Abstract

Particular problem in judicial review frequently found is there a contradiction between the subsidiary legislation and the constitution. Unfortunately, in several Supreme Court verdict on judicial review, there is no usage of constitutional interpretation on their legal reasoning. However within domain of Supreme Court authority, constitution is not the touchstone, but constitution perspective must be included to maintain consistency of legislation hierarchy. There are two reasons on that posibilities, first the approximation of constitutional review by the court and second, the consequences of Indonesian’s legal system that implementing legislation hierarchy. Responsibility as the guardian of constitution not only applied on Constitutional Court, but on all the state institutions including every citizen. In the context of guarding consistency of legislation hierarchy, Supreme Court might also develop constitutional interpretation in order to ensure conformity regulations that is examined to the constitution. In addition, meaning of the constitution can be developed by a judge that can be found in accordance with contextuality. The perspective is assessed to highlight more detailed the mapping of the use of constitutional interpretation on Judicial Review in supreme court post amandment of Constitution of Republic Indonesia 1945. This article formulatesthe notion of constitutional interpretation on Judicial Review. Within this concept, will be prepared by the use of mapping of constitutional interpretation on Judicial Review in supreme court post amandment of Constitution of Republic Indonesia 1945. Thus this research was intended to make the judge use constitutional interpretation. Of course if the recommendations are applied, it can be achieved not instantly in a short time. With the use of Constitutional interpretation on Judicial review in supreme court, the constitutionallity can be reflected later on legislation hierarchy as a whole legal system.

Abstract

AbstractThis article aims to assert that some regulatory mechanisms, such as the appointment of members of and the voting for decision in both Indonesia Peoples Deliberative Assembly (MPR) and village flows in a formalizing pattern from the top governmental body of the central, to the regional, and to the ends at the boom level, the village. This also applies the procedural aspects of the democratic system where the organizational body is made as formal, uniform, and permanent in structure (despite the periods). This somehow seems contradictory with the noon of deliberative democracy (demorasi permusyawaratan) once upheld by the founding fathers of Indonesia. However, the vague understanding surrounding the noon of deliberative democracy necessitates a closer study for a more comprehensive overview, which should also be conducted for beer comprehension on the concept of democracy adopted by the MPR. This article serves only as a preliminary study to prelude a more in-depth study. The derivation of legal policy in this article has the purpose of identifying the political direction towards which the village democracy was taken. This article highlights a paradigmatic shift in the legal policy change of the democratic pattern from the village to the MPR, then later from the MPR to the village.Arus Balik Polik Hukum Gagasan Demokrasi Permusyawaratan dari Majelis Permusyawaratan Rakyat ke Pemerintahan Desa (Suatu Kajian Awal)AbstrakPada tulisan ini hendak dikemukakan pengaturan, misalnya mengenai pengambilan keanggotaan dan putusan, serta kelembagaan desa, menamakan pola imitasi dari kelembagaan di pusat, daerah, maupun desa begitu pula mengenai tata cara kehiduan berdemokrasi dari kelembagaan demokrasi, badan representasinya dibuat secara formal, seragam, dan permanen walaupun terdapat periodisasi. Hal ini tampak kontradif dengan konsep demorasi permusyawaratan yang diusung oleh para founding fathers ketika Indonesia berdiri. Namun demikian, pemahaman mengenai demokrasi permusyawaratan itu sendiri masih harus digali agar lebih tergambar secara komrehensif begitu pula mengenai konsep berdemokrasi dalam kelembagaan. Tulisan ini merupakan kajian awal sebagai pengantar untuk kajian yang lebih mendalam. Alasan hal ini ditarik sebagai sebuah politik hukum adalah untuk melihat apabila terdapat desain arah kebijakan terhadap entitas desa untuk dapat melaksanakan kehiduan demokrasi. Abstract

Indonesian legal system determines that the Local Representatives Body, known as the DPRD has the functions to establishing, supervising the execution of local affairs and budgeting. Those functions provides the rights to the DPRD both collectively and individually. However, there are also legal obligations applied only for individual. The problem is those three functions has not been embodied properly in the elaborated duties of the Representatives Body. It can be seen, that inspite of the collectivity, a number of duties are also inherent to the member of DPRD individually. Yet, the existing provisions have lack of support for the member of DPRD to increase their competence in order to strengthen those functions. In this paper, the author try to identify some models of individual accountability where there is a practical references applied in the three-municipalities, which are city council of Liverpool, Vancouver and Shah Alam. Considered as identification due to that there are no similarity certainty for all the mentioned places. Eventually, once the pattern of accountability has been found, it becomes the raw material of recommendation on revision of the Local Government Act.ABSTRAKPeraturan perundang-undangan memberikan fungsi pembentukan peraturan daerah, fungsi pengawasan, dan fungsi anggaran, kepada DPRD Provinsi dan DPRD Kabupaten/Kota. Ketiga fungsi tersebut memunculkan hak-hak secara kelembagaan maupun secara individu. Namun masih terjadi kesenjangan, yaitu ketiga fungsi secara kolektif dan kolegial tersebut belum diperkuat dengan ketentuan kewajiban yang tepat. Unsur kewajiban hanya dilekatkan kepada individu anggota, karena yang merepresentasikan rakyat pemilih adalah individu dan bukan kolektif. Meskipun demikian, ketentuan yang ada tidak dapat menjadikan anggota DPRD untuk meningkatkan kompetensinya supaya dapat memperkuat ketiga fungsi tersebut. Penelitian ini ingin mencari bagaimana rumusan model akuntabilitas anggota DPRD secara individu. Untuk memperoleh konsep tersebut, dilakukan perbandingan hukum mengenai praktik yang diterapkan di berbagai tempat sebagai cara memastikan fungsi-fungsi semacam city council terlaksana. Penelitian ini juga ingin menunjukkan bahwa upaya-upaya tersebut dapat diidentifikasi sebagai model akuntabilitas terhadap para councilor. Oleh karena itu, tujuan yang dikehendaki dari penelitian ini adalah terbangun konsep akuntabilitas anggota DPRD di Indonesia. Untuk mencapai tujuan tersebut dilakukan pendekatan komparatif di Liverpool, Vancouver, dan Shah Alam. Adapun rekomendasi dalam penelitian ini berupa bahan perumusan ketentuan dalam suatu perubahan Undang-Undang Pemerintahan Daerah.

Abstract

The character of the current local government in Indonesia is moving forward to re-centralisation instead of decentralisation. Meanwhile, some comparative studies on models of local governments are catching eyes as they attempt to systemise a classification. This paper aims to describe a legal doctrinal assessment of the model of local government in Indonesia. It also gives some options for a separate comparative study, if it needs an ‘apple to apple’ or an inspiring object of study, to achieve the purposes of comparison for better legislation constituting local government in Indonesia. In doing so, the previous studies on global models of local government are examined to assess the current Indonesian legislations, covering the nature of the legal entity, source of authority and financial, organisation, and the extent in making the decision. This study points that the recent model of local government in Indonesia is a hybrid system, which implies close to Franco rather than the Anglo model, with certain specifications. However, the 1945 Constitution contains some future and global values without disregarding the root of local government function in the community. Therefore, the study considers the normative model of local government in Indonesia inconsistent with the legal policy in the 1945 Constitution. It is then considerable if an amendment of the local government Act is an option to re-modify the model of local government, which can reflect the ideas in the Constitution and is not left behind the global trends. Abstrak: Karakter Pemerintahan Daerah yang Nampak hari ini di Indonesia lebih mengarah pada re-sentralisasi daripada desentralisasi. Sementara itu, beberapa kajian perbandingan mengenai model-model pemerintahan daerah cukup menarik untuk dapat dilihat bagaimana untuk mengklasifikasi suatu sistematisasi. Dalam tulisan ini hendak dipaparkan sudut pandang yuridis-normatif terhadap model Pemerintahan Daerah di Indonesia. Termasuk di dalamnya terdapat suatu pilihan untuk studi perbandingan, apakah dibutuhkan syarat suatu kesetaraan atau syarat suatu objek kajian yang dapat mengispirasi, untuk mencapai tujuan perbandingan yaitu penyempurnaan suatu hukum yang mengatur Pemerintahan Daerah di Indonesia. Untuk itu, kajian-kajian terdahulu mengenai model-model Pemerintahan Daerah secara global telah ditelaah berikutnya sebagai bahan untuk dapat mencermati peraturan perundang-undangan di Indonesia, yang meliputi makna entitas hukumnya, sumber kewenangan dan keuangan, kelembagaan dan sejauh mana untuk menentukan keputusan. Ditemukan bahwa model Pemerintahan Daerah di Indonesa merupakan system hybrid, yang lebih mendekati model Franco dibandingkan dengan model Anglo beserta spesifikasi di dalamnya. Bagaimanapun, Undang-Undang Dasar 1945 berisi nilai-nilai masa depan dan global tanpa mengesampingkan akar dari fungsi Pemerintahan Daerah di masyarakat. Dengan patokan seperti itu, model normatif Pemerintahan Daerah di Indonesia tidak sejalan dengan dengan gagasan dalam UUD 1945. Maka dari itu, suatu perubahan terhadap Undang-Undang Pemerintahan Daerah dipandang sebagai suatu upaya yang dapat dipertimbangkan untuk re-modifikasi model Pemerintahan Daeeah dapat mencerminkan gagasan dalam Konstitusi tanpa tertinggal oleh kecenderungan global. Abstract

Dorongan untuk mengimplementasikan konsep the right of option ke dalam hukum kewarganegaraan nasional semakin nyata. Hal ini dikarenakan perempuan yang berada dalam pernikahan campuran masih berada dalam posisi yang lemah untuk mempertahankan kewarganegaraannya. Padahal, kerugian telah terjadi, seperti hilangnya hak atas properti. Dengan menggunakan metode yuridis normatif dan pendekatan perbandingan hukum, penelitian ini berkesimpulan bahwa perlu adanya pembenahan dalam UU Kewarganegaraan Indonesia untuk segera mengadopsi the right of option secara penuh dengan beberapa elemen yang patut untuk dipertimbangkan.
