Abstract

Sesuai dengan Undang-Undang No. 15 Tahun 2001 tentang Merek dan bentuk pertanggung jawaban bagi pelaku tindak pidana yang memperdagangkan merek palsu dapat dilihat dari segi hukum perdata dengan meminta ganti rugi, dan penghentian menggunakan merek. Dalam hukum pidana dapat berupa hukuman penjara sesuai dengan ketentuan yang berlaku dan juga denda serta dapat sanksi administrasi. Akan tetapi tindakan pemalsuan di bidang merek tetap dilakukan dan pada umumnya bertujuan untuk mendapatkan keuntungan. Seperti diketahui, bahwa kejahatan di bidang merek merupakan salah satu dari aktivitas kriminal yang berkembang cepat yang disebabkan karena adanya perkembangan di bidang teknologi dan informasi. Di sisi lain, berbagai upaya telah dilakukan untuk mengurangi terjadinya tindak pidana dibidang merek mulai dari dibentuknya Undang-Undang No. 15 Tahun 2001 tentang merek serta peningkatan kesadaran terhadap masyarakat untuk mau menggunakan produk asli.  Namun kejahatan di bidang merek ini masihsaja terdapat di dalam masyarakat, bahkan dapat diperkirakan kasus kejahatan terhadap pemalsuan di bidang merek ini meski sudah ditangani, akan terus mengalami peningkatan. Abstract

According to Law No. 25 of 2009, what is meant by public services is an activity or a series of activities in the context of fulfilling service needs in accordance with the laws and regulations for every citizen and population of goods, services and / or administrative services provided by public service providers The problem of public service is a problem that cannot be underestimated by this country, because the main task and obligation of the government, both central and regional, is to serve the public. The public service itself can be understood as all forms of service, both in the form of public goods and public services which in principle are the main responsibility and carried out by government agencies in the center and the regions as well as in the State-Owned Enterprises (BUMN) or in the Owned Enterprise Region (BUMD) in order to fulfill the needs of the community and in the framework of implementing the provisions of the legislation.

Abstract

Government Regulation in Lieu of Law (Perpu) is one type of statutory regulation that must exist in the legal system of the Republic of Indonesia as one of the logical consequences of adopting a presidential system in the government of the Republic of Indonesia whose existence is always maintained throughout the Indonesian constitution. This type of research is normative juridical research and is descriptive qualitative in nature. Data collection methods are library research and field study. The affirmation of the benchmarks of the establishment of the Government Regulation in lieu of this Act has a fundamental difference regarding the urgency of the law according to the 1945 Constitution prior to the amendment to the 1945 Constitution which is currently in force as the result of the 4th amendment. After the reformation, there have been 2 (two) laws governing regional autonomy, especially with regard to regional head elections, namely Law Number 22 of 1999, which was then replaced by Law Number 32 of 2004. The issuance of Perpu Number 1 of 2014 which is a Amendments to Law No. 32/2004 were first proposed for amendments by the Government in this matter proposed by the Minister of the Interior.

Abstract

According to Islamic law, various views of some schools forbid changing or transferring waqf property, while some other schools allow that the assets cannot be taken advantage of or reduced in benefits and must be replaced. Meanwhile, according to legal regulations in Indonesia and the Compilation of Islamic Law allow with certain conditions. This study uses descriptive research and the nature of the research used is included in the category of normative legal research. Legal arrangements regarding the transfer of waqf land in Indonesia are regulated in Presidential Instruction No. RI. 1 of 1991 concerning Compilation of Islamic Law in Article 225 paragraphs (1) and (2), Article 49 paragraph (1) of Law Number 41 of 2004 concerning Endowments, Article 49 paragraph (2) Government Regulation No. 25 of 2018 concerning the Implementation of Law No. 41 of 2004 concerning Endowments. Management of waqf land namely Nazir makes a letter of application for submission of waqf land for public facilities to the Minister of Religion by attaching the certificate of waqf pledge certificate, certificate of proof of ownership of the substitute land for waqf, Tax Object Sales Value (NJOP) of waqf land and its exchanges, spatial plans from local government, and other letters. The resolution of the waqf land dispute is carried out through three stages, namely through deliberation efforts to obtain consensus, mediation, and legal efforts to file a claim to the Religious Court.

Abstract

The purpose of this research is to Know the Arrangements About Buying and Selling Shares, How Legitimate Selling and Selling of Shares. As well as to find out the Step in Settlement of Sales and Purchase Dispute of Company Shares This type of research in this journal is Normative Juridical. Arrangements for buying and selling of shares are regulated in law number 40 of 2007 concerning limited liability companies and the Civil Code and other laws. The validity of the Sale and Purchase of Shares is in accordance with the applicable regulations stipulated in Article 1457 of the Civil Code regarding the sale and purchase of shares while the shares are regulated in articles 40.41.42, and 43 KUHD. Settlement of disputes over the sale and purchase of company shares is resolved through 2 (two) channels, namely through deliberation and settlement through judicial channels.
