Abstract

This paper discusses women who are considered incomplete as humans, inferiorly, may only play a role in the domestic (household) room. So the researches focused on discussing women, Islam, and farmers in Dusun Kelambi, Desa Pandan Indah, Kabupaten Praya Barat Daya, Kabupaten Lombok Tengah to test these assumptions. The aim is to answer the urgency of women farmers involved in public activities and the role of farmworkers in Dusun Kelambi, Desa Pandan Indah. This research is included in the cluster of qualitative research by involving the library research approach and fieldwork, answering the question in the perspective of the maqasid syari’ah. The result showed that farmer women in Dusun Kelambi did farm work based on equity and necessity considerations, including family food security (hifz al-nafs wa al-mal), continuing their children’s schooling (hifz al’aql wa nasl), and of course the entire population is Muslim (hifz al-din).

Abstract

Penelitian ini menjelaskan pergumulan mengenai nikah dari sudut sejarah, dalil al-Quran dan Hadits (Firman dan Sabda), sampai pada nalar para Ulama Islam. Nikah mutah ialah sebuah ikatan pernikahan antara laki-laki dan perempuan untuk waktu tertentu dengan mahar dan kesepakatan lain yang disebut dalam akad. Nikah mutah tidak mempunyai tahapan atau proses cerai, dengan makna lain bahwa nikah mutah menyesuaikan tempo yang disepakati bersama dengan sendirinya hubungan berakhir sesuai kesepakatan akad. Maka penting bagi peneliti untuk mengangkat pergumulan ini tanpa harus menjustifikasi sesuai dengan kepentingan tertentu. Karena perlu disadari bahwa nikah mutah hingga dewasa ini, selalu menjadi primadona dalam pergumulan fikih dan madhzab. Peneliti menggunakan studi kepustakaan (library research) dengan menganalisisnya dari sudut kesejarahan dan dalil-dalil yang membicarakan tentang nikah mutah. Hasil kesimpulannya bahwa Nikah mutah pernah di izinkan dua kali dan diharamkan dua kali oleh Rasulullah Saw, Ibn Asyur berpendapat bahwa nikah mutah bukanlah pembatalan atau pengharaman melainkan menyesuaikan kondisi-kebutuhan mendesak atau darurat. Buktinya di masa khalifah Abu Bakar dan khalifah Umar Ibn Khattab masih ada praktiknya, namun khalifah kedua (Umar ibn Khattab) akhirnya mengharamkannya untuk selamanya dimasa-masa akhir jabatannya.

Abstract

 Abstract: This paper explains the struggle for political space between Islamism and Islamic groups in the 2019 Presidential Election. The origin of the struggle for political space is closely related to the early history of Indonesian independence. The author considers that historical events are something important to analyze the 2019 Presidential Election issues. This study is a qualitative study using library data through descriptive analysis. The data analysis phase includes data reduction, data presentation, and drawing conclusions. The author uses the triadic concept approach to spatial practise, representations of space, and representational spaces as a theoretical framework for analysis. The discussion of this article results in the conclusion that the “failure of political Islam” in the 2019 Presidential Election cannot be enforced. The 2019 presidential election showed that the struggle for political space was dominated by the Islamism group supporting Prabowo-Sandi and the Islamic group supporting Jokowi-Ma'ruf. Other explanations reveal that the debate and struggle over the political space of the Indonesian State is the impact of the historical cycle of independence. In the context of democracy, the political struggle over space is permissible, but every dynamic of the struggle over political space must be constitutional.الملخص: ستشرح هذه المقالة النضال من أجل الفضاء السياسي بين الإسلامية والجماعات الإسلامية في الانتخابات الرئاسية لعام 2019. يرتبط أصل النضال من أجل الفضاء السياسي ارتباطًا وثيقًا بالتاريخ المبكر لاستقلال إندونيسيا. يرى المؤلف أن الأحداث التاريخية هي شيء مهم لتحليل قضايا الانتخابات الرئاسية لعام 2019. هذه الورقة عبارة عن دراسة نوعية باستخدام بيانات المكتبة من خلال التحليل الوصفي. تتضمن مرحلة تحليل البيانات تقليل البيانات وعرض البيانات واستخلاص النتائج. يستخدم المؤلف نهج المفهوم الثلاثي للممارسة المكانية ، وتمثيل الفضاء ، والمساحات التمثيلية كإطار نظري للتحليل. تؤدي مناقشة هذه المقالة إلى نتيجة مفادها أنه لا يمكن تنفيذ "فشل الإسلام السياسي" في الانتخابات الرئاسية لعام 2019. أظهرت الانتخابات الرئاسية لعام 2019 أن النضال من أجل الفضاء السياسي سيطرت عليه الجماعة الإسلامية التي تدعم برابوو ساندي والجماعة الإسلامية التي تدعم جوكووي معروف. وتوضح تفسيرات أخرى أن الجدل والصراع حول الفضاء السياسي للدولة الإندونيسية هو تأثير دورة الاستقلال التاريخية. في سياق الديمقراطية ، يُسمح بالنضال السياسي على الفضاء ، لكن كل ديناميكية النضال على الفضاء السياسي يجب أن تكون دستورية.
