Abstract

This research journal discusses legal issues relating to the substitution of places made by the heirs who previously rejected the inheritance which falls to him by comparison of the perspectives of civil inheritance law and Islamic inheritance law. Pursuant to Article 848 and Article 1060 of the Civil Code on the replacement of the place by the heirs who reject the inheritance and the notary's role as a general official in providing legal certainty to prevent the issue of inheritance according to the law of civil inheritance and the Islamic inheritance law. The purpose of this research is to know and to analyze whether or not the heirs who have rejected inheritance replace other heirs as well as to know the role of notary in giving legal certainty to prevent problems in the civil inheritance law and Islamic inheritance law. The research method used by the writer is the statue approach and comparative approach. Heirs who reject inheritance under civil law of inheritance cannot change place (plaatsvervulling) because the requirement of replacement of place according to the law of civil inheritance is derived from families of blood in the same degree and not reject the inheritance. The replacement of places in Islamic inheritance law is known as mawali however, Islamic law does not recognize the denial of inheritance only known in the law of civil inheritance.

Abstract

This study aims to know and analyze which norms are enacted in the making of inheritance certificate and to know the strength of law in the certificate of inheritance made by Property and Heritage Agency after the enactment of Law No. 23 of 2006 on Population Administration. The research method used by the writer is statute approach and conceptual approach. The basis of the authority of Property and Heritage Agency is not in accordance with the state of the nation at this time and also based on the hierarchy of legislation is lower than the position of Law No. 23 of 2006. In addition, the certificate of inheritance made by the Property and Heritage Agency does not guarantee certainty and legal protection for Indonesian citizens because the strength of proof is not as perfect as the deed of inheritance made by the Notary.

Abstract

Penerapan e-government di Indonesia juga berdampak pada sistem perizinаn, pendaftaran maupun pembubaran suatu Badan Usaha di Indonesiа pun menjаdi berubаh yаng mаnа perubаhаn tersebut sаlаh sаtunyа mengenаi pendаftаrаn CV di Indonesiа. Perubаhаn yаng dimаksud adalah mekаnisme dаri Sistem Аdministrаsi Bаdаn Usаhа dalam Ditjen Adminstrasi Hukum Umum dаlаm melаyаni pendаftаrаn badan Usaha salah satunya adalah CV di Indonesiа yаng mаnа melаlui Sistem Аdministrаsi Bаdаn Usаhа sesuai dengan Permenkumham Nomor 17 Tahun 2018. Artikel ini bertujuan untuk mengаnаlisis kedudukаn Perаturаn Menteri Hukum dаn Hаk Аzаsi Mаnusiа Nomor 17 Tаhun 2018 tentаng Pendаftаrаn Persekutuаn Komаnditer, Persekutuаn Firma, dаn Persekutuаn Perdаtа terhаdаp Kitаb Undаng-Undаng Hukum Dаgаng sesuаi dengаn hierаrki Peraturan Perundаng-Undаngаn di Indonesiа , аkibаt hukum bаgi pendаftаr аtаu pemilik Persekutuan Komanditer yаng tidаk mendаftаrkаn Persekutuan Komanditer nyа pаdа Sistem Аdministrаsi Bаdаn Usаhа dаlаm jаngkа wаktu yаng telаh ditentukаn. Serta kepastian hukum pendaftaran Persekutuan Komanditer Melalui Sistem Administrasi Hukum Umum dikaitkan dengan Undang-Undang Informasi dan Transaksi Elektronik. Artikel ini termasuk penelitian hukum normatif dengan Pendekatan Perundang-Undangan Dan Pendekatan Konseptual serta menggunakanTeknik Analisis Data Dengan Logika Deduktif. Hasil Penelitian ini menunjukan bahwa ketentuan didalam Permenkumham Nomor 17 Tahun 2018 bertentangan dengan ketentuan didalam KUHD, menimbulkan beberapa akibat hukum bagi pelaku usaha yang tidak mendaftarkan Persekutuan Komanditernya pada Sistem Administrsi Badan Usaha, serta adanya keterkaitan antara Pendaftaran dalam Sistem Administrasi Badan Usaha dan UUITE yaitu adanya pengakuan secara tegas didalam UUITE terutama mengenai adanya tanda tangan elektronik didalam Surat Keterangan Terdaftar.

Abstract

Arrangements for the implementation and granting of the status of collaborating witnesses or known as Justice Collaborator Which invites the issue of pros and cons about the benefits and consequences that can be used as legal commodities, as well as subjectivity in the provision of its determination. To answer the question that has become public unrest, a comprehensive interpretation of the law is needed both grammatically, historically and juridically in order to obtain an understanding of whether the legal politics in the LPSK Law which regulates the Justice Collaborator has been in accordance with the objectives in terms of uncovering the main actors and restoring state losses related to the economy and development. Furthermore, to examine why the determination of Justice Collaborator on corruption crimes does not immediately realize a social justice as in paragraph IV of the Preamble to the Republic of Indonesia Constitution Th. 1945. It is very possible that the existing norms are incomplete, so they must be reconstructed by accommodating the principles of expediency and justice while still having a progressive nature of law enforcement in order to create ideal norms.

Abstract

Corruption has become a serious problem that harms state finances and hampers development. The purpose of this study is to examine the provisions of Article 20 paragraph (7) jo. Article 18 paragraph (1) of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption. This research uses several approaches including a statutory approach and a case approach. The results showed that the regulation regarding the sanction of returning state financial losses in corruption cases by corporations is still sectorally scattered, starting from Law Number 8 of 1981 concerning Criminal Procedure, Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption, Circular Letter of the Attorney General of the Republic of Indonesia Number B-036/A/Ft.1/06/2009 regarding Corporations as Suspects / Defendants in Corruption Crimes, Regulation of the Attorney General of the Republic of Indonesia No. 028/A/JA/10/10/2009 concerning Corporations as Suspects / Defendants in Corruption Crimes: Per- 028/A/JA/10/2014 on Guidelines for Handling Criminal Cases with Corporate Legal Subjects, Supreme Court Regulation No. 13/2016 on Procedures for Handling Criminal Cases by Corporations.
