This is the result of research that aims to explain the legal and political civilization civilized in Isla philosophical perspective. With literature study method and the philosophical approach of the data collected, verified and analyzed. The results showed that as the core of the Islamic civilization which can affect all aspects of human life and therefore civilization should become a legal political concept in accordance with Islamic values that have alignments to the virtues of the world of human life and the hereafter. Political law as a legal way to achieve legal establishment have made many disalahgunkan for maneuvering behind the legality of the law. The necessity to fix the legal politics only interest-oriented materialistic secular with Islamic philosophy, as with the values of Islam that comes from God as the highest authority over all can be transformed into a real life human being, so that the safety and happiness of the world and the hereafter can achieved.

Artikel ini merupakan hasil penelitian yang bertujuan untuk menjelaskan pemahaman tetang hukum dan keaslian hukum di Indonesia berdasarkan nilai-nilai sosial budaya yang ada di masyarakat. Metode penelitian yang digunakan adalah filsafat. Dengan metode filsafat dapat menganalisis dan menjelaskan permasalahan hukum lebih dalam. Hasil penelitian menunjukkan bahwa hukum lebih dominan dipahami sebagai positivisme hukum dalam bentuk peraturan perundang-undangan tertulis yang dibuat oleh negara. Padahal sosial budaya yang dipraktikkan oleh masyarakat dapat menjadi sumber hukum yang otentik di Indonesia, karena mengandung nilai-nilai kebijaksanaan pandangan hidup yang tercermin dari adat istiadat dan agama yang dianut masyarakat. This study aims to explain social reality as the authenticity of Indonesian law and criticism of legal positivism in the legislation. This study using a literature study research method with a legal philosophy approach. Data obtained from the results of literature studies on several scientific works related to the theme of the problem. Data analysis was performed using descriptive, evaluative methods. The results of the research show that there is an incorrect understanding of the law in society. This is because the legal system used in Indonesia still refers to the legacy of the Dutch colonialists. Law is only understood as mere legislation. Apart from that, it is not considered law, such as social realities in people's lives. Laws must be written and issued by state institutions, not norms that arise from social life in society. The law's impact is dry from the social values of society so that the law is far from the sense of justice that is expected by the community. This study is expected to provide benefits to uphold the authentic Indonesian legal sovereignty that originates from the social realities of society. So that Indonesia is free from the bad influence of the legacy of the Dutch colonial legal system because the social reality of society is the original form of Indonesian law.

Hukum syariah dalam lembaga keuangan syariah dinilai masyarakat belum dapat memberikan jaminan kepastian hukum yang jelas. Karena terdapat beberapa ketentuan yang belum masuk dalam hukum positif di negara ini. Beberapa ketentuan hukum keuangan syariah masih belum secara tegas mengatur tentang praktek-praktek keuangan syariah, seperti besarnya bunga yang dianggap halal atau haram, pengadilan yang berwenang memutus permasalahan keuangan syariah, praktek bagi hasil yang hampir sama atau bahkan lebih besar dengan sistem bunga dan permasalahan lain yang menghambat pengembangan keuangan syariah. Sehingga masyarakat yang sejak berpuluh-puluh tahun diajari menggunakan konsep konvensional, menganggap lebih aman dengan jaminan hukum positif yang pasti dari negara. Masalah kepercayaan masyarakat tersebut kiranya cukup beralasan dan menjadi koreksi positif dalam membangun keuangan syariah di Indonesia kedepan. Dalam sistem masyarakat yang menuju kearah modern, jaminan kepastian hukum sangat diperlukan. Sehingga diperlukan suatu tata hukum yang baik, sehingga masyarakat yakin akan keamanan dalam bertransaksi di lembaga keuangan syariah. Urgensi jaminan kepastian hukum keuangan syariah adalah sebagai landasan dasar, rencana aksi, aturan main, pemutus permasalahan, kontrol dan pengawasan dalam transaksi keuangan syariah. Diperlukan konsep hukum dalam keuangan syariah yang melindungi kepentingan masyarakat secara umum dan jauh dari praktek-praktek kapitalisme. Sehingga sesuai dengan prinsip-prinsip dalam ajaran Islam sebagai agama yang meyelamatkan. Kata kunci: jaminan, kepastian hukum, keuangan syariah

This paper aims to know the concept of adab as the politics of Islamic law. Only Islam has the adab to organize people in all spheres of life while still being able to keep up with the times. Islam as a civilized religion wants the good of the world and here after by making human beings as khamil who believe and piety to Allah SWT is evidenced by obedience to His laws as dijelskan in al-Qur’an and Hadith. Adab is a basic principle typical of Islam which contains the values and rules of law that govern human life. Adab contains an inner philosophy of life that explains the lives of the past, present and future. The dimensions of space and time covered in adab can always follow global developments, so that there is an eternal politics of Islamic law as a way for the Islamic law that governs the good of human beings to be the main grip in living life. It is important that the role of adab in the development of the ummah, because it contains about the laws of Allah SWT to regulate acceptable human life and become the main need to practice it, because the goodness that is in it is desired by the whole people. The value contained in it is able to reduce the egoism and fanatic sentiments that are often spread by interested parties. As the politics of Islamic law, adab contains the wisdom of life, contained in it can provide widespread benefit to all mankind.

This article aims to explain the problem of national positive law which dried up religious values and efforts to transform Islamic values into national positive law. The research method used is socciological jurisprudence which studies law as behavior related to positive legal norm systems. The results showed that Indonesian law used a civil law system inherited from the Dutch colonizers who understood the law as a form of written legislation that was not related to life values, including religion. Dictotomic law is separate from religion. The impact of the law becomes secular, only related to worldly matters, so breaking the law is not a sin. Therefore it is necessary to transform Islamic values into positive national law so that law is understood as part of obedience to God. Obeying the law also means a form of worship. Transforming Islamic values is to use values in Islam that are considered good, important and beneficial. Transformation results in the integration of law and religion into a single legal system that is formed from the legal authenticity of Indonesian people who are predominantly Muslim. This means the same as building an Islamic civilization without establishing an Islamic state. Abstrak Artikel ini bertujuan untuk menjelaskan permasalahan hukum positif nasional yang kering nilai-nilai agama dan upaya melakukan transformasi nilai-nilai Islam ke dalam hukum positif nasional. Metode penelitian yang digunakan adalah sosciological jurisprudence yang mengkaji hukum sebagai perilaku yang terkait dengan sistem norma hukum positif. Hasil penelitian menunjukkan, bahwa hukum Indonesia menggunakan civil law system warisan penjajah Belanda yang memahami hukum sebagai bentuk peraturan perundang-undangan tertulis yang tidak terkait dengan nilai-nilai kehidupan, termasuk agama. Hukum terdikotomik terpisah dari agama. Dampaknya hukum menjadi sekuler, hanya terkait dengan urusan keduniawian, sehingga melanggar hukum bukan merupakan dosa. Oleh karena itu perlu mentransformasikan nilai-nilai Islam ke dalam hukum positif nasional agar hukum dipahami sebagai bagian dari ketaatan kepada Tuhan. Mentaati hukum berarti juga bentuk dari ibadah. Mentransformasikan nilai-nilai Islam adalah menggunakan nilai-nilai dalam Islam yang dianggap baik, penting dan bermanfaat. Transformasi menghasilkan integrasi hukum dan agama ke dalam satu kesatuan sistem hukum yang terbentuk dari otentitas hukum masyarakat Indonesia yang mayoritas beragama Islam. Hal ini berarti sama dengan membangun peradaban Islam tanpa mendirikan negara Islam.

This study aims to explain the integral legal thinking which is constructed based on the values of Pancasila. In this study using a literature study research method with a philosophical approach. The data in the research such as; books, journals, articles and various scientific works are collected through library research. The data analysis technique used descriptive, hermeneutic and heuristic analysis. The results of the research show that it is important to make Pancasila an integral legal thinking in Indonesia, because of the strategic position of Pancasila in the life of the nation and legal issues that urgently need reform in accordance with the norms that live and develop in society as reflected in the values of Pancasila. Good law is law that is excavated from authentic sources, namely laws that apply in the real life of everyday people, not foreign laws that are imposed as a result of the colonial legacy. The integral legal thinking of Pancasila is a way of thinking, acting and acting legally based on the values of divinity, humanity, Indonesian unity, deliberation and social justice for all Indonesian people.

This paper is a study of research results that aims to explain the birth of local autonomy from the results of constitutional reform as a form of governance following the community's aspirations. In the past, the problem of the centralized government system did not provide opportunities for regions to regulate and manage their regional government. It was considered undemocratic and did not bring progress to the people in the regions. Therefore, significant changes to the government system in the most aspirational areas through local autonomy are needed. This study, using a normative juridical research method with a philosophical approach. The research results obtained an understanding of the existence of local autonomy as a form of constitutional reform, which is the aspiration of the will of the people in the regions. With the constitutional reform, the system has changed to become decentralized. It has a closer relationship with the people in the regions and can understand the needs of the lower classes. The constitution, with its amendments, can create a democratic system of government and ensure public participation in the life of the state.
