau implikasi dari sahnya suatu perjanjian

Abstract

This study discusses how the effect of Current Ratio, Debt To Equity Ratio and Turnover on company performance and dividend distribution to shareholders and how the legal impact will be if the company is in bankruptcy. The research method taken by the author is to use the normative juridical method, which discusses research by collecting materials through literature studies. The findings of this study show that share ownership in a company affects how dividends are distributed, as reviewed from the Current Ratio, Debt To Equity Ratio and Turnover where the distribution of shares to shareholders has a positive impact. Article 57 paragraph (1) of the Law contains dividends which are the rights of shareholders. Thus, when the company goes bankrupt, shareholder dividends can also be calculated as a form of company debt. This is possible because the definition of debt in PKPU and the Bankruptcy Law follows the definition of debt in the Civil Code, namely debt in a broad sense with additional discussion about the consequences of corporate bankruptcy.

Abstract

Pelaku usaha dan konsumen merupakan komponen yang saling terkait dalam hubungan usaha. Pelaku usaha hotel dengan tamu hotel memiliki hak dan kewajiban masing-masing yang saling dijaga dan dipenuhi. Penelitian ini merumuskan isu-isu masalah yakni bagaimana pertanggungjawaban hukum jika terjadi kehilangan barang tamu serta bagaimana pertanggungjawaban hukum jika tamu hotel melakukan pencemaran nama baik hotel tersebut. Penelitian ini menggunakan penelitian yuridis normatif dengan menerapkan penelitian yang bersifat deskriptif. Data yang diambil berasal dari undang-undang maupun jurnal-jurnal ilmiah yang terkait dengan penelitian ini. Beberapa hasil penelitian ini ialah kehilangan barang yang dialami tamu hotel menjadi tanggung jawab pelaku usaha untuk melakukan ganti rugi sesuai dengan kerugian yang ditimbulkan. Barang hilang yang ada dalam lingkungan hotel sudah seharusnya menjadi tanggung jawab hotel. Tamu hotel juga harus berkewajiban membuktikan bahwa barang yang hilang benar-benar merupakan barangnya, sehingga tidak ada indikasi tamu hotel akan mengambil keuntungan. Hak-hak konsumen terpenuhi pada saat terjadi permasalahan kehilangan serta hak-hak pelaku usaha juga terpenuhi.

Abstract

Bankruptcy is a situation where there is a Bankruptcy Decision against the Debtor from the Commercial Court. In the management of a limited partnership or CV, there are active partners and passive partners, both of which have different responsibilities. Then, in terms of the rights owned by workers, namely wages or salaries, Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations explains that there are three (3) types of Creditors, namely Separatist Creditors, Preferred Creditors, and Concurrent Creditors. Then, this research uses a normative research method with primary and secondary legal materials and collects data using literature studies using the snowball method to search for legal materials. The aim of this research is to examine the responsibilities of CV management and the fate of workers related to CV being declared bankrupt. Thus, the results of this research are that there are differences in the responsibilities of CV administrators in the event that a CV is declared bankrupt by the court between CV administrators who are active partners and passive partners. In addition, there is legal protection for workers' rights in the event of bankruptcy, namely the right to fair wages.
