Abstract

This research investigates the alignment of ‘urf with Islamic law in the context of the Pakake Anak Daro customary marriage among the Mandailing tribe in Singkuang Village. Adopting a mixed-method approach, the study explores the role of ‘urf within this marriage practice and its adaptation to modern times. Findings reveal that Pakake Anak Daro is a meaningful customary marriage rich in cultural values. It encompasses various processions, spanning pre-wedding, wedding, reception, and post-wedding stages, serving to strengthen cultural identity, foster social bonds, and express gratitude to Allah. The practice fulfills the ‘urf sahih (valid) criteria in Islamic law, embodying benefits, widespread acceptance, historical roots, and non-contradiction with Sharia principles. Pakake Anak Daro exemplifies the harmonious coexistence of local traditions and religious principles, contributing to Indonesia’s rich cultural tapestry. The study recommends collaboration among the Government, Religious Leaders, Customary Leaders, and Indigenous People to safeguard and promote this customary marriage as an integral part of Indonesia’s cultural heritage.

Abstract

Recently, a phenomenon has emerged involving the use of a mosque as a marriage dowry (mahar), which has sparked legal debates. This study aims to analyze the perspective of the Indonesian Ulema Council (Majelis Ulama Indonesia or MUI) of Medan City regarding the practice of giving a mosque as a mahar in marriage. The research employs a descriptive qualitative method with a normative and conceptual legal approach. Data were collected through interviews with representatives of MUI Medan and a literature review of Islamic legal texts and scholarly articles related to marriage and waqf. The findings indicate that MUI Medan rejects the validity of using a mosque as mahar because a mosque is considered waqf property, which has been removed from private ownership and therefore does not meet the Islamic legal requirements for a valid mahar—that it must be something that can be lawfully owned and transferred. Nevertheless, the marriage contract remains valid if all its pillars and conditions are fulfilled, but the invalid mahar must be replaced with a mahar mithil (a customary or appropriate dowry). This study recommends the issuance of an official and explicit fatwa by the MUI to prevent public misunderstanding and to serve as guidance for marriage officers and related parties in the practice of marriage.

Abstract

ABSTRACTIndonesia is a tropical country, this makes Indonesia rich in various plant species, including herbal plants such as lemongrass. Lemongrass with the Latin name Cymbopogon citratus thrives both in the highlands and lowlands. Lemongrass plants can be used in cooking spices, a mixture of essential oils and herbal drinks. There are still many people who use citronella conservatively, even though the use of lemongrass in a more modern way can provide more benefits and be able to reach a wider consumption market. Therefore, lemongrass processing innovation is needed in order to have high selling power, such as instant bandrek in powder form. This article aims to describe the manufacture of instant bandrek using lemongrass as the main herbal plant in Dalu Ten A Village, Tanjung Morawa. Keywords: Herbal Plants, Lemongrass, Instant Bandrek ABSTRAKIndonesia termasuk negara beriklim tropis, hal ini menjadikan Indonesia kaya akan aneka spesies tanaman tidak terkecuali tanaman herbal alam seperti serai. Serai dengan nama latin Cymbopogon citratus ini tumbuh subur baik pada dataran tinggi maupun rendah. Tanaman serai dapat digunakan dalam bumbu masakan, campuran essential oil maupun minuman herbal. Masih banyak masyarakat yang memanfaatkan serai wangi secara konservatif, padahal pemanfaatan serai secara lebih modern dapat memberi keuntungan lebih dan mampu menjangkau pasar konsumsi secara luas. Karena itu dibutuhkan inovasi pengolahan serai agar memiliki daya jual tinggi yaitu seperti bandrek instan dalam bentuk bubuk. Artikel ini bertujuan untuk mengemukakan pembuatan bandrek instan dengan memanfaatkan serai sebagai tanaman herbal utama di Desa Dalu Sepuluh A Tanjung Morawa.      Kata Kunci : Tanaman Herbal, Serai, Bandrek Instan
