Abstract

The authority to reviewing Perppu can not be obtained based on the interpretation of an institution or the situation that demanded the interpretation of a norm in the community, but must be strictly regulated in the constitution to the institution where authority was given, therefore there is no ‘juridical’ chaos in it.

Abstract

Constitutionally, the issuance of Government Regulation in Lieu of Law is the subjective right of the President based on the state of exigencies, but its formation should alway fulfill good, proportional and prudent principles of lawmaking. Eventhough the objective of  issuing  the  Government  Regulation  in  Lieu  of  Law on Constitutional Court is to restore public trust and credibility of Constitutional Court Justices, the content of the regulation may not be contradictional with the 1945 Constitution of the Republic of Indonesia. In order that there is no distortion  in the use of subjective right of the President in issuing the regulation, the House of Representatives must objectively scrutinize whether the regulation is reasonable to be promulgated as a law ar must be denied.

Abstract

Political parties have the authority to recall the members of parliament, even make his party membership revoked if a member violates the party’s policy. This is because the nomination of members of parliament nominated by political parties. However, the Constitutional Court decision has changed the mechanism of the serial number be a majority vote in determining who sits in parliament. Partai politik memiliki wewenang untuk me-recall anggotanya dari parlemen, bahkan mencabut keanggotaan seseorang dari partainya apabila anggota tersebut melanggar kebijakan partai. Hal ini dikarenakan pencalonan anggota parlemen diusulkan oleh partai politik. Namun, putusan Mahkamah Konstitusi telah mengubah mekanisme nomor urut menjadi suara terbanyak dalam menentukan siapa yang duduk di parlemen.

Abstract

Penelitian ini bertujuan mengkaji relasi antara pemilih, wakil rakyat dan partai politik dalam membangun demokrasi, serta mengajukan konsep pengawasan pemilih terhadap wakil rakyat dalam membangun demokrasi. Penelitian ini merupakan penelitian normatif, dengan objek penelitian relasi pemilih, wakil rakyat dan partai politik dalam membangun demokrasi. Metode pendekatan yang digunakan sosiopolitik, kasus, dan konseptual. Analisis bahan hukumnya diskriptif kualitatif. Hasil penelitian menyimpulkan, pertama, wakil rakyat mendapatkan daulat dari rakyat, maka secara substantif aspirasi rakyat dapat dikatakan tersalur apabila kepentingan nilai, aspirasi, dan pendapat rakyat yang diwakili benar-benar telah diperjuangkan dan berhasil menjadi bagian dari kebijakan yang ditetapkan oleh lembaga perwakilan rakyat yang bersangkutan, atau setidaknya aspirasi mereka sudah benar-benar diperjuangkan sehingga memengaruhi perumusan kebijakan yang ditetapkan oleh parlemen. Kedua, konsep pengawasan rakyat /konstituen terhadap wakil rakyat atau anggota lembaga perwakilan rakyat itu dapat dilakukan antara lain melalui pemilihan umum dan sistem ‘recalling’ anggota parlemen oleh rakyat/konstituen.

Abstract

This study aims to analyze President’s prerogatif rights in election of the head of Nusantara Capital City Authority and the implication to the head of Nusantara Capital City Authority’s position and authority. This study contain two research problem formulation: Is the election of the head of Nusantara Capital City Authority using President’s prerogative right? What the implication to the head of Nusantara Capital City Authority’s position and authority? This is a normative judicial research. Legal materials used in this study collected by literature review and document review method, and written descriptively. This study used qualitative-descriptive method conducted using legislation approach. This study concluded the election of the head of Nusantara Capital City Authority is a President’s prerogative right. Second, it’s in equal position with the minister. The authority came from Government Regulations and President Regulations, Nusantara Capital City Authority have no autonomous authority. This study offers to return “after having a consult” into “with approval” or “with consideration”. It’s better to separate the preparation and translocation institution, and regional administrators institution to carry out autonomous authority well and return last government model and giving special authority as a special area of ​​the capital, also bringing back Regional Legislative Council.
