Abstract

The article covers Al-Ghazali's view on the use of maslahah mursalah as the basis for establishing law in the field of sharia economics. The concept of maslahah mursalah is debated among ulama to be used as the basis for establishing law. The maslahah provides opportunities for the adoption of new innovations that were not previously discussed among ulama and were not rejected by religion. On the other hand, the economy needs sharia support to continue to run in accordance to religious guidance and adapt to the times. By comparing economic principles and maslahah theory, al-Ghazali's view that accepts the implementation of maslahah is found as a solutional view. Nevertheless, al-Ghazali provided conditions and restrictions on the use of maslahah in the economic field so that they will not be chaotic and uncontrolled.Keywords: maslahah mursalah; al-Ghazali; Islamic economics; religious purpose Abstrak: Artikel ini mengulas pandangan Al-Ghazali tentang penggunaan maslahat mursalah sebagai dasar penetapan hukum di bidang ekonomi syariah. Konsep maslahat mursalah diperdebatkan di kalangan ulama untuk dijadikan dasar penetapan hukum. Maslahat ini memberi peluang adopsi inovasi-inovasi baru yang sebelumnya tidak dibahas di kalangan ulama dan tidak ditolak pula oleh agama. Di sisi lain, ekonomi membutuhkan dukungan syariah agar tetap berjalan sesuai tuntunan agama dan beradaptasi dengan perkembangan zaman. Dengan membandingkan prinsip ekonomi dan teori maslahat, ditemukan pandangan al-Ghazali yang menerima penerapan maslahat tersebut sebagai pandangan solutif. Meskipun begitu, al-Ghazali memberikan persyaratan dan pembatasan penggunaan maslahat tersebut dalam bidang ekonomi agar tidak liar dan tidak terkendali.Kata kunci: Maslahah Mursalah; Al-Ghazali; Ekonomi Islam; Tujuan Keagamaan

Abstract

Work agreements between workers and employers form the basis for determining rights and obligations. Employment agreements are influenced by the laws governing a country and its historical experience. This study aims to analyze the influence of international and Islamic law on labor law in two countries, both Indonesia and Morocco. The research method used is a qualitative research method with a comparative approach. The results of the study stated that by comparing the provisions of work agreements from three sources of law, namely Indonesian, Moroccan, and Islamic law, it was found that international law had an effect on national law. Islamic law has little effect on work agreements. The influence of Islamic law is found more in Moroccan regulations than in Indonesian regulations. Several different concepts regulated in the source of law include the concept of work agreements, restrictions on the age of children who can enter into work relationships, the object or work employed, and the designation of work areas. This research has implications for the openness of international work transactions or the acceptance of foreign workers due to the same arrangement although with certain restrictions according to a country's policy.

Abstract

Indonesian halal product regulation has changed. These arrangements have been in numerous rules, but they have not been binding and strong legal instruments. Halal product assurances in the micro industry, especially in Depok City, are continually failing. Sate Taichan Cihuy and Mie Ayam Pelita Solo production research demonstrates that halal product promises have failed. Doctrinal legal study uses qualitative data for normative legal research. The study examined legislative structure, substance, and culture in relation to the implementation of halal product assurances based on Law Number 33 of 2014. The study found that Indonesia's Halal Product Guarantee Act has inspired a system of regulating halal product guarantees to provide certainty, protection, and guarantees for halal items entering, circulating, and trading in Indonesia. Despite legal clarity, the Halal Product Guarantee Act has been poorly implemented. Micro enterprises, mainly in Depok City, have found food goods without halal certificates.
