Abstract

Status of children out of wedlock in Indonesia, which is currently associated with many (having a civil relationship) other than with mother but also with her father. Problems in this article, namely: Constitutional Court Decision Number 46 / PUU / VII / 2010 and, how the rights and obligations of children outside of Marriage before and after the Decision of the Constitutional Court Number 46 / PUU-VIII / 2010. Because in the Malang District Religious Court there are many civil cases as described in the Case statistics. The method of approach used in this study is the research of qualitative description and legal sociology (legal research, rechtsonderzoek) and libre researce. Qualitatively analyzed, namely from primary data from interviews and secondary theories. The results of the study show that the perceptions of the judges of Malang Regency religious court in the case of children out of wedlock can get their rights by considering aspects of justice and the child's needs.

Abstract

Globalisasi perekonomian dewasa ini telah melahirkan berbagai kejadian baru dalam perkembangan ekonomi dunia yaitu terjadinya era pasar bebas Internasional, interdepedensi sistem baik dalam bidang politik maupun bidang ekonomi, lahirnya berbagai lembaga ekonomi Internasional, pengelompokkan negara dalam kawasan ekonomi regional, maju pesatnya pelaku ekonomi Trans Nasional Corperation, lahirnya Military Industrial Complek dan sebagainya. Hal ini tidak dapat dilaksanakan dalam kevakuman hukum dan kaedah-kaedah hukum sangat diperlakukan untuk mengatur mekanisme hubungan agar tidak menjadi konflik kepentingan dalam pembangunan ekonomi suatu bangsa. Seandainya konflik betul-betul terjadi, maka pranata hukumlah yang dapat dipergunakan sebagai alat untuk menyelesaikannya. Tulisan ini bertujuan untuk mengungkap peran atau kontribusi Hukum terhadap perkembangan perekonomian khususnya di Indonesia. Penelitian ini merupakan penelitian kualitatif yang menggunakan dokumentasi dan studi literatur sebagai metode pengumpulan data. Penelitian ini menarik kesimpulan kontribusi hukum terhadap perkembangan perekonomian nasional di Indonesia sangat berpengaruh dalam fungsinya sebagai pembatas dalam segala kegiatan perekonomian agar kegitan perekonomian berjalan sesuai koridor dan batasan-batasan tertentu, demi terciptanya perekonomian yang adil dan merata.

Abstract

In today's modern economy era, the role of banking institutions is very important. In Indonesia the role of banking institutions is so increasing that it reaches about 99% of the national financial system. Given such an important role of the institution, it should be supported by a strong and strong, credible (reliable) legal and regulatory tool. Strong, strong and credible in the sense of their contents-the articles are not contradictory to each other, are not often revised / amended, neither misinterpreted and applicable. The Law Regulating Banking Law No. 7 of 1992 was amended by Act No. 10 of 1998 on Banking, Act No.23 of 1999 which amended by Act No. 3 of 2004 and Act No. 6 of 2009 on Bank Indonesia, Law Number 21 of 2008 concerning Sharia Banking (July 16, 2008); Law No. 21 of 2011 on the Financial Services Authority. This paper draws the conclusion that it is necessary to amend the law regulating of OJK, considering that OJK as the sole overseeing agency and investigator of economic activity in Indonesia, needs other institution to guard the developmnet of national banking in order to be health, grow fairly and support national economic development continuous.
