Abstract

The use of patient medical records for hospital payment claims is in essence contrary to the medical records confidentiality rules. This study aims to review the judicial use of medical records in the verification of health care financing in the era of national health insurance. This research uses descriptive study method with normative juridical approach. Qualitative data comes from literature review such as primary, secondary and tertiary law. This study indicates that verifiers with the status of health workers have the legal authority to use patient information in medical records as they relate to the profession. Medical secrets can be opened in the context of quality control and health care costs. Quality control through medical audit, and cost control with health service utilization. This study recommends that verifiers be selected from medical personnel and therefore have the authority to open a medical record.

Abstract

The purpose this paper is to analyze the effectiveness of the implementation of the program in the regional regulation on regional health insurance plus in Sinjai Regency. This study uses an empirical legal research type, using a statutory approach and a conceptual approach. The data used are primary data and secondary data obtained through interviews and literature study, the data collected is then analyzed qualitatively. The results showed that the implementation of the program in the regional regulation on regional health insurance plus in Sinjai Regency was effective. In the context of implementing government affairs in the health sector in Sinjai Regency, in the context of implementing government affairs in the health sector in Sinjai Regency, statistics show that in 2021, there will be 9.77 percent of morbidity rates. Then, in terms of health care facilities, it can be seen that in 2021 in Sinjai Regency, there will be 1 hospital, 0 maternity homes, 16 community health centers with 10 ordinary categories, 5 remote categories, 1.88 very remote categories. community health assistants with the usual category of 0 mobile community health centers, 364 posyandu and 59 supporting public health center (puskesmas pembantu/pustu) and Poskesdes as many as 13. Furthermore, regarding the sociological conditions in the administration of health affairs in Sinjai Regency, related to infectious disease sufferers in 2021, it can be seen that based on the classification of the 10 most common types of disease, there were 9048 cases of hypertension, 6,509 cases of dyspepsia, 4,203 acute respiratory infection, 3599 dermatitis and eczema, 3381 cases of myalgia, 2459 cases of fever with unknown cause, and 2072 cases of cephalgia. Common cold as many as 1871 cases, caugh/cough in 1850 cases, and non-specific diabetes mellitus in 1845 cases. However, home care and home visit service programs, public safety center 119, one-stop outlets, and patient shelters have made it possible to handle it properly.

Abstract

Abstrak Penelitian ini bertujuan untuk mengetahui dan menganalisis permohonan pernyataan pailit terhadap BUMN dan Pertimbangan Hakim Terhadap BUMN yang dinyatakan pailit. Dengan menggunakan metode penelitian hukum normatif. Bahan hukum yang di peroleh kemudian disusun secara sistematis selanjutnya dianalisis secara kualitatif untuk mencapai kejelasan masalah yang akan diteliti. Hasil penelitian yang diperoleh menunjukkan bahwa Pasal 2 ayat (5) UUK-PKPU mengharuskan permohonan pernyataan pailit hanya dapat diajukan oleh Menteri Keuangan. Terlebih lagi dalam Putusan MK Nomor 48/PUU-XI/2013 dan Putusan MK Nomor 62/PUU-XI/2013 menyatakan bahwa status kekayaan BUMN merupakan Kekayaan Negara. Berdasarkan kedua Putusan MK tersebut juga dapat menjawab terkait dengan banyaknya interpretasi dari Pasal 2 ayat (5) tersebut. Kemudian Pertimbangan Hakim dalam memutuskan kepailitan terkait dengan PT. Kertas Leces (Persero) sudah berdasarkan ketentuan Pasal 291 UUK-PKPU dan dalam pembuktiannya di persidangan, terbukti lalai dalam memenuhi isi dari perdamaian, mengakibatkan PT. Kertas Leces (Persero) dinyatakan pailit. Terhadap pertimbangan hakim dalam upaya hukum peninjuan kembali yang dilakukan tersebut sudah tepat sesuai ketentuan Pasal 293 UUK-PKPU yang bahwa terkait pembatalan perdamaian tidak terbuka upaya hukum. Kata kunci: Hukum Kepailitan, Badan Usaha Milik Negara (BUMN), Kepailitan BUMN, Kekayaan BUMN Abstract This study aims to find out and analyze the request for bankruptcy statements of SOEs and judges' considerations of SOEs declared bankrupt. By using normative legal research methods. The legal material obtained is then arranged systematically and then analyzed qualitatively to achieve the clarity of the problem to be examined. The results of the study showed that Article 2 paragraph (5) of the UUK-PKPU required the request for bankruptcy statements to only be submitted by the Minister of Finance. Moreover, in the Constitutional Court's decision Number 48/PUU-XI/2013 and MK Decision Number 62/PUU-XI/2013 states that the status of BUMN wealth is a state wealth. Based on the two Constitutional Court decisions, they can also answer related to the number of interpretations of Article 2 paragraph (5). Then the judge's consideration in deciding bankruptcy related to PT. Paper leces (Persero) is based on the provisions of Article 291 of the UUK-PKPU and in its proof at the trial, proven to be negligent in meeting the contents of peace, resulting in PT. Paper leces (Persero) is declared bankrupt. Regarding the judge's consideration in the legal remedies carried out the exactly carried out in accordance with the provisions of Article 293 of the UUK-PKPU which related to the cancellation of peace is not open to legal efforts.
