Abstract

An adopted child defines as a child’s rights are transferred from original parents, legal guardian, or other people who are responsible for the care, education, and nurturing of the child, into adoptive parents based on a decision or court order, as regulated in Article 1 Number 1 Government Regulation No. 54 of 2007 about the Implementation of Child Adoption.Children adoptions apply for both married couples and women or men who are single as long as they have a highly motivated to raise a child. In the process adoption, the prospective adoptive parents need a statement from the parents when handing over the child. Adoption of children hasbecome a practice among Indonesian people and has been taken up by religious and non-Islamic state judiciaries. Adoption does not break the blood relationship between the adopted child and his or her born parent. Section 6 (1) states that adoptive parents are obliged to notify the adoptive child of the birth and birth parent, and Section 6(2) takes into account the motivation of the child in question for birth and birth parent notification. moreover, adoption of a child is considered valid if a court decision is made and entered into the registry documents.

Abstract

Packaged food is a food product that is widely circulated and free in the community. Foods that will be circulated for consumption so as not to harm consumers must include adequate, correct, honest and responsible information. So that every business actor in the food sector that is circulated is burdened with responsibility, especially if the food he produces causes losses to consumers. Based on the Decree of the Regent of Sintang Number: 510/156 / KEP-INDAGKOP-C/ 2015 dated February 27, 2015, on the Integrated Supervision of Hazardous Materials Abused in Food, a joint team chaired by the Sintang DistrictHealth Office held a raid in the Junjung Buih market and the shops in the Sintang Inpres Market. Abstract

Penerapan hukum terhadap ganti rugi keuangan dan barang daerah kabupaten Sintang secara yuridis menjadi suatu model untuk menyelesaikan permasalahan administratif khususnya kerugian keuangan dan barang daerah dalam tataran pemerintah daerah yang dijalankan oleh Inspektorat Kabupaten Sintang. Kedudukan Majelis Pertimbangan Tuntutan Ganti Rugi Keuangan dan Barang Daerah dengan demikian menjadi kehendak pemerintah daerah dan bukan menjadi kehendak pembentuk Undang-Undang. bendaharawan jika dalam pengurusannya terdapat kekurangan perbendaharaan dan kepada bendaharawan yang bersangkutan diharuskan mengganti kerugian. Yang dimaksud dengan kerugian daerah dalam Permendagri tersebut adalah berkurangnya kekayaan daerah yang disebabkan oleh suatu tindakan melanggar hukum atau kelalaian bendaharawan atau pegawai bukan bendaharawan dan/atau disebabkan oleh suatu keadaan di luar dugaan dan di luar kemampuan manusia (force majeur). Inspektorat merupakan unsur penunjang Pemerintah Daerah di Bidang Pengawasan yang dipimpin oleh seorang Kepala Badan yang berada di bawah dan bertanggungjawab kepada Kepala Daerah (Gubernur/ Bupati/ Walikota) melalui Sekretaris Daerah. Inspektorat mempunyai tugas melaksanakan pengawasan fungsional terhadap penyelenggaraan Pemerintahan Daerah dan Pengelolaan Badan Usaha Milik Daerah serta Usaha Daerah lainnya.

Abstract

The protection of labour in Indonesia must be carried out by each entrepreneur or company that hire employee to work for the company for the purpose to have a responsibility toward the maintenance and the improvement of welfare, it is carried out as labour social security form which plays such commonly implemented or as a primary, provides a decent wage, an appropriate working hours based on the applicable regulations and the workers’ rights. The method used by the researcher is a sociological juridical approach with an descriptive research analysis. In data collecting, this reasearch used a field studies and literature. Moreover, the reasearcher used qualitative-descriptive for technique data analysing; the author does not use lists of tables, numbers and statistical formulas in thesis writing. The result of this research are; there is an employees of Indomaret occupied call as contract worker for 2 years and it is extended for 2 years continuously. In during that process the workers’ rights have not been fulfilled and the worker efforts their rights through deliberation but it does not got results. In conclusion, there is no protection regarding with the employment agreement in the specific time as stated in article 59 paragraph (2) and paragraph (4) which states that PKWT cannot be implemented for a permanent employee and in a period of more than 3 (three) years with a contract extension every once a year. Moreover, it can be interpreted in paragraph (7) which stated that the violations of Article 59 paragraph (2) and paragraph (4) this will result in the PKWT being legally changed to PKWTT. This research suggests several point of view, namely: to apply a legal protection to contract workers in accordance with the labour law, every workers has the rights that must be given, especially in the fields of wages, occupational safety and health. Likewise, for a contract workers who have not receive their rights as workers are required to seek settlement through an industrial relations quarrels.

Abstract

An adopted child is stipulated in Article 1 point 1 of Government Regulation No. 54/2007 concerning the Implementation of Child Adoption. A child’s rights are shifted from parents, a legal guardian, or other who has responsible for the care, education, and the grow of child in the family environment of his or her adoptive parents. Child adoption does not only belong to married couples but also for a single women or men are allowed as long as they have a strong motivation to take care for a child. The process that must be carried out through a parent’s statement when handing over the child. Child adoption has become a familiar in Indonesia and has been housed through the Religious Courts Institution for Muslims and the State Courts Institution fornon-Muslims.Child adoption does not sever the blood relations toward his or her biological parents. In article 6 paragraph (1) states that adoptive parents are obliged to inform their adopted child of their backgrounds and biological parents, and as Article 6 paragraph (2) the notice of biological parents is carried out by considering with the readiness of the child concerned. Thus, the child adoptionis valid if a court decision has been made and recorded in the civil registry deed.
