Abstract

Abstrak –Tujuan Akademis penulisan ini sebagai suatu syarat untuk kelulusan dan mendapatkan gelar Sarjana Hukum di Fakultas Hukum Universitas Surabaya. Tujuan praktis penulisan adalah untuk meninjau kasus Invasi Amerika Serikat ke Negara Iraq dari Konvensi Jenewa ke IV tahun 1949 tentang Perlindungan Korban Sipil di masa perang dan Konvensi Den Haag Tahun 1907 Tentang Hukum dan Kebiasaan Perang di Darat, beserta Protokol tambahan I dan II Konvensi Jenewa tertanggal 12 Agustus 1949. Ruang lingkup dalam tulisan ini adalah pembahasan perang dalam perspektif penyelenggaraan perang melalui Kriteria jus ad bellum dan jus in bello. Kata Kunci: Invasi Amerika Serikat ke Iraq, Perlindungan Korban Sipil, Hukum Humaniter Internasional, Pertanggungjawaban Negara Abstract–The Academic Purpose of this writing is a requirement for graduation in achieving the Law Degree at the Faculty Law of University of Surabaya. The Practical Purpose of this writing is to review the case of the United States invasion of Iraq of the Geneva Convention IV of 1949 on the Protection of Civilian war victims in wartime, and The Hague Convention 1907 on the Laws and Customs of War on Land, and Additional protocols I and II of the Geneva Conventions of August 12, 194. Scope of this paper is a discussion of the war in the conduct of the war through the perspective of the criteria Jus ad bellum and Jus in bello.
