Pasal 54 Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika mengatur bahwa pecandu narkotika dan korban penyalah guna narkotika wajib menjalani rehabilitasi medis dan sosial. Selanjutnya pasal 127 ayat (3) undang-undang tersebut menyatakan bahwa dalam hal penyalah guna dapat dibuktikan atau terbukti sebagai korban penyalahgunaan narkotika, penyalah guna tersebut wajib menjalani rehabilitasi medis dan rehabilitasi sosial. Pengaturan tersebut membuka peluang bagi orang yang sedang dalam proses hukum terkait kasus narkotika untuk mengajukan rehabilitasi medis dan rehabilitasi sosial. Dapat atau tidaknya menjalani proses rehabilitasi pada tahap penyidikan dan penuntutan akan tergantung kepada proses asesmen yang dilakukan. Proses asesmen ini berperan penting dalam menentukan rehabilitasi terhadap penyalah guna narkotika. Rumusan masalah yang akan dibahas, yaitu: 1) Bagaimanakah proses asesmen terhadap pecandu narkotika pada tahap penyidikan dan penuntutan, 2) Bagaimanakah koordinasi penyidik dan penuntut umum dengan lembaga rehabilitasi medis dan rehabilitasi sosial. Metode penelitian yang digunakan adalah penelitian yuridis sosiologis. Penelitian ini bersifat deskriptif dengan analisis data dilakukan secara kualitatif. Hasil penelitian menunjukkan bahwa terhadap penyalah guna narkotika yang menjalani proses hukum pada tahap penyidikan atau penuntutan dapat menjalani rehabilitasi medis dan rehabilitasi sosial setelah melalui proses asesmen. Proses asesmen dilaksanakan oleh Tim Asesmen Terpadu yang terdiri dari Tim Hukum dan Tim Dokter. Melalui Tim Asesmen Terpadu akan ditentukan apakah seorang tersangka atau terdakwa penyalah guna narkotika sebagai pengedar atau pecandu narkotika serta melalui Tim Medis akan diuji kandungan serta tingkat keparahan pengguna narkotika. Apabila berdasarkan pemeriksaan Tim Asesmen Terpadu diputuskan dapat menjalani rehabilitasi medis, maka tersangka atau terdakwa penyalah guna narkotika akan diserahkan ke lembaga rehabilitasi. Koordinasi antara penyidik atau penuntut umum dengan lembaga rehabilitasi medis dapat dilihat dari awal penyerahan, pelaksanaan, hingga penyerahan kembali kepada penyidik atau penuntut umum. Khusus untuk rehabilitasi yang dilaksanakan dengan rawat jalan, kewenangan menghadirkan tersangka atau terdakwa yang direhabilitasi ada pada lembaga yang menyerahkan (penyidik atau penuntut umum).

Village Owned Enterprise is an important part of the form of empowerment economic community at the village. Given, the urgency of the existence of Village Owned Enterprise, the government through the Regulation of Ministry of Villages, Disadvantaged Regions and Transmigration No. 5 of 2015 stated that one of the priorities of the use of village funds is for the establishment and development of Village Owned Enterprise. While the mechanism of establishment of Village Owned Enterprise is based on the result of village consultative meeting involving element of village government, element of village consultative body, and elements of community figures. The result of the village consultative meeting is implemented in form Village Regulation. However, it causes anomaly related to the status of Village Owned Enterprise, because it does not have to be legal entity in Regulation of Ministry of Villages meanwhile it has to be legal entity in Regulation of Minister of Home Affairs No. 39 of 2010 on Village Owned Enterprise.

The implementation of an online single submission risk-based approach (OSS RBA) is a manifestation of a government program to increase investment in a region. Business risk classification is an instrument of the Central Government and Local Government in controlling business activity. This study aims to find out the readiness of the local government to implement an online single submission risk-based approach. The method of the study is empirical legal research. The result of this study shows that Padang City has issued Mayor Regulation No 43 /2021 on Guidelines and Procedures of an online single submission risk-based approach Supervision as a follow-up to Government Regulation No. 5/2021 on implementation of online single submission risk-based approach; meanwhile, several other regions are in the process of drafting local regulations relate to implementing online single submission risk-based approach in West Sumatera Province. The challenges of local government to implement OSS RBA consists of indefinite license periods in the particular business field (Appendix I Government Regulation No 5/2021), the regional support system has not integrated OSS RBA and the readiness for the transition from manual RDTR to digital RDTR in West Sumatera.

The use of social media in online investment activities should ideally provide convenience to the public for investing their assets. The prevalence of online investments within the community does not rule out the possibility that some of them are illegal or unauthorized investments, leading to losses for citizen. Legal protection can be provided to investors namely domains of illegal futures brokerage companies, cessation of illegal futures trading promotion, monitoring and observation of illegal futures trading sites by the regulatory authority. However, there are no explicit rules regarding penalties for influencers promoting binary option trading due to the lack of clear regulations about binary options. The research questions addressed in this study are: What is legal protection to investors in illegal investments YouTube? What is the function of BAPPEBT) to prevent illegal investments due to online influencer promotions YouTube? This research uses the normative juridical. The Conclusion of the research are BAPPEBTI offers preventive protection to the public by continually monitoring and educating about investment procedures in line with regulations. BAPPEBTI can block illegal sites based on regulation, but it can’t prohibit binary option trading due to the persistent emergence of domain sites. Contradictory regulations regarding the submission of claims for Restitution and Compensation result in investors lacking legal protection. BAPPEBTI’s role involves ongoing efforts in monitoring, observation, blocking illegal investment websites, education, and public awareness campaigns. BAPPEBTI is also part of the anti investment scam task force to halt investment solicitation and remove content related to Quotex and binary options.

BPJS Kesehatan adalah lembaga negara yang bertugas menjalankan program jaminan kesehatan nasional bagi seluruh masyarakat Indonesia. Meskipun BPJS Kesehatan berperan dalam memberikan pelayanan kesehatan, dalam pelaksanaannya, masih terdapat beberapa kendala. Salah satunya adalah keluhan dari peserta BPJS Kesehatan mengenai pengadaan obat pada fasilitas kesehatan. Penelitian ini menggunakan metode yuridis normatif. Hasil penelitian menunjukan bahwa Puskesmas sebagai bagian dari upaya kesehatan menyelenggarakan layanan kesehatan yang mengutamakan promotif dan preventif untuk mencapai derajat kesehatan yang seitinggi tingginya puskesmas diharapkan tidak mengesampingkan pemberian jaminan pelayanan kesehatan kuratif serta rehabilitatif pada seluruh masyarakat yang membutuhkan serta dapat selalu memastikan pemberian dan pengadaan obat untuk peserta BPJS Kesehatan dapat optimal. Akibat hukum yang dapat terjadi pada kasus ini mencakup ketentuan Pasal 1365 KUHPerdata tentang perbuatan melawan hukum. Dalam hukum perdata, sanksi yang dapat diterapkan berupa ganti kerugian yang diberikan oleh BPJS Kesehatan atau fasilitas kesehatan kepada pasien yang dirugikan, seperti pengembalian uang, penggantian barang dan/atau jasa, perawatan kesehatan, atau pemberian santunan.BPJS Kesehatan, sebagai lembaga negara yang bertanggung jawab menjalankan program jaminan kesehatan membentuk unit pengaduan untuk masyarakat. Salah satu programya adalah BPJS SATU (Siap Membantu). Jika masalah tidak dapat diselesaikan melalui unit pengaduan, proses penyelesaian selanjutnya melalui mediasi, dan BPJS Kesehatan bertanggung jawab untuk membantu proses tersebut sebagai mediator.

Indonesia Deposit Insurance Corporation (LPS) as the institution that has function to provide security guarantees of financial transactions should also consider the risk of the financial system built by financial Technology (Fintech). Financial Services Authority (OJK) has announced that 231 Fintech Peer to Peer Lending (P2P) are illegal. This research endeavors to answer the following questions: how is the function of LPS in Financial Technology Era and how is the readiness of Indonesia LPS in the face of Financial Technology Era. This research applied normative or legal research in answering the questions. The study concludes that even though Fintech is not the banking institution, so that deposit Fintech is not guaranteed by LPS. However, with technological developments and community needs for financial services, LPS should strive to encourage economic growth, while still doing its function to maintain the stability of financial system through the transformation of the function of Indonesia LPS, then it should form regulations that are institutionally integrated with Bank Indonesia and OJK in dealing with uncertainty about the risks caused by the Fintech industry. LPS should also prepare human resource by forming a fintech division to face the development of the fintech business

A business decision is very important to determine the quality of the Board of Directors in carrying out their duties professionally and responsibly as expected by Good Corporate Governance (GCG). The effectiveness of the Board of Directors is the center of the implementation of Good Corporate Governance. Bank Business is very risky (such: credit risk, reputation risk, etc.). The Board of Directors in making a business decision, will always face unpredictable condition. In Banking practice, the Head of Branch Office Bank is the extension of Director, if the Head of Branch Office Bank signs credit agreement out of the rules (plafond). His action has categorized as ultra vires, so the consequence is the Head of Branch Office Bank can be held responsible for his action. In this case, the Board of Directors has not taken responsibility for the action of the Head of Branch Bank, based on Business Judgment Principle, the Director has not taken its responsibility for ultra vires act which is done by the Head of Branch Office Bank, as along as Director has managed the Company in good faith, carefully and does not against the law. Therefore, Business Judgment Principle gives legal protection to the Director in making a business decision

Online Single Submission is a system developed by the government by reforming the administrative mechanism of business licensing services. The aim of this study is to find out the implementation of Government Regulation Number 24 Year 2018 concerning Electronic Business Licensing Services or Online Single Submission (OSS) fundamentally changing the permit issuance system from complicated to simple in West Sumatra. The method of research is empirical juridical. This research endeavours to answer the following questions : how to implement the Government Regulation Number 24 Year 2018 concerning Electronic Business Licensing Services to boost the investment in West Sumatra and what the obstacles faced in implementing Government Regulation Number 24 Year 2018 concerning Electronic Business Licensing Services to enhance the investment in West Sumatra and make the efforts to alleviate the issues. The result of this research shows that OSS has been implemented since 2018 in West Sumatra through the use of the OSS Version 1.0 application published by the Central Government. Furthermore, the implementation of OSS by the government of West Sumatra is also supported by the SIPSAKATO (SAKATO Licensing Information System) application related to addressing the essence of an integrated OSS system both at the Ministry level and the Regency or City levels. In practice, the implementation of OSS Version 1.0 had many weaknesses, thus the Government issued OSS version 1.1 to replace OSS Version 1.0. The use of the OSS Version 1.1 application is strengthened through the issuance of Government Regulation Number 5 Year 2021 concerning the Implementation of Risk-Based Business Licensing. The obstacles in the implementation of OSS in West Sumatra include the lack of understanding or education of the public regarding information on the licensing service process through OSS, as a result, it has logical consequences for the readiness of the government through related agencies on the importance of education and socialization to business actors due to the technical mechanism for digital licensing has an impact on the perception and readiness of business actors in implementing OSS. The availability of adequate human resources is expected to be able to provide the integrated education and socialization related to providing benefits, forming a positive perspective between agencies or institutions in communicating the role of OSS in economic growth. All stakeholders are expected to work together in supporting OSS system to improve the domestic and foreign investment in West Sumatera.

The government issued several regulations to stimulate the economy that have worsened due to the Covid-19 pandemic. The issuance of Regulation of the Financial Services Authority No. 18/2020 on Written Directives for the Handling of Distressed Banks, so Financial Services Authority has authority to give written directives to financial services institution to do merger, consolidation, acquisition, integration, and conversion. This research aims to analyze the legal implications of the issuance of Regulation of the Financial Services Authority No. 18/2020 on Written Orders for Handling of Distressed Banks, which resulted in monopolistic practices and unfair competition. It is contrary to Law No. 5/1999. This research endeavors to answer the following questions: how the merger strategy to increase economic stability during the Covid-19 Pandemic and the obstacles faced implementing the merger to increase economic stability during the Covid-19 Pandemic, and the efforts that can be made to overcome it. The research method used is juridical normative. The study concludes that the relevant merger strategy approaches to be applied by banks during the pandemic are Horizontal Mergers and Market Extension Merger. The second approach to the merger strategy can be a consideration for banks to implement Regulation of the Financial Services Authority No. 18/2020. The obstacles faced to implement the merger are the Bank's unreadiness in responding to Regulation of the Financial Services Authority No. 18/2020 because the complicated merger process does consider the tangible assets of the banking system and aspects intangible assets. Then, the overlap of several Regulations with the issuance of Regulation of the Financial Services Authority No 18/2020 (the overlap Regulation of the Financial Services Authority No 18/2020 on Written Orders for Handling of Distressed Banks with Law No. 5/1999 on Prohibition of Monopolistic Practices and Unfair Business Competition and Government Regulation No. 57/2010 on Merger or Consolidation of Business Entities and Acquisition of Shares which May Result in monopolistic Practices and Unfair Business Competition). It can have an impact on monopolistic practices and unfair business competition.

This research aims to analyze the independence of the Financial Services Authority (OJK) after the promulgation of Law No. 4 of 2023 on the Development and Strengthening of the Financial Services Sector. This research addresses the following problems, how independent is the OJK after the promulgation of Law No. 4 of 2023 on the Development and Strengthening of the Financial Services Sector; and what are the challenges faced by OJK in building relationships between financial services sector developments after the promulgation of Law No. 4 of 2023 on the Development and Strengthening of the Financial Services Sector. This research uses a normative juridical method with statutory and conceptual approaches. This research concludes that the enactment of Law No. 4 of 2023 on the Development and Strengthening of the Financial Services Sector poses challenges in maintaining the independence of the OJK in carrying out its authority as there are several provisions governing the consultation between the OJK and the House of Representatives (DPR) which can affect the independence of the former. The challenges faced by OJK in maintaining the stability of the national financial sector should be supported by providing independent authority, especially in aspects of regulation and supervision. This is due to the fact that the regulatory and supervisory aspects are the primary factors that reflect the integrity of stakeholders in OJK. The existence of a budget supervision for OJK and its consultation body with the DPR provides challenges for the OJK in the planning, implementation and evaluation process of the work programs being developed. The potential intervention from DPR towards the authority of OJK should be based on the importance of understanding the regulatory, supervisory, institutional and budgetary independence mechanisms so that they serve a positive impact on the development of the institutional role of OJK in managing the financial services sector.Keywords: Financial Services Authority, House of Representatives, Independence. AbstrakPenelitian ini bertujuan untuk menganalisa Independensi OJK setelah di undangkannya UU No. 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Jasa Keuangan. Penelitian ini menjawab permasalahan bagaimana independensi OJK pasca diundangkan UU No. 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Jasa Keuangan dan apa tantangan yang dihadapi oleh OJK dalam membangun hubungan antar kelembangan sektor jasa keuangan pasca diundangkan UU Nomor 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Jasa Keuangan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan undang-undang dan konseptual. Penelitian ini menyimpulkan bahwa dengan diterbitkannya UU No. 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Jasa Keuangan memberikan tantangan dalam menjaga independensi OJK dalam menjalankan kewenangannya karena terdapat beberapa ketentuan terkait konsultasi antara OJK dan DPR yang dapat memengaruhi independensi OJK. Tantangan yang dihadapi oleh OJK dalam menjaga stabilitas sektor keuangan nasional hendaknya didukung dengan memberikan kewenangan yang bersifat independen khususnya pada aspek regulasi dan supervisi. Hal ini dikarenakan aspek regulasi dan supervisi merupakan faktor utama yang merefleksikan integritas OJK pada stakeholders. Keberadaan badan supervisi dan konsultasi anggaran OJK dengan DPR memberikan tantangan bagi OJK dalam proses perencanaan, implementasi, serta evaluasi atas program kerja yang dikembangkan. Potensi intervensi DPR atas kewenangan OJK hendaknya didasarkan atas pentingnya memahami mekanisme independensi yang bersifat regulasi, supervisi, kelembagaan, dan anggaran sehingga memberikan dampak positif bagi perkembangan peran kelembagaan OJK dalam mengelola sektor jasa keuangan.Kata Kunci: Dewan Perwakilan Rakyat, Independensi, Otoritas Jasa Keuangan.
