Abstract

Islamic insurance products and services adopt many conventional insurance mechanisms including subrogasi. In the aplication, it turned out to contain many problems. Therefore, author was intersted in studying criticaly. This papper was discussed by library research. The approach that used was normatif. The theories that used were the hawālah and takāful/tadāmun concepts. This papper had found that subrogasi was not suitable with islamic law (according to scholar of Hanafi, Maliki, Syafi’i, and Hanabilah) if it was aplicated in islamic insurance because the claim fund was taken from tabarru’ fund acumulation, not from insurance fund. Because of subrogasi contains the advantage and harmfull in islamic insurance, author recomend in order to use wakalah theory. The manager of islamic insurance is positioned as a representative of member to demand compensation against the gulty person

Abstract

It is difficult to find a study of ethical philosophy issues in the history of Islamic civilization. The reason is because it was not written separately by Muslim thinkers. It is discussed in tandem with or mixed with other reviews, such as mixed with reviews of metaphysics, psychology, and so on. This paper attempts to reconstruct the philosophy of ethics in Suhrawardi al-Maqtul's thought through the metaphysical theory that he offers. This is qualitative research that is categorized in the type of library research. The field of research is Suhrawardi's work in the form of text, therefore the method used is hermeneutics. More precisely, the hermeneutics used are the hermeneutics of intentionalism and the hermeneutics of Paul Ricoeur. This research shows that Suhrawardi has provided a well-established ontological view for developing ethical concepts. Suhrawardi symbolically identifies good with light (al-nūr) and bad with darkness (ẓulm). Become a perfect human being when the soul is able to let go of the elements of darkness and merge with the light of goodness. The ethical concept offered by Suhrawardi tends to be mystical-rationalist like his big ideas that accommodate Sufism that is harmonized with philosophy.

Abstract

The growth of the sharia-based creative economy in the digital era presents complex ethical challenges, particularly concerning the commercialization of values, digital plagiarism, and cultural exploitation. The urgency of this research lies in the effort to construct a business ethics paradigm rooted in the epistemology of Islamic law that is not merely normative, but also rational and contextual. The primary objective of this study is to examine how the epistemology of Islamic law can function as a foundation for shaping business ethics within a sharia-based creative economy. This research adopts a qualitative approach with a normative–philosophical orientation, employing a literature review of classical sources such as uṣūl al-fiqh texts, as well as contemporary works in Islamic economics and business ethics. The analytical techniques used include content analysis, hermeneutics, and conceptual analysis. The findings indicate that the epistemology of Islamic law generates a value system that balances economic creativity with moral responsibility through the principles of maqāṣid al-sharīʿah, justice, trust (amānah), and public welfare (maṣlaḥah). The proposed model of sharia-based creative business ethics emphasizes that Islamic law functions not only as a formal regulatory framework but also as a system of value production that shapes ethical awareness in economic innovation. This study recommends further empirical research to strengthen the application of sharia principles within the digital creative economy ecosystem.
