Abstract

Child custody (Hadhanah) is a crucial issue in Islamic law, particularly when a mother with custody remarries. Differences in scholars' opinions and the varying decisions of religious courts in Indonesia highlight the need for an in-depth analysis through the perspective of maqashid syariah. This study aims to examine child custody for remarried mothers by emphasizing the protection of life (hifz an-nafs), lineage (hifz an-nasl), and child welfare. The research employs a qualitative approach using library research and comparative analysis of scholars' views and court rulings. The findings indicate that custody decisions should not solely rely on classical legal texts but must also consider the child's well-being. This study contributes by providing a more comprehensive understanding of child custody in Islam and offering recommendations for policymakers and legal practitioners to apply maqashid syariah principles in custody cases, ensuring decisions prioritize the best interests of the child.

Abstract

Divorce mediation in the Bangil Religious Court plays an important role in resolving domestic conflicts peacefully. This study explains the importance of mediation as an alternative to resolving disputes in court and highlights the challenges faced in the mediation process. The writing method used in this article is an in-depth literature review and analysis of mediation practices in the Bangil Religious Court. Data collection was carried out through observation, interviews and documentation related to divorce mediation practices in the Bangil Religious Court. This study covers various strategies applied by non-judge mediators, including religious, psychological, beautiful past, family, and mathematical logical approaches. This study shows that the success of divorce mediation is highly dependent on the mediator's ability to apply appropriate strategies, taking into account the cultural, psychological, and social contexts of the conflicting parties. This study makes an important contribution to the development of mediation practices in the religious court environment, especially in the context of divorce.

Abstract

Pendidikan agama memiliki peran yang sangat penting dalam memperkuat nilai-nilai keluarga menurut hukum Islam. Dalam konteks ini, pendidikan agama tidak hanya berfungsi sebagai sarana untuk memahami ajaran-ajaran Islam, tetapi juga sebagai fondasi untuk membangun karakter dan moral individu dalam lingkungan keluarga. Melalui pendidikan agama, anggota keluarga diajarkan tentang tanggung jawab, kasih sayang, dan saling menghormati satu sama lain. Hukum Islam memberikan pedoman yang jelas mengenai peran setiap anggota keluarga, termasuk hak dan kewajiban suami, istri, dan anak. Dengan demikian, pendidikan agama dapat menjadi alat untuk menanamkan nilai-nilai tersebut dalam kehidupan sehari-hari, sehingga menciptakan keluarga yang harmonis dan sejahtera. Penelitian ini bertujuan untuk mengeksplorasi bagaimana pendidikan agama dapat diintegrasikan ke dalam praktik kehidupan keluarga serta dampaknya terhadap penguatan nilai-nilai keluarga dalam perspektif hukum Islam
