Abstract

AbstractThis paper explores the thoughts of Qasim Amin, an early 20th-century Islamic reformer, on gender justice in the context of polygamy, and its relevance to Islamic family law in Indonesia. Qasim Amin criticized polygamy not merely from a doctrinal perspective but by highlighting the moral and social injustices it often causes to women. He argued that justice is a fundamental principle in Islam and should serve as the primary criterion for evaluating religious practices, including polygamy. This study employs a qualitative approach through library research, analyzing Amin’s major works such as Tahrir al-Mar’ah and Al-Mar’ah al-Jadidah, and comparing them with the regulations stated in Indonesia’s Marriage Law and the Compilation of Islamic Law. The findings indicate that Amin’s ideas remain relevant for promoting a more just and socially responsive Islamic legal reform, particularly in advocating for women's rights within Muslim families. Keywords: Qasim Amin, Gender Justice, Polygamy, Islamic Family Law, Legal Reform. AbstrakTulisan ini membahas pemikiran Qasim Amin, seorang tokoh pembaru Islam awal abad ke-20, mengenai keadilan gender dalam praktik poligami, serta relevansinya terhadap hukum keluarga Islam di Indonesia. Qasim Amin mengkritik praktik poligami bukan dari sudut pandang doktrin semata, tetapi dengan menekankan aspek moral dan sosial yang berujung pada ketidakadilan terhadap perempuan. Ia berpandangan bahwa prinsip keadilan merupakan landasan utama dalam Islam dan harus dijadikan tolok ukur dalam menilai suatu praktik keagamaan, termasuk poligami. Studi ini menggunakan pendekatan kualitatif dengan metode studi pustaka, menganalisis karya-karya Qasim Amin seperti Tahrir al-Mar’ah dan Al-Mar’ah al-Jadidah, serta membandingkannya dengan peraturan dalam Undang-Undang Perkawinan dan Kompilasi Hukum Islam di Indonesia. Hasil penelitian menunjukkan bahwa pemikiran Qasim Amin relevan dalam mendorong reformasi hukum Islam yang lebih adil dan responsif terhadap kebutuhan serta perlindungan hak-hak perempuan. Kata Kunci: Qasim Amin, Keadilan Gender, Poligami, Hukum Keluarga Islam, Reformasi Hukum

Abstract

This article examines the views of Shaykh Abdul Halim Mahmud on the relationship between philosophy and Sufism in the context of ma‘rifatullah (knowledge of God). The purpose of this study is to demonstrate that philosophy and Sufism are not conflicting disciplines, but rather complementary paths toward the perfection of ma‘rifatullah. This research employs a qualitative approach using a literature review of the works of Shaykh Abdul Halim Mahmud and classical Islamic philosophical sources. The study finds that philosophy is understood as ḥikmah or rational effort to know God through the medium of reason, while Sufism pursues the path of taṣfiyah (purification of the soul) to attain a higher level of divine knowledge. Shaykh Abdul Halim Mahmud asserts that reason alone is insufficient to achieve perfect ma‘rifatullah without being complemented by inner purification. This view aligns with Plotinus’s concept of the stages of “finding God” through reasoning and “connecting with God” through spiritual purification, as well as the philosophical illustration found in Ibn Ṭufayl’s Hayy Ibn Yaqzan. The study concludes that the integration of philosophy and Sufism represents a comprehensive intellectual and spiritual approach to drawing closer to God and understanding reality in depth.
