Abstract

Nowadays, in line with technological advances in the field of transportation and telecommunications, in a developing society various new legal institutions are widelyused in practice in our country, namely what we know as periodic sale and purchaseagreements. Judging from the seller's point of view, the emergence of this form of agreement certainly does not cause too many problems. However, it feels safe when viewed from the seller's point of view, it is not the case with the situation felt by the buyer. There are many problems faced by buyers as a result of making regular sale and purchase agreements, especially when we look at the portrait of buyers who make periodic sales and purchase agreements, most of them are buyers whose economic conditions are weak. From the background of the problems that become the problem are: 1) How is the legal protection for buyers who suffer losses due to the making of a periodic sale and purchase agreement 2) How to build a fair law for the parties in a periodic sale and purchase agreement? From the results of the study of the above problems, it can be seen that the main legal protection for buyers is torefer to the contents of the agreement made by the parties and the Consumer Protection Law as its legal umbrella, while efforts to build a fair law for the parties certainly need to pay attention to the existence of various principles underlie the making of an agreement such as the principle of good faith that underlies the making of an agreement.

Abstract

The purpose of marriage according to Law No.1 of 1974 is to form a happy and eternal family based on The One Almighty God, but in reality not all marriages go as expected, often marriages have to run aground in the middle of the road due to conflicts between a married couple who cannot be resolved except with a judge's decision on the demands of one of the parties in the marriage. The occurrence of divorce has consequences for husband and wife, namely after the marriage breaks up due to divorce, the husband and wife are free to remarry, provided that the ex-wife must pay attention to the waiting time. Besides, it will have consequences on the relationship between husband and wife, children and on property in marriage.

Abstract

With the increase in economic development increasingly diverse sources of financing are no longer limited to bank credit loans or sources of money and capital markets. In Indonesian financing law, there are various forms of financing institutions, one of which is a leasing or leasing institution according to article 1 of the Joint Decree of the Minister of Finance, Minister of Industry and Minister of Trade No. 122 / MK / IV / 2/1974, No. 32 / M / SK / 2/1974, No. 30 / Kpb / I / 1974 concerning Leasing Business Licensing, what is meant by leasing is: "Every company financing activities in the form of providing capital goods for use by a company for a certain period of time, based on periodic payments accompanied by voting rights ( option) for the company to buy the relevant capital goods or extend the lease period based on the agreed residual value ". From the formulation above, it turns out to focus more on the economic aspects, so that looking at leasing as an act, economical, which is an activity corporate financing in the form of providing capital goods.

Abstract

According to Article 1338 section 1 of the Civil Code that "all agreements madelegally apply to those who make them". From article 1338 section 1, it can be seenthat there is an open system and the principle of freedom of contracting anagreement.Thus we are allowed to make any agreement and determine its contents and what wehave made is binding as a law. The principle of freedom of contract is also the basisfor an agreement that contains exoneration conditions, namely the conditions in anagreement whereby one party frees himself or is limited to liability imposed on him bythe governing law.The use of exoneration requirements in principle aims at limiting and eveneliminating the creditor's responsibility for certain risks that may arise later in themany execution requirements we encounter in a standard agreement or contractstandard, namely an agreement whose contents have been pre-written in writing inthe forms used in unlimited amount, to be offered to consumers regardless of theconditions of the consumers.The emergence of standard agreements in contract law traffic is based on the need foreffective and efficient service to transaction activities. The form of standard orstandard agreement made by one of the parties is a written form, the contents ofwhich have been determined unilaterally by the strong economy and set forth in astandard clause (article 1 number 10 of Law No. 8 of 1999 concerning consumerprotection)

Abstract

Bank merupakan lembaga keuangan yang mempunyai peranan yang sangat strategis dalam menyerahkan dan mengembangkan unsur – unsur Trilogi Pembangunan nasional. Kegiatan utama dari perbankan adalah menyerap dana dari masyarakat dan menyalurkan kembali kepada masyarakat. Hal ini terutama karena fungsi bank sebagai perantara pihak – pihak surplus of funds (kelebihan dana) dan pihak lack of funds (memerlukan dana).Manurut pasal 3 dan 4 Undang – Undang Nomor 7 Tahun 1992 yang telah dirubah dengan Undang-Undang Nomor 10 Tahun 1998 tentang Perbankan, menyebutkan fungsi dan tujuan perbankan Indonesia, yaitu :Fungsi Utama Perbankan Indonesia adalah sebagai penghimpunan dan penyalur dana masyarakat. Abstract

In principle, the Marriage Law adheres to the principle of monogamy, but it does not rule out those who wish to polygamy as long as their religion and belief allows and can fulfill the requirements stipulated by the Marriage Law. This is reflected in Article 3 paragraph 1 of the Marriage Law which reads: In principle, in a marriage a man can only have one wife, a woman can only have one husband; The court may give permission for a husband to have more than one wife if the parties wish to do so. Thus it can be seen that the principle of monogamy adopted by the Marriage Law is not absolute.
