Abstract

This study aims to analyze the impact of child marriage in Desa Falabisahaya from an Islamic law perspective. A qualitative field research method was employed. The findings indicate that underage marriages comply with the requirements and regulations of Islamic marriage and fulfill half of the functions of marriage, namely the biological function. However, underage marriage has more negative than positive impacts. For instance, the lack of mental preparedness among the couple often leads to disputes and jeopardizes marital harmony. Additionally, other negative impacts include health risks, school dropout, and the potential for divorce. Moreover, underage marriage falls short in terms of psychological aspects, maturity of thought, and financial readiness to build a household. Keywords: Child marriage, Islamic law

Abstract

The principle of Al-‘Adatu Muhakkamah is a fundamental concept in Islamic law that recognizes customary practices as a source of law, provided they do not contradict Sharia principles. This article examines the concept, legal foundation, and application of this principle in various fields, such as family law, muamalah, and siyasah. Using a literature review method, the findings reveal that this principle offers flexibility within Islamic law to accommodate local traditions, such as customary marriage practices and business transactions rooted in local customs, as long as they adhere to Sharia requirements. However, its application is not absolute, as it must consider the limitations imposed by Sharia principles, such as prohibiting practices inconsistent with Islamic values, such as political dowries. The study further highlights the need for renewed understanding and empirical research on this principle to address the challenges of modernization. In conclusion, Al-‘Adatu Muhakkamah serves as a vital guideline that ensures the relevance of Islamic law while preserving local traditions, provided both align with the overarching objectives of Sharia.

Abstract

This article aims to analyze how the Islamic epistemological approaches—bayani, burhani, and irfani—can be integrally employed to formulate a tolerant and inclusive Islamic education framework within multicultural societies without falling into value relativism. This qualitative study employs a literature review method, drawing from classical and contemporary works on Islamic epistemology and multicultural education. The findings reveal that bayani provides normative foundations through textual and revelatory sources; burhani fosters critical reasoning based on social reality; while irfani refines spiritual sensitivity and empathy. When integrated methodologically, these three approaches form a comprehensive Islamic educational model that is both value-based and open to dialogue. This integration avoids the pitfalls of epistemological extremism and ethical relativism. An Islamic education based on this integral epistemology offers a new paradigm for transformative, humanistic, and contextual pedagogy amid the complexity of global diversity.
