Abstract

Abstract The practice of applying a Notary honorarium that is not in accordance with Law Number 2 of  2014 concerning Amendments to Law Number 30 of 2004 concerning Notary Position, that a Notary has set a tariff below the standard. This study uses empirical normative methods, literature studies and case approaches. The results of the sutdy show that the practice of applying Notary honorariums tha are not in accordance with Law Number 2 of 2014 concerning Amendments to Law Number 2004 concerning Notary Position, in practice that Notaries have violated the provisions of Article 13 Paragraph (3), Article 4 Paragraph (9), and Article 4 Paragraph (10) Notary Code of Ethics, and sanctions that can be imposed on Notaries who do not apply honorarium according to Law Number 2 Year 2014 concerning Amendments to Law Number 30 Year 2004 concerning Notary Position stipulated in Article 6 Notary Code of Ethics.Keywords: Notary, Honorarium, Notary Supervisory Board

Abstract

Abstract:The main problem in this study is the analysis of the protection of well-known brands, especially in the element of equality that basically applies to non-similar goods. In addition to analyzing the consideration of judges Number 29 PK / Pdt.Sus-HKI / 2016 which contains trademark disputes between BMW brands and BMW Body Man Wear. The research method uses a normative juridical approach. The results showed that the element of equality in principle applies to goods of different types because it is a principal element that exists in the legal order of the brand associated with the distinguishing power element that exists in a brand. The panel of judges in deciding this case considers SEMA Number 3 / BUA.6 / HS / SP / XII / 2015 which states that all cases of filing claims for cancellation of brands that have similarities in principle in non-similar goods, the lawsuit must be declared with amar 'is not acceptable 'because the Government Regulation mandated by Law Number 15 Year 2001 Concerning Trademarks has not yet been enacted.Keywords: Trademark Protection, Elemental Equality Principals, Decision Analysis

Abstract

The existence of Law Number 26 of 2007 concerning spatial planning is a shared hope, both for the local government and the community in East Jakarta Municipality. Urban problems arise due to unclear urban spatial planning, as well as inconsistencies in environmental management. The purpose of this study is to explain the importance of managing urban spatial planning as a strategy for designing and developing environmentally friendly areas in East Jakarta Municipality based on Law Number 26 of 2007 concerning Spatial Planning. The research method used is qualitative with a normative and empirical juridical approach. The results of the study found that one of the benchmarks for the application of the Green City concept is the existence of Green Open Space (RTH) in urban areas. Green Open Space in a city must meet a minimum area of 30% of the total land area, with a composition of 20% public green open space and 10% private green open space (Law No. 26 of 2007).

Abstract

Jurnal ini bertujuan untuk menganalisis rekontruksi penyelesaian sengketa kepemilikan tanah yang bersertifikat ganda sesuia dengan study kasus putusan pengadilan tata usaha Negara serang yang bernomor : 54/G/ 2016 / PTUNSRG. Secara khusus skripsi ini mencoba membahas latar belakang, pertimbangan hukum yang ada dalam putusan. Disamping itu, skripsi ini juga membahas yang seharusnya dilakukan oleh setiap pihak yang bersengketa untuk mengakses keadilan yang lebih tepat dan cepat. Penelitian dalam jurnal ini mennggunakan pendekatan penelitian kepustakaan (library research) melalui pendekatan  perundang-undangan  (statute  approach) , Penelitian  ini  menggunakan metode  pengumpulan  data  berupa  studi  pustaka.  Melalui  studi  pustaka  peneliti mengumpulkan dokumen dan data untuk diolah menggunakan metode analisis isi. Hasil  penelitian  menunjukkan  bahwa Undang – undang dan hasil putusan yang mengatur untuk menyelesaikan sengketa kepemilikan tanah yang bersertifikat ganda dengan mengedepankan asas keadilan belum  memberikan kepastian hukum yang baik. Terbukti dengan adanya beberapa pasal dalam UU Agraria dan aturan dalam internal BPN yang masih menimbulkan pertanyaan soal penyelesaian sertifikat ganda di masa mendatang.

Abstract

This study analyzes the breach of contract (wanprestatie) committed by a franchisee in executing the agreement established with the franchisor. The research adopts a statute approach combined with an analytical approach to examine the relevant legal provisions and their practical implications. The findings indicate that RL, as the franchisee, failed to fulfill contractual obligations under the agreement with MYSalon, the franchisor. Initially, MYSalon demonstrated good faith by summoning the franchisee and offering an opportunity to settle outstanding payment obligations. However, the franchisee refused to comply and instead unilaterally closed the MYSalon outlet under their management while filing a lawsuit before the South Jakarta District Court. To prevent the franchisor’s claim from becoming illusory and to ensure compensation for material losses, the franchisor requested the court to impose a conservatory attachment (conservatoir beslag) on all movable assets, equipment, and furniture owned by the franchisee across all managed outlets. Furthermore, the franchisor petitioned the court to prohibit the franchisee from using the MYSalon name and trademark, which legally belong to the franchisor.
